PLANNING & ZONING COMMISSION
RIVERSIDE, MISSOURI
AUGUST 14, 2003
The Planning and Zoning commission for the City of Riverside, Missouri, met for a regular meeting in the
Board of Aldermen room at City Hall, 2950 NW Vivion Road, Riverside, Missouri.
Chairman Barbara Snyder called the meeting to order at 7:30 p.m. The following members answered roll
call: Shawn Lee, Ray Uhl, Karen Gordy, Mike Shelton, George Flaws, Evelyn Poe, Aaron Lock, Cy
Houston, Mayor Betty Burch and Chairman Barbara Snyder. Jim Burch and Jim Smith were absent.
Also present was Community Development Coordinator, Brent Miles.
Approval of Minutes Chairman Snyder asked for any corrections or additions to the minutes of
July 10, 2003 July 10, 2003. Evelyn Poe made a motion to approve the minutes as presented;
seconded by Karen Gordy: all voted aye; motion carries.

presented; seconded by Ray Uhl; all voted aye; motion carries. George Flaws
abstained.
Public Hearing Chairman Snyder continued the Public Hearing for a Special Use Permit for
Continued Available Construction , 4439 NW Gateway to the next meeting.

Open Public Hearing Chairman Snyder opened the public hearing for a rezoning request from Dennis
Rezoning Request Rogers concerning a parcel of land in the Gate Woods Subdivision. This
Dennis Rogers zoning request is now R -I and he is requesting it be changed to C -1.

Comments from Public Evelyn Poe, 3002 NW Florence Road, stated her property borders Florence and
50`" Street and she did not want to see residential property changed to more
commercial property.
Brent Miles presented staff report stating the location meets size standards for
commercial use, the site fits with the continuity of the adjoining lots to the
east and northeast and the city will control the design standards in the C -1
district. Staff recommends approval for rezoning.
Cy Houston inquired if there were plans at this time and what direction
the building would face. Brent stated no plans at this time and the
building would face 50" Street.
Mr. Poe stated he opposed the rezoning because there were no plans or
drawings at present and they didn't want commercial another 100 foot
down a residential road.
George Flaws stated that the lot in question was really not a residential
lot.
Mrs. Poe stated there was a large storm drain ditch in the area. Brent
Miles stated this could be covered with parking but not a building.
Shawn Lee inquired if the traffic would impact the Poe's and Mrs. Poe
stated it would not.
George Flaws stated that no one would build a home on this lot because
of it's location.
Dennis Rogers stated he respected the concerns of the Poe's. He was
looking for property to build a fine arts school. He has taught 33 years.
He chose this location because he is excited about what's going on in
Riverside. His wife is a teacher at Park Hill South High School. He
currently teaches at Missouri Western and UMKC. He has met with the
City's staff on several occasions and impressed with their assistance.
He intends to build a Northland School of Fine Arts on 50 Street and
some type of professional building along Gateway, so it would be
two buildings. He states his philosophy is to "build people ". He currently
has 55 students and has talked to other faculty that want to teach.
Mrs. Poe stated she was opposed changing residential ground to
commercial ground and the City should think about that.
Mike Shelton inquired how many other properties could be changed
from residential to commercial and Brent stated minimal. Betty
Burch stated maybe on Vivion Road.
George Flaws inquired if this was the exit area of the old drive in.
Jim Trimble stated it was the exit from the drive in. It's roughly
300' back from Gateway. The hill was excavated 3 to 1 slope and
dedicated as a common area. It is 30' higher in elevation than the
rest of the residential and the hill drops off. The City acquired
an easement for a large storm sewer to carry water into that drain
that goes into a natural stream.
Close Public Hearing Chairman Snyder closed the public hearing at 8:15 p.m.
Motion to Recommend Cy Houston made a motion to recommend approval for the rezoning

all voted aye; motion carries. Evelyn Poe abstained.
Request for Building Brian Henly, 4507 NW Apache, presented application for a building
Permit permit to construct a deck and above ground swimming pool.
Brian Henly He stated the pool would be located at the end of his retaining wall.
4507 NW Apache and be 48" deep. It would have a 10 X 15 deck with a privacy gable and railings
48" high.
Staff report states that Mr. Henly have protective fencing of at least
four feet in height and include a protective enclosure. Approval is
recommended contingent upon what type of locking system will
be used.
Mr. Henly stated he knew it was late in the year but he wanted to
proceed so that they could be 8 to 10" of water to set the liner and
be ready for next year.
Mr. Uhl inquired if you would see this from the road and Mr. Henly
stated you would see the lattice work and railing.
Motion to Recommend George Flaws made a motion to recommend approval of the building permit

Request for Building Mr. Anthony Martini, presented application for Domoch Medical Systems, Inc.
Permit at 4032 NW Riverside Street, for an interior remodel to add interior offices.

Mr. Martini stated his building was located behind Zep Mfg. and they
had experienced growth and needed extra offices to accommodate employees.
Staff report stated that the building permit request did not change the footprint
of the building. He basically would be putting up walls and City Engineer
John Jackson, was working with Mr. Martini on load bearing capacity issues.
Shawn Lee inquired if this building had a truck ramp with overhead door and
metal steps to main entry and Mr. Martini stated it was. That they lease the
building at this time.
George Flaws stated this building was warehouse space.
Motion to Recommend Shawn Lee made a motion to recommend approval for the building permit
Approval forDomoch Medical Systems, Inc., 4032 NW Riverside Street, subject to
Building Permit City Engineer, John Jackson, determining the specifications with weight
Domoch Medical Systems, Inc. bearing capacities; seconded by George Flaws; all voted aye;
4032 NW Riverside Street motion carries.
Motion to Adjoum Shawn Lee made a motion to adjourn the meeting at 8:38 p.m.; seconded by
Ray Uhl; all voted aye; motion carries.
