HomeMy WebLinkAbout2006-08-01Minutes of Regular Meeting of Board of Aldermen of City of Riverside, Missouri August 1, 2006 A regulaz meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, on August 1„ 2006 at 6:30 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Jones, Dazata, Hurt, Beazd and Super. Alderman Bruns, absent at this time (arrived later). Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, Chief Greg Mills, Brent Miles, Director of Planning & Economic Development, and John McClelland, City Attorney. Motion for Closed Alderman Jones moved that the meeting go into closed session, pursuant to Session at 6:35 p.m. RSMo 610.021(1) Legal and RSMo 610.021(2) Real Estate Issues with the City Attorney, seconded by Alderman Hurt, and the vote was: Aldermen Beard, Darata, Jones, Super, Bruns and Hurt. Motion carries. Alderman Bruns arrived at 6:45 p.m. Motion for Open Alderman Bruns moved that the meeting go into open session, seconded by Session at 7:30 p.m. Alderman Dazata, the vote was: Aye: Aldennen Dazata, Jones, Beard, Bruns, Hurt and Super. Motion carries. Visitors Comments Alfred Jones, 5014 NW Merrimac complained to the boazd about a letter he received from the City stating the installation of a storm sewer system had been put in place and the property owner would be responsible for maintenance and ownership from now on. Mr. Jones said this was not in any contracts when he bought the house in November 2005. Brent proceeded to explain and John McClelland said it would be inappropriate to comment because of pending litigation. Mr. Jones said he received a letter from the survey company stating it shows a 10' easement on his property. Mr. Jones says the storm sewer drain nms about 15' on his neighbor's yazd. Mayor Rose said she could not respond because she knows nothing about the issue. Mayor Rose said an investigation will be done and someone from the City would contact Mr. Jones with a letter of opinion regazding his concerns. Dennis Leader, 4915 NW Merrimac is not satisfied with the drainage decisions made by the City. A counter proposal was presented by Mr. Leader to the work that is supposed to be done at 4915 NW Merrimac. Mr. Leader would like the area north of 4915 NW Merrimac filled so that it would route the runoff onto the Merrimac roadway. Mayor Rose said everything would be reviewed from the Engineers and someone would get back with Mr. Leader. 8/1/06 Janet Harris, 4021 NW South complained to the boazd about parking problems during parties and the police have been at the house, evidently from neighbor's complaints. Mrs. Hams would like something done about the pazking problem in yards during parties, holidays or events. Mayor Rose said this would be investigated, some information gotten together and worked out with Chief Mills and then presented to the boazd. Mrs. Harris will be contacted when a solution has been reached. Website Develop- Sara Breshears with Creative Minds made a presentation to the boazd regazding ment Discussion the home page of the City's website. Ms. Breshears showed 3 different ideas for the cover page and gave an overview of creating the website. The first choice was the Charmer, 2"d-the Movie and 3`~- Sunny side. She asked the board to review for their likes and dislikes and a-mail Jane their comments. Soon a work session will be done with the Board regarding the website. Liquor License Alderman Dazata moved to approve a Liquor License for the Riverside Area for the Riverside Area Chamber of Commerce on September 15th & 16`~ at the E. H. Young Riverfront Chamber of Commerce Park, seconded by Alderman Jones, the vote was: Approved Aye: Aldermen Jones, Bruns, Darata, Beard, Hurt and Super. Motion carries. Minutes, July 11, 2006 Alderman Darata moved that the minutes of July 11, 2006 be corrected and Approved approved, seconded by Alderman Super, the vote was: Aye: Aldermen Bruns, Darata, Super, Hurt, Beard and Jones. Motion carries. Public Hearing Opened Mayor Rose opened the Public Hearing to consider amending Riverside at 8:10 p.m. to consider amending Riverside Municipal Code Section 410.100 "Accessory Uses" and add Section 410.115 "Fences". Brent gave a brief summary of the staff report stating the regulations in place now and the proposed code amendment. The proposed amendment consists of the following: Fences in Residential Districts: Front Yard: Fences in any front yazd shall be constructed of wood, decorative iron, plastic, or masonry and the height of such fence shall not exceed 36" above the ground. Any fence permitted shall not interfere with the visibility of drivers and shall be a determining factor in approving such fence in any front yard. Side and Rear Yards for Residential Districts: Fences in any side or rear yard shall be constructed of chain link, wood, decorative iron, plastic, or masonry and the height of such fence shall not exceed 6' above the ground. Fences in Commercial and Industrial Districts: The same as for Residential accept no wood and the Side and Rear Yards shall not exceed 8' above the ground. Performance Standards: Fences shall be constmcted and maintained so