REGULAR MEETING
PLANNING AND ZONING COMMISSION
RIVERSIDE, MISSOURI
Thursday, August 27, 2009
7:00 p.m.
The Planning and Zoning Commission for the City of Riverside, Missouri, met in regular session in the
Board of Aldermen Chambers at City Hall, 2950 NW Vivion Road, Riverside, Missouri.
Chair Barbara Snyder called the meeting to order at 7:00 p.m. Answering roll call were Al Bowman,
Stephen King, Evelyn Poe, Harold Snoderley, Ray Uhl, Steve Kaspar, Cheryl Melton, Art Homer,
Barbara Snyder, Alderman Brad Cope and Mayor Kathy Rose. Members absent: Aaron Locke . Also
present: Mike Duffy Director of Community Development and Sarah Wagner, Community Development
Approval of June 11, 2009 Commissioner Al Bowman made a motion to approve the minutes of
June 11, 2009
Commissioner Harold Snoderley seconded and the motion was
approved unanimously.
Commissioner Stephen King abstained from voting.
Approval of Minutes from Commissioner Art Homer had a correction on the minutes of August 13,
August 13, 2009 2009.
Commissioner King made a motion to approve the minutes of August
13, 2009 as corrected.
Commissioner Ray Uhl seconded and the motion was approved
unanimously.
Commissioner Barbara Snyder and Al Bowman abstained from voting.
Public Hearing: Mike Duffy, Director of Community Development gave a staff report.
To consider Rezoning He explained that it was recently discovered that the site in question has
property at 2908 NW two different zoning classifications, R -3 and C -1. Considering the
Vivion Road from "R -3" majority of the site is utilized for business purposes, it does not comply
Multi - Family Residential with the R -3 zoning district. How this situation came to be is unclear,
to "C -1" Commercial especially considering business activities have been conducted on the
site for many years. The 10,633 square foot building located on the site
was constructed in 1960 and has housed numerous businesses
throughout the years. The property owner is requesting to rezone the
site entirely to C -1 to rectify the situation and ensure the longevity of
the property. The rezoning will have minimal impact on the surrounding
properties. With the exception of the multi - family development to the
northwest of the site, the surrounding properties also support
business/office type uses and are zoned C -1 Commercial or CPO Civic
and Professional Office. Additionally, as the site has been operating as
a commercially zoned property for many years, the change in zoning
will not impact the current use of the site. There is a 0.33 acre
undeveloped site to the north of the developed area that may one day be
used for expansion of the existing business, pending the rezoning is
approved and a site plan is submitted and approved. To date, the
applicant has not submitted any plans. The Comprehensive Master Plan
identifies the areas near the intersection of Vivion Road and Gateway
Avenue as commercial. Besides beginning located close to this major
intersection, the site is also located off two high traffic streets, Vivion
Road and High Drive. The larger traffic volumes suit a commercial
type use. Further, the multi - family and civic uses adjacent to the site act
as a transition buffer from commercial to single - family residential uses.
Considering these factors, the rezoning is in compliance with the
Comprehensive Master Plan and established planning principles. Staff
finds the application in conformance with the Comprehensive Master
Plan, UDO and adopted policies and procedures, and therefore,
recommends approval of the rezoning to C -1.
Commissioner Uhl asked what the property to the East was.
Duffy said that the Day Care owns all of the property, but the City is
looking to get an easement in order to control the flood plain and
construct a trail.
Commissioner Poe asked what would happen to the property if the
current business ever left.
Duffy explained that the "C -1" zoning district does allow a vast number
of uses, but with the Change of Use process will help regulate the type
of businesses
Commissioner Bowman asked about the CPO zoning.
Duffy said that the CPO would work, but doesn't think that it is the best
fit.
Chair Snyder opened the Public Hearing at 7:13 PM.
Hearing no comments from the public the Public Hearing was closed at
7:14 PM.
Commissioner Poe moved to recommend approval to the Board of
Aldermen of the rezoning of 2908 NW Vivion from "R -3" Residential
to "C -1" Commercial.
Commissioner Bowman seconded and the vote was unanimous in favor
of the motion.
General Discussion Duffy asked the Commissioner's thoughts on a vacant property being
used as a temporary location for a church.
In general the Commission was agreeable to it.
Adjournment
Commissioner Bowman made a motion to adjourn.
Commissioner Snoderley seconde The motion passed and the
meeting was adjourned.
