AN ORDINANCE APPROVING THE FINAL PLAT OF BRIARCLIFF HILLS FOURTH PLAT,
A SUBDIVISION OF THE CITY OF RIVERSIDE, PLATTE COUNTY, MISSOURI.
WHEREAS, Application No. PC13 -14FP, submitted by Greenside Investments, LLC on
behalf of Briarcliff Development Company, LLC requesting approval of the final plat for Briarcliff
Hills Fourth Plat, a subdivision in the City of Riverside, Platte County, Missouri, was referred to
the Planning Commission; and
WHEREAS, the Planning Commission considered the application on June 13, 2013 and
rendered a report to the Board of Aldermen recommending that the final plat be approved; and
WHEREAS, the Board of Aldermen find that the final plat substantially conforms to the
approved preliminary plat and to all applicable requirements of the City of Riverside Unified
Development Ordinance; and
WHEREAS, the Board of Aldermen find it is in the best interests of the City of Riverside,
Missouri to approve the final plat of Briarcliff Hills Fourth Plat as set forth herein;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
SECTION 1 — APPROVAL OF FINAL PLAT. That the final plat of "Briarcliff Hills
Fourth Plat ", (hereinafter the "Plat ") a subdivision of the City of Riverside, Platte County,
Missouri, a true and correct copy of which is on file with the City Clerk, is hereby approved
and accepted as a subdivision of the City of Riverside, Missouri, platting the property legally
described in Exhibit "A" attached hereto.
SECTION 2 — CONDITION OF APPROVAL. The approval and authority granted in
Section 1 hereof is conditioned upon the approval by the Board of Aldermen and execution of
a Declaration of Conditions, Covenants, and Restrictions over the platted area, which shall be
filed of record with the Platte County Recorder of Deeds prior to or contemporaneously with
the filing of the plat.
SECTION 3 — APPROVAL AND ACCEPTANCE OF DEDICATION. That the City of
Riverside approves the dedication of the streets, municipal uses, rights of way and access
easement(s)s shown on the Plat, not heretofore dedicated to the public, and accepts the same
for public use.
SECTION 4 — ACCEPTANCE OF UTILITY EASEMENT DEDICATION. That the
dedication to the City Riverside of an easement or license to locate, construct and maintain or to
authorize the location, construction and maintenance of facilities and use of conduits for all or any
purpose, including but not limited to, water, gas, sanitary sewer, storm sewer, telephone, cable
television, drainage, poles and wires, over, under or along the strips of land marked "UTILITY
EASEMENT" or "U /E" or within any street or thoroughfare dedicated to public use on the Plat is
hereby accepted.
SECTION 5 — BUILDING LNES. The building or setback lines are hereby established as
shown on the Plat and no building or portion thereof shall be constructed between this line and
the street right of way line.

SECTION 6 — REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of
ordinances in conflict with this ordinance are hereby repealed.
SECTION 7 — SEVERABILITY CLAUSE. The provisions of this ordinance are severable
and if any provision hereof is declared invalid, unconstitutional or unenforceable, such
determination shall not affect the validity of the remainder of this ordinance.
SECTION 8 — EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after the date of its passage and approval.

Platte County, Missouri, described as follows:
BEGINNING at the Northwest corner of Tract A, Briarcliff Hills Second Plat; thence South 10
degrees 34 minutes 05 seconds West along the West line of said Tract A, a distance of 126.01
feet to a point; thence North 65 degrees 07 minutes 09 seconds West along the Westerly line of
said Tract A, a distance of 31.59 feet to a point; thence South 24 degrees 52 minutes 51
seconds West along the Westerly line of said Tract A, a distance of 17.69 feet to the Southwest

