HomeMy WebLinkAbout2003-05-15 Planning & Zoning Commission Minutes MINUTES PLANNING & ZONING COMMISSION RIVERSIDE, MISSOURI MAY 15, 2003 The Planning and Zoning Commission for the City of Riverside, Missouri, met for a special meeting in the Board of Aldermen Room at City Hall, 2950 NW Vivion Road, Riverside, Missouri. Chairman Barbara Snyder called the meeting to order at 7:30 p.m. The following members answered roll call: Shawn Lee, Ray Uhl, Karen Gordy, Jim Smith, George Flaws, Mayor Betty Burch, and Chairman Barbara Snyder were present. Jim Burch, Aaron Locke, Evelyn Poe, Cy Houston and Mike Shelton were absent. Also present was City Administrator, David Blackburn, City Consultant, Mike Duffy and City Attorney, Ben Prell. Approval of Minutes Chairman Snyder asked for any corrections or additions to the minutes of May 8, 2003 May 8, 2003. Shawn Lee made a motion to approve the minutes as presented; seconded by Jim Smith; all voted aye; motion carries. Public Hearing Mr. Jim Flemington, Apex Construction, 9207 Slater, Overland Park, Continued Kansas, was present to request a special use permit for Riverside Seat Special Use Permit Company. They will be constructing a new facade on the existing building. Apex Construction and Riverside Seat Co. Mike Duffy, City Consultant, stated the building occupied by Riverside Seat Co., 500 NW Platte Valley Drive, was located within the current flood hazard zone and subject to Chapter 455, Article V, Section 455.150 "Provisions for Flood Hazard Reduction ". The addition to the facade does not occupy flood volume, has no mechanical, electrical, plumbing, heating or ventilation components and conforms to City Code. The building is located in a building permit moratorium area for new development but does not violate the object of the ordinance because there are no changes to the building. Staff recommends approval. Public Hearing There being no further comments from the public, Chairman Snyder closed the Closed the public hearing at 7:33 p.m. Mayor Burch inquired if elevations were required and Mike Duffy stated they were not. Mayor Burch suggested that the first building permit be attached to this subsequent permit and that would show elevations. Mike Duffy stated staff would put that together. Motion to Recommend Shawn Lee made a motion to recommend approve the Special Use Permit for Approval Apex Construction to construct a new facade on the Riverside Seat Co. building Special Use Permit at 500 NW Platte Valley Drive; seconded by Ray Uhl; all voted aye; motion Apex Construction/ carries. Riverside Seat Co. Request for Building Mr. Jim Flemington presented application for a building permit for construction Permit if a new facade on the Riverside Seat Co. building at 500 NW Platte Valley Dr. Apex Construction Motion to Recommend George Flaws made a motion to recommend approval of the building permit Approval application for Apex Construction to construct a new facade on the Riverside Building Permit Seat building at 500 NW Platte Valley Dr.; seconded by Shawn Lee; all voted Apex Construction/ aye; motion carries. Riverside Seat Co. Public Hearing Chairman Barbara Snyder opened the previously continued public hearing Continued to consider design standards in the commercial and industrial districts at 7:39 p.m. Mike Duffy, City Consultant, presented each board member with a five -page document that proposed design standards for the commercial and industrial districts. He stated that this process was very similar to the "CPO" District and primary purpose was to establish guidelines to improve the aesthetic appearance of buildings, signage, and lighting. He stated prior to this meeting, he received a faxed -letter from a property owner stating concerns with proposed guidelines as follows: C.1 Horizontal and vertical elements shall extend completely around the building? Mike Duffy stated four -sided construction should be completed and a building in the commercial district would not necessarily be added onto like a building in the industrial district. Chairman Snyder inquired if there could be an exception to that rule and Mike Duffy stated certainly and in fact two modifications were made to the Filger Car Wash with side yard set back and signage. H.1 Requires 35 ft. set back from any single family residentially zoned property? Mike Duffy stated that the property owner's concern was that a 5000 s.f. lot would be un- buildable. Mike stated the request could always go to the Board of Zoning Adjustment. The committee reduced it from the CPO guidelines. They know that some Cl lots along Vivion and West Platte are not as deep. I. lc Excludes "stucco pre - manufactured panels "? Mike Duffy stated EFIS panels would not be acceptable. 1.1e Standing seam -metal roofing as an incidental role? Mike Duffy stated he did not see the complaint with this item. The list of materials speak for themselves. J.3 Required pitched roofs on single story buildings? Mike Duffy stated pitched roofs should be required on single -story buildings, Buildings using flat roofs with a pitch of 2" vertical to 12" horizontal or less shall incorporate parapets or cornice lines. The roof line is measured to mid- point. Shawn Lee inquired about problems with ice and snow on metal roofs and sheeting off. Mike Duffy stated aesthetics were addressed here and liability to public was on property owners. We can address that to applicants. J.7 Allows control of color schemes, material styles and textures to BOA? Ben Prell, City Attorney, stated this provision would be safe and the legality to allow this flexibility to the BOA would fall in our favor. No grandfather clause to address permits in progress...? Ben Pre11 stated that Chapter 460 addresses this and would cover it. General discussion was held about color schemes, chain link, vinyl, and wood fence materials. It was determined that the guidelines need to be as clear as possible so the public know what they have to meet. The City needs to be diligent to enforce maintenance issues. Motion to Recommend George Flaws made a motion to recommend approval of the design standards Approval in a commercial and industrial district; seconded by Betty Burch; all voted aye; Design Standards motion carries.
