R- 2013 -045 A RESOLUTION APPROVING AND ACCEPTING A PERMANENT SANITARY SEWER EASEMENT AND TEMPORARY CONSTRUCTION EASEMENT FROM FLEMING BABCOCK, INC., AND AUTHORIZING ACQUISITION PAYMENT WHEREAS, the Board of Aldermen find it to be a public purpose and in the best interest of the public in connection with the Horizons development to acquire certain property easements as further described herein. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: THAT the Board hereby approves and accepts the Permanent Sanitary Sewer Easement and Temporary Construction Easement, in substantially the form attached hereto as Exhibits A and B, from Fleming Babcock, Inc.; and FURTHER THAT compensation in the amounts of $3,426.75 for the Permanent Sanitary Sewer Easement, and $1,930.69 for the Temporary Construction Easement are hereby approved to acquire such easements; and FURTHER THAT the Mayor, the City Administrator, the City Attorney and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Resolution and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary or convenient to perform all matters herein authorized; and FURTHER THAT all resolutions (including R- 2013 -039), or parts thereof, in conflict herewith are hereby repealed.
