HomeMy WebLinkAbout2003-01-23 Planning & Zoning Commission Minutes MINUTES PLANNING & ZONING COMMISSION RIVERSIDE, MISSOURI JANUARY 23, 2003 The Planning and Zoning Commission for the City of Riverside, Missouri, met in regular session in the Board of Aldermen Room at City Hall, 2950 NW Vivion Road, Riverside, Missouri. Chairman Snyder called the meeting to order at 7:30 p.m. The following members answered roll call: Jim Burch, Gale Perkins, Mayor Betty Burch, Jim Smith, Karen Gordy, Ray Uhl, Shawn Lee and Chairman Barbara Snyder. Cy Houston, Mike Shelton, George Flaws, and Aaron Locke were absent. Also present were City Administrator, David Blackburn, and City Consultant, Mike Duffy. Approval of Minutes of Chairman Snyder asked for any corrections or December 9, 2002 additions to the minutes. Shawn Lee made a motion to accept the minutes as presented; seconded by Ray Uhl; all voted aye; Karen Gordy abstained as to the 12/9/02 minutes; motion carried. Request for Sign Permit City Consultant, Mike Duffy stated that the request Filger Car Wash for sign permit submitted by John Filger required 2806 NW Vivion Road more information and requested the action be tabled to the next meeting. Shawn Lee made a motion to table the request to the next meeting; seconded by Gale Perkins; all voted aye; Jim Burch abstained; motion carried. At this time Barbara Snyder abstained from discussion of meeting. Mayor Betty Burch sat as Chairman. Request for Building Permits Wayne Snyder, 4909 NW Merrimac, presented Syntec Custom Construction application for construction of 8 new homes; 2 5014 -5016 Merrimac on Merrimac and 6 on Strathbury on behalf of 5011 -5017 Strathbury Mr. Chris Roberts with Syntec Custom Const. Mr. Snyder explained that specific home - styles were planned on specific lots, but would like to request the flexibility of being able to accommodate prospective buyers by being able to change a designated home -style if needed. He also explained that Syntech would build the seven home - styles and they would be • displayed as model homes for other homes that may be built in Riverside. He stated that the home -style "The Farmington" would not be built. Mr. Snyder stated that they already had to change one house plan on a certain lot for a buyer and they wanted to have that flexibility for others. They were requesting to obtain permits for all lots so that all the foundations could be done at one time. Before being built these homes would be pre -sold and not "spec" homes. Jim Burch stated that this request had never been done before and we had always given independent permits for specific houses. He stated that waiting two weeks until a next meeting would be the better solution versus potential problems down the road. He felt it was a simple process to come back. Mayor Betty Burch stated that a building permit was only effective for six months and it would have to renew if they needed more time. Mayor Burch inquired if other properties had been purchased. Mr. Snyder stated they were in negotiations. Shawn Lee inquired that once the slab was in place on a specific lot then the buyer would know what home -style had been chosen. Mr. Snyder stated that once they start they are set, however, they expected to sell the houses fairly quickly. Jim Burch stated that Syntec apparently wanted the flexibility to market these houses and change the home style to fit on a different lot. Mike Duffy, City Consultant, stated that Snytec proposed to build 8 homes between 1700 and 2300 square feet with a price range of $173,000 and $230,000. All home styles except the Foxbury would fit on all lots. All setbacks ,elevations, and drainage issues have been addressed. At this point it is probably best to tie each home style to a specific lot and it would be a short turn around time to revise it if the request was made. Ray Uhl inquired if any other cities approved permits in this manner. Mr. Snyder stated he did not know. Ray Uhl inquired if three homes, for example, did not appear to be a popular design if they would find other plans. Mr. Snyder stated it was certainly a common sense factor but there was a direct advantage of seeing seven homes already complete. Mayor Burch inquired if the homes were marked correctly as this point. Mike Duffy stated that the Foxbury and Crawford have been switched. Motion to Recommend Gale Perkins made a motion to recommend Approval approval of the 8 building permits for single family homes as presented with specific home styles on specific lots and if there are any changes then applicant would need to return; seconded by Shawn Lee; Jim Burch, Gale Perkins, Ray Uhl, Jim Smith, Karen Gordy, and Shawn Lee voted aye; Mayor Betty Burch, opposed; motion carried. Barbara Snyder returned as Chairman of the rest of the meeting. Request for Minor Subdivision Joe Lee, 5400 Merrimac, Kansas City, Mo. and Building Permit was present on a lot -split approval and 5001 NW Hillside a building permit application for 5001 NW Hillside. City Consultant, Mike Duffy, stated there was a slight change in the Commission's handout. Once the minor subdivision and plot plan were approved, it would be ready for signatures and recorded. The building permit addressed the middle lot and meets all code requirements, elevations and drainage issues. Shawn Lee inquired about the field inlet not showing on the plat. Mike Duffy stated it would not show on a legal instrument. Motion to Recommend Gale Perkins made a motion to recommend Approval — Minor Subdivision approval of the minor subdivision as presented; seconded by Ray Uhl; all voted aye; motion carried. Jim Burch inquired about the drainage and if the applicant realized the house would be setting four feet below the road. City Consultant, Mike Duffy, stated that the two south lots did fall away from the road. Also, fill would have to be brought in and there were concerns about driveway ponding. The two homes that would be hurt would be their two homes. The off -site has been solved. The code for grading and plot plan for single family does not require it to be sealed. Jim Burch stated that this particular issue needed to be addressed and changed, so that someone else's water doesn't run off on others. Shawn Lee inquired that the plans showed the garage on the side and on the front. Joe Lee stated that city staff had discussed this and it was not a problem. The garage would be on the front. Shawn Lee stated it was not according to plans as presented. Mike Duffy stated that switching the garage from the side to the front did not bring any problems. Motion to Recommend Gale Perkins made a recommendation to Approval- Building Permit approve the building permit for a single family home at 5001 NW Hillside noting that the placement of the garage on the plans is not correct and would be moved from the side to the front; Karen Gordy seconded; all voted aye; motion carried. General Discussion City Administrator, David Blackburn, stated that the Mayor and Board of Aldermen passed the new IBC codes. Motion to Table Building Permit Gale Perkins stated that the building permit Red X -- Car Wash for the car wash at Red X was tabled from last meeting to this meeting. Mike Duffy stated it would need to be tabled to 2/13/03. Shawn Lee made a motion to table the building permit for Red X Car wash until 2/13/03; seconded by Jim Smith; all voted aye; motion carried.
