HomeMy WebLinkAbout2003-06-26 Planning & Zoning Commission Minutes MINUTES PLANNING AND ZONINING COMMISSION RIVERSIDE, MISSOURI June 26, 2003 The Planning and Zoning Commission for the City of Riverside, Missouri, met in regular session in the Board of Aldermen Room at City Hall, 2950 Northwest Vivion Road, Riverside, Missouri. Chairman Snyder called the meeting to order at 7:35 p.m. The following members answered roll call Al Bowman, Karen Gordy, Shawn Lee, Aaron Locke, Fire Commander Mike Shelton, Chairman Barbara Snyder and Ray Uhl. Absent were: Mayor Betty Burch, Jim Burch, Alderman George Flaws, Vice Chairman Cy Houston, Evelyn Poe, and Jim Smith. Also present were City Engineer John Jackson, City Consultant Mike Duffy, Community Development Coordinator Brent Miles, and City Legal Representative Matt Kitzi. Approval of Minutes — May Ms. Gordy moved that the minutes of May 15, 2003 meeting be 15, 2003 approved as printed. Mr. Uhl seconded. The motion carried. Fire Commander Shelton and Mr. Locke abstained due to absence. Public Hearing — Proposed Chairman Snyder opened the public hearing for consideration of an Amendment to City Code ordinance amending Chapter 455 of the Riverside City Code by amending Sections 455.030, 455.100, Sections 455.030, 455.100, and 455.130 regarding the establishment of 455.130 — Establishment of Levee Critical Zone Development Regulations and the Administration the Levee Critical Zone thereof. Regulations and Administration Mr. Kitzi stated that the amendments satisfy the levee restrictions. The proposed portion of the Code is effective once the levee is constructed. There were no comments from the public. Public Hearing — Closed The Public Hearing was closed. Motion to Recommend Mr. Locke moved that the amendment be recommended for approval to the Approval Board of Aldermen. Mr. Lee seconded. The motion carried unanimously. Building Permit for Garden Gary Shipley, 5107 NW High Drive Terrace, appeared before the Shed — Gary Shipley, 5107 Commission to request a building permit for a garden shed. Mr. Shipley NW High Drive Terrace stated the wooden shed would be outside the detached garage. Mr. Uhl asked if it would need to be on cement slabs. After checking the Code, it was determined that it would not. Planning and Zoning Commission Minutes June 26, 2003 Page 2 Motion to Recommend Mr. Lee moved that the building permit be recommended for approval to Approval the Board of Aldermen. Ms. Gordy seconded. The motion carried unanimously. Building Pennit for Single Jim Jrold of Straight Builders, 4505 North Hickory, appeared before the Family Home – Straight Commission to request a building permit for a 3,000 square foot reverse Builders, 5113 NW Gower story and a half brick and stucco home. The plan for the home meets all Court Code requirements. Mr. Jackson requested the Commission consider requiring installation of metal roof truss, rafter uplift restraint or lift device; and that the driveway meet PWA standards. Motion to Recommend Mr. Locke moved that the building permit be recommended for approval to Approval the Board of Aldermen with the stipulations that a metal roof truss or rafter uplift restraint or lift device is installed, and that the driveway meets PWA standards. Mr. Lee seconded. The motion carried unanimously. Building Permit for Removal Gary Young, 5130 NW High Drive Terrace appeared before the and Installation of Fences at Commission to request a building permit. Mr. Young would like to install 5130 NW High Drive —Gary a 91 -foot privacy fence along the west side of his property. He would like and Loretta Young to take out the fence along the south and north sides and replace it with a 76 -foot fence that is four feet high. The fence would be cedar. No survey is required. The City would not be liable to make sure the fence is on his property. He would be responsible for the upkeep of the grass between the two fences. Mr. Young said he did not plan on a stake survey. Mr. Uhl asked about aesthetics with the neighboring chain link fence. Chairman Snyder allowed neighbor, David Lavar, 4003 NW 52 Street, to address the Commission. Mr. Lavar stated he was concerned about the security of his pets, and would like to see the wooden fence with a concrete footer. He has one for the existing fence. He would also like to see consistency in which side of the fence is in his yard (smooth or rough). He is concemed with visibility from the front of his home. He asked if he needed a permit to put a security camera to see above the fence. Mr. Young stated he would be responsible for cleaning between the two fences. His fence should not hinder visibility in the front of