AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE, MISSOURI TO ENTER
INTO AN AGREEMENT WITH MISSOURI-AMERICAN WATER COMPANY FO:[Z
THE INSPECTION AND ACCEPTANCE OF WATER MAINS AND RELATED
FACILITIES IN CONNECTION WITH THE GOWER WATER MAIN EXTENSION
PROJECT
WHEREAS, the City of Riverside, Missouri ("City") plans to install a new water main
along Gower Drive and after completion, this water main will be owned by Missouri-American
Water Company; and
WHEREAS, the City will permit Missouri-American Water Company to locate the water
main, hydrants and appurtenant facilities in the right-of--way of Gower Drive, and agrees not to
charge any permit fees for such water main, hydrants and appurtenant facilities being located
therein; and
WHEREAS, the City will reimburse Missouri-American Water Company any anti all
reasonable and necessary costs associated with the future relocation of the water main, hydrant
and appurtenant facilities installed in the Gower Drive right-of--way under this Ordinance for the
installation of X00 feet of water main; and
WHEREAS, funds are available for this project in the FY 2008 Capital Improvement
Program.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF RNERSIDE, MISSOURI, AS FOLLOWS:
Section 1. The Mayor of the City of Riverside, on behalf of the City, is authorizc;d to
enter into an agreement with Missouri-American Water Company, consistent with the ternis of
this Ordinance, for inspection and subsequent acceptance by the Company of the water main and
related facilities to be installed by the City as part of the Gower Drive water main project.
Section 2. The City permits Missouri-American Water Company to locate its water
mains, hydrants and appurtenant facilities in the right-of--way of Gower Drive, and agrees not to
charge any permit fees for such water mains, hydrants and appurtenant facilities being located
therein.
Section 3. The City will reimburse Missouri-American Water Company any and all
reasonable and necessary costs associated with the future relocation of the water main, hydrants
and appurtenant facilities installed in the Gower Drive right-of--way pursuant to this Ordinance
for the installation of X00 feet of water main.
Section 4. In the event the right-of--way of Gower Drive is ever vacated or abandoned by
the City, the City will be solely obligated to incur any and all costs, including condemnation
costs, associated with obtaining replacement easements, before the right-of--way can be vacated
or abandoned.
Section 5. This Ordinance shall be in full force and effect from and after its passage .and
approval.
