I AN ORDINANCE AMENDING CITY CODE SECTIONS 110.090 AND 110.040, AND ADDING SECTION 110.095, RELATING TO THE DUTIES OF TREASURER AND PROVIDING FOR AN ASSISTANT TREASURER AND ITS DUTIES WHEREAS, Section 110.090 of the City Code currently provides for the duties of the City Treasurer; and WHEREAS, the City employs a Director of Finance, whose duties include the matters set forth in Section 110.090 of the City Code as well as the duties set forth in Section 79.300, RSMo; and WHEREAS, the City desires to provide for an Assistant Treasurer to assist the Treasurer and ensure good internal accounting controls; and WHEREAS, the Board of Aldermen finds it is in the best interest of the City to amend the City Code to provide for any individual appointed as the Director of Finance to serve and perform the duties of City Treasurer, and also to provide for an Assistant Treasurer. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: SECTION 1 — AMENDMENT OF SECTION 110.090 OF THE CITY CODE Title I, Chapter 110, Section 110.090 of the Riverside City Code is hereby amended to read as follows: Section 110.090: DUTIES OF THE TREASURER, APPOINTMENT The Treasurer shall keep such records and make such reports as may be required by State Statute, the ordinances or the Board of Aldermen. The Director of Finance shall serve as Treasurer. SECTION 2 — AMENDMENT OF SECTION 110.040 OF THE CITY CODE Title I, Chapter 110, Section 110.040 of the Riverside City Code is hereby amended to read as follows: Section 110.040: APPOINTIVE OFFICERS The City Administrator, Municipal Judge, City Prosecutor, City Clerk, Treasurer, Assistant Treasurer, Attorney, Assistant Attorneys, Engineer, Director of Public Safety and Secretary to the Board of Aldermen are hereby declared to be appointive officers of the City. SECTION 3 — ADDITION OF SECTION 110.095 TO THE CITY CODE. Title I, Chapter 110, Section 110.095 of the Riverside City Code is hereby added to read as follows: Section 110.095: DUTIES OF THE ASSISTANT TREASURER The Assistant Treasurer shall assist in the bank statement reconciliation, and perform and assist with other tasks as directed by the Treasurer. The Assistant Treasurer shall receive compensation in the amount of One Hundred Dollars ($100.00) per month. SECTION 4 — REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 5 — SEVERABILITY CLAUSE The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 6 — EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval. Campo, City Attorney RE: City Code Amendment - Treasurer and Assistant Treasurer/ April 16, 2013 Agenda The City Treasurer resigned on July 26, 2012, which resulted in an evaluation of the role and responsibility of the position. A conflict between the statutory responsibilities and duties actually performed by the individual appointed as Treasurer was identified. Specifically, the Director of Finance performs the statutory duties of the Treasurer set forth in Section 79.300, RSMo. The primary role of the individual who previously held the title of Treasurer was to review the bank statement reconciliation and sign checks. The proposed bill amends the City Code Section 110.090 to provide that the Director of Finance shall serve as Treasurer. It is consistent with the duties of the Director of Finance to have responsibility for payment of bills and maintenance of the various funds as required by state law. It also makes the Treasurer appointment automatic with any change of employment in the position of Director of Finance. Staff believes that it is important and helpful to have a third -party review the bank statement reconciliation and perform other as- needed tasks. Accordingly, the proposed bill creates the appointive position of Assistant Treasurer by amending City Code Section 110.040, which adds this position to the list of other appointive positions. The proposed bill then adds a new City Code Section 110.095 to provide for the duties of the Assistant Treasurer, which are to assist in the bank statement reconciliation, and perform and assist with other tasks as directed by the Treasurer. Accompanying the proposed bill amending the City Code is a resolution approving the Mayoral appointment of Jeff Pence to the newly created position of Assistant Treasurer.