Mr. Lavar's home because it will be aligned to the edge. Discussion Tabled until later Mr. Lavar suggested the two neighbors meet to see if they could come to in the Meeting some understanding. Mr. Young agreed to the meeting. Chairman Snyder tabled further consideration of the item until later in the meeting. Planning and Zoning Commission Minutes June 26, 2003 Page 3 Building Permit — Tumble Don Alexander, Allison & Alexander, 3403 NW Vivion Road, appeared Cheer, Don Alexander, 5130 before the Commission to request a building permit for a 16,000 square NW High Drive foot building. The building would house a gymnasium. It is in the C1 district. There will be 82 parking spaces with ADA spaces. There will be a turnaround to drop off children. The landscaping exceeds minimum requirements. There will be pole lighting and double shoebox lighting. Mr. Jackson recommends six inch drain tile footing instead of four inch because of the size of the building. He also recommends a mechanical connection between the shear plate and tension bars if rebar is to be used for the tension bars. Comment about Sign Setbacks Susan Downing, 1217 NE 43 Terrace, Kansas City, Missouri 64116, addressed the Commission. She requested the Commission consider the setback of signs. She felt the Tumble Cheer sign was too close to the road as she was leaving the cemetery. Motion to Recommend Mr. Lee moved that building permit be recommended for approval with the Approval stipulations that 1)Sheet S200 Foundation Sections — Six inch slotted rain tile footing drain instead of four inch as shown; and 2) Sheet 201, Section 8/S201 — A mechanical connection between the shear plate and tension bars if rebar is to be used for the tension bars. Ms. Gordy seconded. The motion carried unanimously. Building Permit Renewal Mr. Miles stated that Beverly Lumber, 2529 West Platte Road is requesting Extension — Beverly Lumber, a building permit extension. The extension would be for six months, but it 2529 West Platte Road is believed they will not need the extra time. Their current building permit is from January 2 — July 2, 2003. Mr. Miles also stated that the original permit was $112, but the renewal would be $250. Motion to Recommend Mr. Lee moved that the building permit extension be recommended with Approval approval, with leniency in the renewal fees considered. Mr. Uhl seconded. The motion carried unanimously. Ru.K Sign Permit, Available Eery Johnson, 4434 NW Gateway, appeared before the Commission to Construction, Gary Johnson, request a sign permit. Mr. Johnson is planning for three signs, which will 4434 NW Gateway all total less than 10% of the facade of the building. The first sign would read "Available Carpet and Tile," the second sign, "Available Construction," and the last sign "Available." Mr. Lee wondered if "Available" was too vague. The signs meet all City Codes. Motion to Recommend Ms. Gordy moved that the sign permit be recommended for approval to the Approval Board of Aldermen. Mr. Lee seconded. The motion carried unanimously. Planning and Zoning Commission Minutes June 26, 2003 Page 4 Sign Permit, United Sign/G.E. Scott Wagner, United Sign, 4900 Lister, Kansas City, Missouri, appeared Polymershapes before the Commission. Mr. Wagner requested approval for three signs. Two signs would be the same, and the third sign would be basically for delivery. The third sign would face the southwest. It would be a metal sign with vinyl cropping. The side and rear signs would be visible from Highway 9. All three signs combined within the 10% limit. Mr. Lee moved that the sign permit be recommended for approval to the Motion to Recommend Board of Aldermen. Mr. Locke seconded. The motion carried Approval unanimously. Continuation -- Young, Fence, 1 Z Young stated that Mr. Lavar has agreed to move his fence. That will 5130 NW High Drive eliminate the issue of maintaining the area between the two fences. Mr. Lavar will also do what is necessary to keep his dogs in his yard. The request meets City Code requirements. Motion to Recommend Mr. Locke moved that the building permit be recommended for approval to Approval the Board of Aldermen. Mr. Lee seconded. The motion carried unanimously. General Discussion Fire Commander Shelton stated that while on vacation he noted 20 -foot fire lanes with the words "Fire Lane" in red areas in large lots. He would like Tumble Cheer to consider something like that. Mr. Duffy stated that 24 -foot lanes have been done in the past. He would like to make sure that public safety is part of the standard review rather than having an ordinance. Adjournment Mr. Lee moved that the meeting adjourn. Ms. Gordy seconded.