that they do not constitute a blighting influence nor an element leading to the progressive deterioration and downgrade of neighborhood property value. Minn. 8/1/06 Outside storage shall be permitted only after a Special Use Permit has been granted for such storage. Fencing used in connection for outdoor storage shall be a component of such Special Use Permit and shall be a determining factor in the approval of such. Staff recommended "Bazbed wire and electrical fences shall only be approved by Special Use Permit." Certain regulations apply to these types offences. These types offences shall be charged a fee for advertising and notification costs only per Riverside Development Fee Schedule. Visitors Comment Irene Paulhe, 4700 Petronella Lane asked if barbed wire required a Special Use Permit. Brent said, "Yes" in certain azeas. Brent said they discussed chain link fences stating they need to be powder coated. Evelyn Poe, 3002 NW Florence asked if this applied to the Residential azea only; Brent said all azeas. Anyone who would put up a new chain link fence, Planning and Zoning is recommending the fence to be powder coated. Alderman Bruns said he believes the coating should apply for the commercial area, not residential. Alderman Hurt asked if we could legally require someone to have powder coating. John McClelland said there is no legal restriction that prevents the City to put powder coated in the code, but a determination of the cost imposed on people by requiring that type of fence opposed to a galvanized fence is reasonable and for the public benefit for that type of fence. Alderman Super said the City should allow regular chain link fencing and no powder coating fencing should be required anywhere. Phyllis Reece, 4551 NW High Drive said it's a good suggestion, but the City shouldn't demand the residents to have powder coated fences. Alderman Beard believes no powder coating should be required anywhere. Brent said the Ordinance will be written eliminating powder coated fencing. Public Heazing Closed Mayor Rose closed the Public Hearing at 8:14 p.m. Public Hearing Mayor Rose opened the Public Hearing continued from the July 18'" meeting, Opened at 8:15 p.m. to consider a rezoning application from "R-1: Single Family Residential: to PD: Planned Development" and to consider the preliminary Plat of the Planned Development proposed on property generally located north of NW 50`s Street west of NW Gateway drive and east of I-635. Public Hearing Alderman Jones moved to continue the Public Hearing until the August 15s' Continued meeting, seconded by Alderman Darata, the vote was: Aye: Aldermen Beard, Super, Bnuu, Jones, Dazata and Hurt. Motion carries. Motion carries. Building Permit Alderman Bruns moved to approve a Building Permit for Alderman Hurt, 5016 for 5016 NW NW Strathbury to construct a wood deck and enclose as a screened porch, Strathbury seconded by Alderman Dazata, the vote was: Aldermen Beard, Bruns, Jones, Super and Darata. Abstain: Alderman Hurt. Motion carries. Motion to Approve Alderman Jones moved to approve TranSystems proposal to design and TranSystems Option 1 construct Phase 1, Horizons Parkway connection from the Interchange to for Horizons Parkway Vandepopulier with Option 1, build it as the preliminary plans have it; Approved (this is a 4 lane parkway with a 28' median and the cost is $7 million.) Aye: Aldermen Jones, Super, Darata, Hurt and Bruns. No: Aldem~an Beard. Motion carries. City Administrator David said new Public Safety Vehicles have been ordered. Three comments 2007 Crown Victoria Interceptor cars were ordered and bids were solicited with 3 Ford dealers: Joe Machen's Ford $21,648 Shawnee Mission Ford 21,524 Thoroughbred Ford 21,197 Mid Amer. Reg. Council No contract available <t. The lowest and best bid is from Thoroughbred Ford. Chief Mills recommends this dealership to purchase the cazs from. The emergency lights are a sole source bid through OMB for $16,118.76. Chief Mills said they are under budget with these purchases and delivery is expected in September. The Public Works vehicles have not been purchased. The contractor was willing to hold the bids open for another week to purchase 2007 vehicles at 2006 prices. It will take 10-12 weeks for delivery and this does not include the bodies. Bids aze being taken for the bodies at this time. The boazd approved ordering the Escape and it is in the budget. The City van will not be bid out through the state or MARC September or October. Mins. 8/1/06 VSM Change Order Change Order # 2 for VSM Eng. for $2,750 for the Merrimac-Petronella Approved project was approved. Contracts Comment David said a report would be given on the contracts that have been signed since Mayor Rose has been in office. Mayor Rose said a report on a monthly basis would be sufficient. Park Board Discussion Brent said he and David met with Homer Williams with WSKFregazding the Community Center and the assessment of information will be presented to the boazd. The first review comments were received from the Levee District on the Line Creek Trail and they are being reviewed. There will be a meeting