HomeMy WebLinkAbout2008-107 - Houston LakeBILL N0.2008-107 ORDINANCE N0.2008-107 AN ORDINANCE APPROVING AN AGREEMENT WITH THE CITY OF HOUSTON LAKE, MISSOURI FOR FIRE, RESCUE AND MEDICAL FIRST RESPONSE SERVICES WHEREAS, in order to enhance and improve the City of Riverside, Missouri's (the "City") fire protection services, and to provide the benefit of the equipment, personnel and other resources of the City to neighboring communities, the City wishes to enter into an agreement with the City of Houston Lake, Missouri ("Houston Lake") to provide fire, rescue and medical first response services when such assistance is needed; WHEREAS Houston Lake and the City have agreed to compensation for these services so as to reduce the cost to both parties; and WHEREAS Houston Lake and the City have prepared an Agreement for Fire, Rescue and Medical First Response Service setting forth the terms of the agreement; NOW THEREFORE BE IT ORDAINED BY THE BOARD OF ALDERMEN OF T'HE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: Section 1. This Ordinance is intended and is hereby determined and declared to be necessary to accomplish and serve the public purpose of enhancing and improving the fire protection services of the City and neighboring communities. Section 2. The City shall enter into an agreement whereby the City agrees to provide :6re, rescue and medical first response services to Houston Lake, and Houston Lake agree:; to compensate the City for the services (the "Agreement"). Section 3. The execution and delivery of the Agreement, in substantially the fi~nn attached hereto as Exhibit A, is approved, and the Mayor is authorized to execute the Agreement and to take such other actions reasonably necessary to carry out the intent of this Ordinancc: on behalf of the City, the execution of the Agreement being conclusive evidence of such approval. Section 4. The Mayor, the City Administrator, the City Attorney and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary or convenient to perform all matters herein authorized. Rose ATTE T: Ci Clerk Agreement for Fire, Rescue and Medical First Response Service THIS AGREEMENT is made and entered into this ~'~I`ay ofo~~~, 2008 by and between THE CITY OF RIVERSIDE, MISSOURI, a municipal c oration hereinafter called CYRS and THE CITY OF HOUSTON LAKE, MISSOURI a municipal corporation hereinafter called CYHL. Whereas: The CYHL desires to upgrade the services available to its City's residents by providing high levels of fire prevention, education, suppression, medical first response, hazardous materials response and water rescue services; and, The CYRS desires to enhance the services provided to its City's residents by expanding its current fire prevention, education, suppression, medical first response, hazardous materia:s response and water rescue services capabilities, and by using additional revenues available under this agreement will offset additional costs of these expanded services that would otherwise be borne solely by its taxpayers; and, The CYRS is a duly authorized provider of such services in accordance with Missouri St<<te Statutes; and, A determination has been made by the Boards of both areas that the following Agreemenr, is a cost effective mechanism to provide such services. Now Therefore Be It Resolved That: 1. The CYRS shall furnish its equipment, personnel, and services at the request of persons who are residents of the CYHL from the CYRS stations located within the CYRS. 2. In consideration for the CYRS's furnishing such equipment, personnel, and services, the CYHL shall pay to the CYRS an annual fee of $19,000, which is the agreed upon amount by both CYHL and CYRS for annual service. 3. This Agreement shall continue on an annual basis with either party having the right to terminate this Agreement with 180 days written notice to the other party. 4. In consideration of the payment of such sum of money, CYRS agrees to pay all of its expenses of organization, operation and all costs of acquiring, supplying and maintaining the necessary personnel with which to control and prevent fire and provide medical first :response CYHL/ CYRS Agreement 1 August, 2008 and light rescue services within the CYHL. The CYHL shall pay no additional monies to the CYRS except for the sum outlined herein. This agreement will be in full force and effect from July 1, 2008 until midnight July 1, 2012, unless terminated according to the provision of paragraph 3. 6.
