HomeMy WebLinkAbout2003-10-09 Planning & Zoning Commission Minutes MINUTES PLANNING AND ZONINING COMMISSION RIVERSIDE, MISSOURI October 9, 2003 The Planning and Zoning Commission for the City of Riverside, Missouri, met in regular session in the Board of Aldermen Room at City Hall, 2950 Northwest Vivion Road, Riverside, Missouri. Chairman Snyder called the meeting to order at 7:44 p.m. The following members answered roll call Vice - Chairman Cy Houston, Shawn Lee, Evelyn Poe, Fire Commander Mike Shelton, Chairman Barbara Snyder and Ray Uhl. Absent were: Mayor Betty Burch, Jim Burch, Karen Gordy, Aaron Locke and Jim Smith. Also present was Community Development Coordinator Brent Miles. Approval of Minutes — Mr. Lee moved that the minutes of September 11, 2003 meeting be September 11, 2003 approved as printed. Mr. Uhl seconded. The motion carried. Fire Commander Shelton and Vice - Chairman Houston abstained due to absence. Public Hearing — Special Chairman Snyder opened the public hearing for consideration of a special Permit in Flood Hazard Area permit in flood hazard area for McCray Lumber for the property at 4439 for McCray Lumber, 4400 Northwest Mattox. NW Mattox Bob Edinger, 3600 North Wabash, Kansas City, Missouri, 64116, was present to represent McCray Lumber. Community Development Coordinator Miles gave the staff report. The building was destroyed in the May tornado. The staff recommends the fees be waived as they have been for others affected by the tornado. In order to meet the requirements of the City Municipal Code Chapter 455, the applicant plans to flood proof the building by: • Automatically equalizing hydrostatic flood forces by allowing for entry and exit of floodwaters. • Providing a minimum of two openings having a total net area of not less than one square inch for every square foot of enclosed area. • Ensuring all openings shall be no higher than one foot above grade. • Noting that openings may be equipped with screens, lovers, valves, or other coverings or devices provided they permit automatic entry. • Ensuring all utilities and mechanical are one foot above base flood elevation. All plans must be certified by an engineer. Applicant has met all other requirements of the Code. Planning and Zoning Commission Minutes October 9, 2003 Page 2 Commission Discussion The Commission discussed the need to continue require applicants meet the requirements of Special Permit in Flood Hazard Area until the levee is done and FEMA maps have been updated, which can take an additional one to three years. There were no comments from the public. Public Hearing — Closed The Public Hearing was closed. Motion to Recommend Mr. Lee moved that the amendment be recommended for approval to the Approval Board of Aldermen with the recommendation to waive fees. Ms. Poe seconded. The motion carried unanimously. Building Permit for McCray Mr. Miles submitted the staff report on the building permit for McCray Lumber, 4400 NW Mattox lumber. Staff recommends that the building permit be granted with the condition that roof plans be submitted. Motion to Recommend Commander Shelton moved that the building permit be recommended for Approval approval to the Board of Aldermen with the condition that a building plan be submitted and approved. Mr. Lee seconded. The motion carried unanimously. Building Permit for El The Commission considered the request of Bob Sigler, 413 Division, Chapparal Apartments, 4937 Kansas City, Kansas, on behalf of El Chapparal Apartments for a building NW Gateway permit. The complex had damage to twelve units after a recent fire. The request is to restore the units. Mr. Mile gave the staff report and recommended approval contingent upon: Motion to Recommend • Doubling all roof joists damaged by fire or fire fighting procedures. Approval • Replacing single joist hangers with double joist hangers as needed when doubling joists. • Installing hurricane clips on both ends of all roof joists exposed by the fire damage repairs. • Meeting or passing all applicable City and International Codes per inspection. Commission Discussion Mr. Houston asked if requiring hurricane clips were part of the Code. It is not. The City has been requiring it since the May tornado. Mr. Lee asked if the ceilings and floors had been certified structurally sound? City Engineer Jackson did a walk- through and pointed out where joists were needed. There is a lightweight concrete topping