with the Levee Boazd on August 10`s for a presentation. The Argosy E.H. Young sewer connection was discussed and is on the agenda tonight. The Homestead Fence was discussed and the survey. The Mo. Riverfront Trail was discussed with one issue to be resolved. The requirements for the top of the levee will be discussed and shared with the board at another time. College Incentive Alderman Darata moved to approve the College Incentive and Tuition Reim- & Tuition Reimbuse- bursement Program for a full time member of the Department of Public Safety ment Program, Approved seconded by Alderman Bruns, the vote was: Aye: Aldermen Darata, Super, Hurt, Beard, Bruns and Jones. Motion carries. Comments Mayor Rose said she received an e-mail and 2 phone calls regarding striping on Northwood Road and High Drive and they were greatly in favor of the striping. City Administrator David said he received a phone call and they were appalled with the striping. Alderman Super Alderman Super received a couple of phone calls stating they regarding were not in favor of the striping. Bill No. 2006-100 Alderman Beard moved to place Bill No. 2006-100 on its first reading, Amend. Title VI, said Bill amending Title VI, Chapter 600.470 Temporary License for Not- Chapter 600.470 Temp. for-Profit Sale of the Municipal Code of the City of Riverside, Missouri, License for Not-for seconded by Alderman Bruns, the vote was: Profit Sale..... Aye: Aldermen Jones, Super, Darata, Beazd, Brrns and Hurt. Motion carries. Ordinance No. 2006-100 Alderman Jones moved to place Bill No. 2006-100 on its second reading, Approved and upon passage of same become Ordinance No. 2006-100, seconded by Alderman Beard, the vote was: Aye: Aldermen Hurt, Beard, Bruns, Dazata, Super and Jones. Motion carries. Minn. 8/1/06 Bill No. 2006-101 Alderman Beard moved to place Bill No. 2006-101 on its first reading, Payment of said Bill authorizing the payment of certain indebtedness listed therein, Indebtedness seconded by Alderman Darata the vote was: Aye: Aldermen Darata, Beard, Bruns, Jones, Hurt and Super. Motion carries. Ordinance No. 2006-101 Alderman Jones moved to place Bill No. 2006-101 on its second reading, Approved and upon passage of same become Ordinance No. 2006-100, seconded by Alderman Super, the vote was: Aye: Aldermen Bruns, Hurt, Super, Jones, Darata and Beard. Motion carries. Bill No. 2006-102 Alderman Beard moved to place Bill No. 2006-102 on its first reading, said Amend. sect. 110.150 Bill amending Section 110.150 and Section 110.140 of the Municipal Code Sect, 110.140 amend. of the City of Riverside, Missouri, by amending provisions regarding the regular mtg. times of the board provisions re: regular mtg. meeting times of the Board of Aldermen and the & Plan. Comm. & including Planning Comrnission and providing for the inclusion of Ordinance 95-81 in the Ord 95-81, Sect 110.040 Riverside Municipal Code Section 110.040 regarding the compensation for the re: Mayor's compensa- Mayor and Board of Aldermen for attendance at Board of Aldermen Meetings, lion & BOA at mtgs. seconded by Alderman Hurt, the vote was: Aye: Aldermen Darata, Super, Jones, Hurt, Beard and Bruns. Motion carves. Ordinance No. 2006-102 Alderman Bruns moved to place Bill No. 2006-102 on its second reading, Approved and upon passage of same become Ordinance No. 2006-102, seconded by Alderman Darata, the vote was: Aye: Aldermen Hurt, Beard, Bruns, Darata, Super and Jones. Motion carries. Bill No. 2006-103 Alderman Beard moved to place Bill No. 2006-103 on its first reading, said Approv. the granting Bill Approving the Granting of a Sanitary Sewer Easement to the Argosy of a sanitary sewer Casino; and Authorizing the Execution and Delivery of Documents and Esmt. to Argosy Casino Actions Relating Thereto, seconded by Alderman Super, the vote was: Aye: Aldermen Jones, Super, Darata, Beard, Bruns and Hurt. Motion carries. Ordinance No. 2006-103 Alderman Bmns moved to place Bill No. 2006-103 on its second reading, Approved and upon passage of same become Ordinance No. 2006-103, seconded by Alderman Darata, the vote was: Aye: Aldermen Hurt, Beard, Bruns, Darata, Super and Jones. Recess Reconvened David's comment Mayor's comment Motion for Closed Session at 9:03 p.m. Motion for Open Session at 10:15 p.m. A brief recess was called at 9:10 p.m All Aldermen and the Mayor responded to roll call and the meeting reconvened at 9:20 p.m. Alderman Jones asked about the revisions to the Employee Manual. David said he has the red-line version. David said RFP's have been sent out for a salary survey. Mayor Rose asked about the driveways on High Drive Terrace. David said John Jackson would have a report for the next meeting. Alderman Beazd said thanks for taking care of the driveway in front of the Peeler building. Alderman Super said if anyone would like to meet Thursday afternoon at 4 or 5 p.m. regarding signage for the City. Alderman Darata moved that the meeting go into closed session, pursuant to RSMo 610.021(1) Legal Issues with the City Attorney, seconded by Alderman Bruns, and the vote was: Aldermen Beard, Darata, Jones, Super, Hurt and Bnms.