General Information
Applicant: Briarcliff Development Company
Location: 1755 NW 42 "" Street- Briarcliff Hills
Application: Replat of a part of Tract A Briarcliff Hills Second Plat — modifications to previously
approved plat
Current Zoning: PD- Planned Development
Existing Land Use: Undeveloped
Proposed Land Use: Single Family Homes
Site Area: Approximately 42,983 sq.ft.
Procedure: The plat will be reviewed by the Commission and the Board of Aldermen.
Analysis
Overview: Briarcliff Development Company is developing the Briarcliff Hills Subdivision located
northeast of the intersection of West Platte Road and Valley Lane. The original plat called for Tract A to
eventually contain a clubhouse and pool that will be owned and maintained by the homeowner's
association. The applicant is now proposing to construct the clubhouse and pool on the east side of
Valley Lane as they develop that area. They are proposing to take 42,983 sq.ft. of Tract A and replat it
as Lot 1 of Briarcliff Hills Fourth Plat to eventually construct a single family home on. The remaining
1,509 sq.ft. will remain in Tract A for easement purposes.
Site Layout: The land included in the plat is undeveloped and does not require any new right -of -way or
easements. All roads and utilities to the site have been installed.
Conformance to Comprehensive Master Plan: The modified plat and proposed use is in conformance
with the Comprehensive Master Plan as the plan identifies the area for single family homes.
Recommendation
Staff finds the application in conformance with the Comprehensive Master Plan, UDO and previously
approved final plat, and therefore, recommends approval of the final plat of Briarcliff Hills Fourth Plat, a
replat of part of Tract A, Briarcliff Hills Second Plat.

MINUTES
REGULAR MEETING
PLANNING AND ZONING COMMISSION
RIVERSIDE, MISSOURI
Thursday, June 13, 2013
7:00 p.m.
The Planning and Zoning Commission for the City of Riverside, Missouri, met in regular session at
Riverside City Hall, 2950 NW Vivion Road, Riverside, Missouri.
Chair Al Bowman called the meeting to order at 7:00 p.m. Answering roll call were Ray Uhl, Harold
Snoderley, Jim Frakes, Mike Soler, Art Homer, and Steven Kaspar. Also present: Jackie Carlson
Planning and Business Services, James Fuller Building Inspector, Keith Payne Assistant Fire Marshall,
and Community Development Assistant Sarah Wagner. Members absent were Stephen King. Mike
Lombardo, and Mayor Kathy Rose
Approval of Minutes of Commissioner Snoderley moved to approve the minutes of May
May 23, 2013 23, 2013, seconded by Commissioner Kaspar
Motion passed 7 -0.
Public Hearing- Chair Bowman opened the Public Hearing at 7:00 p.m.
Special Use Permit
Revision- 6305 NW Sarah Wagner explained that the applicant, Damon Pursell
Riverpark Drive Construction, was requesting an amendment to their Special Use
Permit to expand the scope of their services to include sheetrock,
paper and aluminum recycling. She explained that the physical
area of their operation would not expand, just their recycling
services. From 2005 to 2011 the applicant has had their SUP
reviewed on a annual basis. In 2011 it was decided to allow them
to continue operations without annual review as a long as they
had no code violation. To date the applicant has never had a code
violation. Staff recommends approval of the amendment to their
SUP and that they be allowed to continue operations without
annual review as long as they have no code violation.
Mike Pursell address the Commission and expanded on the scope
of services and his operation.
Having no comments from the public, Chair Bowman closed the
public hearing at 7:07 p.m.
Commissioner Frakes moved to recommend approval of the
amendment to the Special Use Permit for Damon Pursell

Construction to the Board of Aldermen, seconded by
Commissioner Uhl.
Motion passed 7 -0.
Public Hearing - PD Chair Bowman opened the Public Hearing at 7:08 p.m.
Amendment for Horizons
East
Carlson explained that the applicant, North Point Development
was requesting an amendment to the approved PD regulations for
Horizons East to allow 3 wall signs on industrial buildings that met
certain criteria. Signs would still be limited to one per wall with a
maximum size of 150 feet for a single tenant building
The Commission discussed the aesthetics of the signs and the
justification for the amendment.
Chair Bowman closed the Public Hearing at 7:26 p.m.
Commissioner }Caspar moved to recommends approval of amending the
approved Planned Development Regulations for Horizons East to the
Board of Aldermen. Commissioner Soler seconded and the motion
passes 7 -0.
Final Plat- Briarcliff Hills Carlson explained to the Commission that the applicant, Briarcliff
Fourth Plat Development, was requesting to replat a portion of Tract A of
Briarcliff Hills Second Plat and have it as a residential lot. The
original plat had planned for Tract A to be the location of a
clubhouse and pool. The applicant now plans to construct the
pool and clubhouse on the west side of valley. A small portion of
Tract A will remain for easement purposes.
Commissioner Snoderley moved to recommend approval of the
Final Plat for Briarcliff Hills Fourth Plat to the Board of
Aldermen. Commissioner Homer seconded and the motion
passed 7 -0
Adjourn Commissioner Uhl moved to adjourn, seconded by Commissioner
Homer.
Motion passed 7 -0 and the meeting was adjourn at 7:32 p.m.