over the floor /ceiling. Planning and Zoning Commission Minutes October 9, 2003 Page 3 Motion to Recommend Ms. Lee moved that the building permit be recommended for approval to the Board of Aldermen with the conditions set forth by Staff. Mr. Uhl seconded. The motion carried unanimously. Commander Shelton abstained due to his involvement in the fire. Building Permit for Deck, Bob Wilson, 5548 Northwest Platte Drive, appeared before the Master Suite and Kitchen, Commission to request a building permit for a deck, master suite and 5548 NW Platte Drive, Bob kitchen. He plans to be done by year-end. Wilson Mr. Wilson plans to widen the bathroom door in the master suite from two feet to three feet. He will also move the vanity. He plans to install a 674 square feet deck from a manmade composite. He plans to install a gas cook top, exhaust fan, and breakfast bar in the kitchen. The library window will be moved to open to the deck. The porch light will be replaced with can light. Mr. Miles gave the staff report. Staff recommends approval contingent upon the stairs being compliant with IRC 2000 Code Section R314. The stairs will be a minimum of 36 inches wide, with a 7-% inch max rise and a 10 -inch minimum tread. Commission Discussion Mr. Houston noted that only the deck and electrical work need to be covered by the building permit. Motion to Recommend Mr. Lee moved that the building permit be recommended for approval with Approval the contingency that the stairs are compliant with IRC 2000 Code, Section R314. Mr. Houston seconded. The motion carried unanimously. Sign Permit — Tumble Cheer, Julie Davis, 6104 NW Karon Road, Kansas City, Missouri, was present to 5050 NW Gateway request a sign permit for Tumble Cheer, 5050 NW Gateway. The request is for two signs as presented in the site plan on April 10, 2003. One of the signs will be on the south and one on east. The signs meet the requirement of the Code. Commission Discussion The signs are not lit. There will be broadcast lights on the sign. Ms. Davis did not know exactly where the lights would be until the gables are up. The East sign is over a fake entrance, which was made to make the building more aesthetically pleasing. The fake entrance is actually windows. Planning and Zoning Commission Minutes October 9, 2003 Page 4 Motion to Recommend Mr. Houston moved that the sign permit be recommended for approval to Approval the Board of Aldermen. Mr. Lee seconded. The motion carried unanimously. Sign Permit, Available Chairman Snyder stated that the request for a sign permit by Available Construction, 4439 NW Construction was continued at the September 11, 2003 meeting. Gateway Motion to Table until October Mr. Lee moved that the request be tabled until the October 23, 2003, 23, 2003 meeting. Mr. Uhl seconded. The motion to table carried unanimously. Sign Permit, Available Gary Johnson, 4434 NW Gateway, appeared before the Commission to Construction, Gary Johnson, request a sign permit. Mr. Johnson is planning for three signs, which will 4434 NW Gateway all total less than 10% of the facade of the building. The first sign would read "Available Carpet and Tile," the second sign, "Available Construction," and the last sign "Available." Mr. Lee wondered if "Available" was too vague. The signs meet all City Codes. Motion to Recommend Ms. Gordy moved that the sign permit be recommended for approval to the Approval Board of Aldermen. Mr. Lee seconded. The motion carried unanimously. General Discussion MARC Planning & Zoning Community Development Coordinator Miles, Chairman Snyder and Mr. Commissioners Workshop Lee recently attended the Mid America Regional Council Workshop. They found the workshop to be informative. They would like to meet early for the next meeting to share some of the information. They would specifically like to discuss the ex -parte topic. They were reminded that that particular issues could not be discussed. The Commission plans to meet at 6:30 p.m. with possibly a light meal. Mr. Miles will notify members by e-mail in advance. Other Discussion The Code is still being re- worked. Along with CPO and a master plan once the levee is complete. The City has bought the old Leibrands site. Chairman Snyder reminded the Commission that the Code does allow for subjective opinions when it is for the good of the city. The new Codes Enforcement Officer, Jim Hare has been working diligently on some enforcement issues.
