" ,.. ~+-- MINUTES OF REGULAR MEETING OF BOARD OF ALDERMEN OF CITY OF RIVERSIDE, MISSOURI SEPTEMBER 2, 1986 A regular meeting of the Board of Aldermen of the City of Riverside, Missouri was held in the City Hall in Riverside, Mis- souri on September 2, 1986, at 7:30 p.m. The roll was called and Karr, Gordy, Best, Peeler, Wedua and Brenner were present. In the absence of Mayor Holmes, Mayor Pro Tem Peeler called said meeting to order. It was decided to dispense with the reading of the Minute of August 19, 1986, for the present time. D. Rabon, 11 East 1st Street, Parkville, Missouri, 64 52, presented a Business License Application for Image Coordina ors, Inc. at 406 N.W. Business Park Lane. Said application w ap- proved, subject to the payment of the fee. C. B. Lundy, presented an application for sign for Image Coordinators, Inc. at 406 N.W. Business Park Lane. Said applica- tion was approved subject to the payment of the fee. Mr. Edmond May, 850 Valley Lane, 741-3331, spoke to the City regarding weeds and the street guttering being settled and in need of repair and the weeds need cutting, on Valley Lane. Mr. May was advised that the City would look the area over and report back to the Council at the next meeting. Ted Updike of Ted;"Updike & Son, 1319 N. 69th Street, Kansas City, Kansas presented an application for an entry. o.ff~'if Vivion Street in the area of the_Union Hall where he is enlarging the parking lot.., .After a discussion on the matter and:an-the recom- mendation of Chief Fred McDaniel that the entry~off~of Vivion Street also the the exit to Che parking lot and ,~txat., the present entry a.nd/or exit on -Cliff View Drive be permanently closed,.. Mayor Pro Tem and majority,. of the Board agreed'zo_~ermit the entry and exit be on Vivion Street. This Was agreed; to with the understanding that. the- Union People will -permanently close the exit/entry on Cliff View Drive. Gateway reported .tQ the Board that he had to have parts ordered for the`Circuit Breaker Box and the. parts just came in on August 29, 1986, and now all. the problems which the City requested him to correct have:-been !•corrected, and approval of his business.: license will beiin.order, subject to'the payment. of ,the fee. ~.,.,.; ~..~ r r .. 7~». 0 ~, Minutes of Reg. Meeting Page 2, Sept. 2, 1986 It was announced that there would be a reception for Mayor Frank Barns of Houston Lake at 7:30 p.m., September 6, 1986, because of his retiring as Mayor, and every one was invited to attend. A letter dated August 19, 1986, from attorneys Spen- cer, Fane, Britt and Browne was read, this concerned water rates. Bill Hannah, P. 0. Box 12188, Parkville, M0. was present _ and inquiring what needs to be done for him to get a permit to go ahead and continue his building. He said that the Engineer of the City had told him the angle iron had to be placed a certain way in the footing. This matter was discussed and it appeared that he would have to have a letter from a engineer stating that the compac- tion of the fill was correct and that the City Engineer would have to approve the footing- and building if this has not been done. A hearing concerning Macy Elder's house on N.W.Gate- way. This hearing had been continued from a prior date. ~.- Attorney Don Witt said this hearing is being held to see if Mrs. Elder's house is in violation of the house code in the City of Riverside, and offering certain documents are being offered to show that this is true. The City needs to vote as to whether or not the building is in vio- lation of the City Buidling Code, and Mrs. Elder has 30 days in which to correct the situation or demolish the house. Attorney Witt presented a certified copy of a Mis- souri Warranty Deed showing that Mrs. Macy Elder is the owner of the house and property involved; a copy of the notice served upon:. Mrs. Elder that the building is in violation of the Building and Zoning Code of the City and a cert#~g~ed copy of the Deputy (under oath) that he served Mrs. Elder this notice. Attorney Witt asked Officer Palmer to come forward to answer certain questions as he investi- gated the matter. He brought out that the front porch was falling down that the exterior need repair and painting; that there were :seve_ral windows broken towards the back of the house; that the outer buildings were badly in need of repair and painting; that the roof of the house leaked; and he had pictures of the house which were taken October 1, 1985 which were presented as evidence. On the premises was also an automobile which had not been used for quite a while. Mrs. Macy Elder, 3116 N.W. 56th Street, said most of ~ the items mentioned were correct; that the roof did not leak; that the house was badly in need of repair on the outside; that the windows broken were not in the kitchen; Minutes of Reg. Meeting ~..~ Page 3 , Sept . 2 , 1986 Mrs. Eldet-~sid she intends to do whatever it takes to put the house in condition to come up to the City Code; and agrees that there are several items which are badly in need of repair. Karr moved that it be resolved that after hearing in compliance with the housing code of the City of Riverside, Missouri, it is determined that a structure at or about 4801 N.W. Gateway, Riverside, Missouri, is in violation of the housing code of the City and the Mayor is directed to serve ~, compliance order requiring the structure to be repaired, :rehabilitated, vacated or demolished within thirty (30) days after the service of the Order, seconded by Gordy, the roll was called and votes were as follows: Karr, Gordy, Best, Wedua and Brenner voted aye; Peeler being Mayor Pro Tem. City Attorney Don Witt said the next thing is to determine what repairs need to be done to bring the house up to City Code. A Compliance Order was given to Mrs. Macy Elder, giving her 30 days from this date (September 2, 1986) to repair, rehabil- itate, vacate of demolish the house at or about 4801 N.W. Gateway by Mayor Pro Tem Peeler. `-' Mrs. Elder promised to return to the Council meeting in two weeks with the plans of what she intends to do the the building. Wedua reported that Mr. Pulley would haul the gravel for Van DePopulier road at no cost and Mr. Pulley could possibly get the gravel at no cost. Brenner reported that the lumber to replace the old boards on the bleachers at the ball diamond was the cheapest at Sutherland and it will be purchased there. City Clerk Betty Burch said that she had an inquiry as to why the City is not screening its salt and sand pile. Further consideration will be given this matter. It was brought up that the Water Company hearing will be Th ursday, September 4, 1986. Fred McDaniel reported that some of the Public Safety Officers participated with the County with the DWI check point and found it to be quite informative. Chief Mc Daniel also said that the City could purchase certain items at the State bid prices. `..~ E. H. Young had asked for a fill and grading permit for his property south of the railroad tracks and east of the race track. This was approved subject to it being for a term .. Minutes of Reg. Meeting Page 4, Sept. 2, 1986. of six months at a time; that it be graded weekly and the drainage and compacting be checked at intervals.
