HomeMy WebLinkAbout2003-09-11 Planning & Zoning Commission Minutes MINUTES PLANNING & ZONING COMMISSION RIVERSIDE, MISSOURI SEPTEMBER 11, 2003 The Planning and Zoning Commission for the City of Riverside, Missouri, met at a regular meeting in the Board of Aldermen room at City hall, 2950 NW Vivion Road, Riverside, Missouri. Chairman Barbara Snyder called the meeting to order at 7:30 p.m. The following members answered roll call: Shawn Lee, Aaron Locke, Ray Uhl, Jim Burch, Evelyn Poe, Mayor Betty Burch and Chairman Barbara Snyder. Cy Houston, Karen Gordy, Jim Smith, and Mike Shelton were absent. Also present was Community Development Coordinator, Brent Miles. Approval of Minutes Shawn Lee made a motion to approve the minutes of August 14, 2003 and August 14, 2003 August 28, 2003 as presented; seconded by Evelyn Poe; all voted aye; motion August 28, 2003 carries. Jim Burch abstained. Request for Building Ken T. Whittlesey, 5008 NW High Drive Terr. presented application to put Permit a driveway on the side of the building located at 5008/5010 NW High Drive Ken Whittlesey Terr. and construct a carport in the back for two vehicles. He is selling 5008 NW High Drive Terr. the property at 5006 NW High Drive Terr. and will be permanently residing at 5008 NW High Drive Terr. Brent Miles presented staff report stating Mr. Whittlesey has made application for the installation of a driveway, a concrete pad and a carport. Upon review of the site it was determined that a retaining wall 30" to 36" high to run the length of the house would need to be installed. Betty Burch inquired if the carport would be built beside the building. Mr. Whittlesey stated it would be built directly behind the building. Betty Burch inquired if that was the side that the emergency exit was located for the occupants upstairs. Mr. Whittlesey stated it was. Brent Miles stated this a general design from a manufacturer on the carport with a freestanding metal canopy. Mr. Whittlesey stated it would be bolted down in concrete and he is also asking for an enclosure on the north part to store lawnmowers and tools. Shawn Lee inquired whether it was single family or multi - family. Mr. Whittlesey stated it was originally a small grocery store and in 1968 was a restaurant with a small apartment. Floyd Moore put apartments above it. Mr. Whittlesey stated he lived in there for 12 years before he built the home at 5016 NW High Drive Terr. Ray Uhl inquired about the material used for enclosing the carport. Mr. Whittlesey stated it would be metal or framework with no window and would be bolted to the ground. Jim Burch asked Mr. Whittlesey to indicate which carport he was requesting. Mr. Whittlesey stated it was like the 21' x 18', but he wanted a 20' x 26'. Jim Burch inquired if it would have sidewalls and Mr. Whittlesey stated it would on one side of the storage. Ray Uhl inquired if Mr. Whittlesey had checked with his neighbors and Mr. Whittlesey stated it would not be easily seen. Shawn Lee inquired about encroaching on the property line and if he would be doing a re -plat of the area. Mr. Whittlesey stated it was on the edge of the line and the potential buyer at 5006 had no problems with it. It had been surveyed by Aylett Survey at an earlier time. Ray Uhl inquired which neighbors would see this. Mr. Whittlesey stated Mark Johnson may see it, however there were many trees in between them. Barbara Snyder stated that open storage is an issue and Mr. Whittlesey stated he wanted to close in a section with a 5' door for his lawnmower. Shawn Lee inquired if the building occupied four residences and Mr. Whittlesey stated it did. Shawn Lee inquired if it was zoned R -1 and Brent Miles stated it was and that carports were a permitted accessory use it was the issues with the drive and outside storage that posed a problem. Barbara Snyder stated that there were apparently issues with drainage, encroachment and open storage and more specific drawings would be needed. Motion to Deny Shawn Lee made a motion to deny the building permit request for a carport at Building Permit 5008 NW High Drive Terr. and ask the applicant to reapply; seconded by Ray Ken Whittlesey Uhl; all voted aye; motion carries. 5008 NW High Drive Terr. Request for Sign Brent Miles stated that the sign permit request from Available Construction Permit needed to be continued to the next meeting. Available Construction 4439 NW Gateway Motion to Continue Shawn Lee made a motion to continue the request for sign permit for Available Sign Permit Construction; seconded by Aaron Locke; all voted aye; motion carries. Available Construction 4439 NW Gateway General Discussion Motion to Recommend Shawn Lee made a motion to recommend elimination of carports in the code Elimination of Carports as a permitted accessory item; seconded by Evelyn Poe; all voted aye; motion as accessory item carries. Codes Enforcement Brent Miles stated that the new Codes Enforcement Officer, Jim Hare was Complaints busy working on violations. 3 -D Cars was in violation, however they were moving out. Motion to Recommend Shawn Lee made a motion to recommend a moratorium be placed on pre -owned Moratorium on Pre- car lots; seconded by Jim Burch; all voted aye; motion carries. Owned Car Lots Board Conduct Chairman Snyder cautioned board members to conduct board business in a professional manner and remember they had no authority as individuals. Pending Items Brent Miles stated that the new sign code was 90% complete. Motion to Adjourn Shawn Lee made a motion to adjourn the meeting at 8:30 p.m.; seconded by Aaron Locke; all voted aye; motion carries.� Kathleen L. Rose, Acting Secretary
