HomeMy WebLinkAbout2002-01-10 Planning & Zoning Commission Minutes MINUTES PLANNING AND ZONINING COMMISSION RIVERSIDE, MISSOURI January 10, 2002 The Planning and Zoning Commission for the City of Riverside, Missouri, met in regular session in the Board of Aldermen Room at City Hall, 2950 Northwest Vivion Road, Riverside, Missouri. Chairman Steve Warger called the meeting to order at 7:35 p.m. The following members answered roll call Alderman George Flaws, Karen Gordy, Cy Houston, Gale Perkins, Vice Chairman Larry Reece, Jim Smith, Barbara Snyder and Chairman Steve Warger. Absent were: Mayor Betty Burch, Rosa Curttright, Aaron Locke, Toni Looker, Fire Commander Mike Shelton. Jim Burch entered after roll call. Also present were Codes Enforcement Officer Dwight Flowers, City Engineer John Jackson, and City Attorney Matt Kitzi. Approval of the Minutes of Vice Chairman Reece moved that the minutes of December 13, December 13, 2001 2001, be approved as printed. Mr. Smith seconded. The motion carried. Ms. Gordy abstained due to absence. Request for Building Dean Lefstad, 12 West 4` Street, Parkville, Missouri, appeared Permit — Dean Lefstad, before the Commission. Mr. Lefstad requested a building permit for 4720 NW Petronella Lane his property at 4720 NW Petronella Lane. Mr. Lefstad said the contractors have been selected, and he is currently attempting to get utilities. He stated the land was sold with the driveway to an adjacent property. It may require an easement. A question of whether it requires a public street became an issue. Mr. Jackson did not think it needed a street since it is so far south. Chairman Warger stated the Commission would want to watch for any precedents it may set. Mr. Burch stated that if the City wants to improve land south, easements will be needed and it would be easier to get them now. Attorney Kitzi said that that could be looked into before it goes to the Board of Aldermen. Motion to Recommend Ms. Snyder moved that the building permit be recommended for Approval approval contingent upon a satisfactory determination following a reasonable further investigation into compliance with applicable code provisions, including, without limitation, a survey of public right -of -way and potential resultant dedication. Mr. Smith seconded. The motion carried unanimously. Planning and Zoning Commission Minutes January 10, 2002 Page 2 Request for Building Bryan Evans, 303 Marshall Drive, Platte City, Missouri, appeared Permit, BSE Enterprises for before the Commission. Mr. Evans requested a building permit for a a Subway Shop at 1841 Subway Shop in the 1831 NW Vivion Road building. The Subway NW Vivion Road Shop would be 1,400 square feet, seating 40 — 50 people. Mr. Evans is the owner of five Subway Shops. This restaurant is expected to have eight to ten employees. It can be built in six weeks. The parking lot is in place. They would expect to have the Certificate of Occupancy in the couple of weeks. Motion to Recommend Alderman Flaws moved that the building permit be recommended Approval for approval by the Board of Aldermen. Ms. Gordy seconded. The motion carried unanimously. Argosy Casino Preliminary Bill Browning, PGVA Architects, 1900 West 47 Place, Westwood, Development Plan Kansas, appeared before the Commission. Mr. Browning presented the site development plan for the new 60,000 floating facility for Argosy. It is in the GP -1 Retail area with expanded parking. Mr. Browning will return to submit the final sign requests final light and landscaping and other needed submissions along the way. It is expected that construction will take 18 months, with completion in September 2003. The goal is to gear more toward the west and to have better vehicular parking. Motion to Recommend Vice Chairman Reece moved that the plan be recommended for Approval approval to the Board of Aldermen. Ms. Snyder seconded. The motion carried unanimously. Fred Buckley, Kansas City Fred Buckley, Kansas City Home Builders Association, 600 East Home Builders Association 103 Street, appeared before the Commission. Mr. Buckley stated he was here to speak in place of Steve Begshaw. He wanted to speak to the issue of Minimum Floor Requirements for Single Family Dwelling. Mr. Buckley stated the ordinance as written is going to increase housing in Riverside. He gave examples of several nearby cities and their minimum floor requirements. Riverside's would be higher than most, and would be the only one that does not include all living space — specifically, the basement. In order to compensate for not using the basements, homes would need to be bigger. Mr. Buckley also stated it would eliminate choices. Planning and Zoning Commission Minutes January 10, 2002 Page 3 Fred Buckley stated that there is conflict between the International Residential Code and the proposed requirement. The International Residential Code states that egress windows must be in every habitable space and that includes basement. By excluding the basement in the minimum space requirement, Mr. Buckley thinks the two will conflict. Continuation of Public Vice Chairman Larry Reece moved that the public hearing of Hearing to consider December 13 to consider Amending City Code Section 410.020 Ordinance Amending City related to Single Family Residential Buildings in Districts Zoned R- Code Section 410.020 1, "Minimum Floor Area," be reopened. Mr. Burch seconded. The related to Single- Family motion carried. Residential Buildings in Districts Zoned R -1, Attorney Matt Kitzi gave a recap on the changes that are being "Minimum Floor Area" proposed. Jim Trimble, 7 Main Street, Parkville, Missouri addressed the Commission. Mr. Trimble said the proposed amendments would exclude several kinds of homes. Half of his current project would no longer qualify. He stated the terrain in this area often requires a walkout basement. Mr. Trimble suggests a compromise would be that the basement be allowed to be used in the calculation of minimum square footage. The old definition of basement and cellar would better fit. Changes were made to the proposed amendments after publication of the announcement. The corrected proposed ordinance was distributed. Wayne Snyder, 4909 Northwest Merrimac, Riverside, Missouri, then addressed the Commission. Mr. Snyder stated some home designs would be eliminated. He stated he is supportive of the spirit of the proposed law, but thought it was confusing. Sandy Schmude, 7357 Southeast Hanesville, Holt, Missouri, then addressed the Commission. Ms. Schmude mentioned that other types of split -level homes would be eliminated. She stated she did not have the information, but believed that statistics north of river show 77% of the homes are split level (raised ranch, reverse story and a half). She stated she would be happy to present the actual statistics north of the river at a later date. She suggested that square footage be set and then the Committee decide on a house -by -house basis. Discussion by Commission Alderman Flaws said the goal of the proposed ordinance is to ensure that "crackerjack boxes" are not built for homes. Mr. Burch stated he was concerned with relaxing the requirements. It would open the door to lower -priced houses. He does not think the proposed ordinance will eliminate many builders. Ms. Perkins stated that after public comments, the proposed ordinance might eliminate the diversity of income that the City currently has, and that is a concern to her. Ms. Schmude asked if it was fair to limit housing. Further Consideration by Ms. Snyder reminded the Commission that they were discussing the Commission "minimum" standards. Mr. Houston stated the concern to buy or inherit a lot and build a small home was the purpose of the ordinance. Chairman Warger stated that probably 70% to 80% of Riverside homes would not qualify for the 1,000 square foot minimum of first floor. Motion to Continue Mr. Smith moved that discussion by the Commission be continued until the next meeting. Ms. Gordy seconded. The motion carried unanimously. General Discussion Mr. Flowers stated that the name change for Petronella Street is expected to come before the Commission. Also, Brenners Ridge is ready to return to the Commission for the homes that are in Riverside of that development. Mr. Jackson stated that Argosy would return to the Commission four times. It will be open a week longer than originally stated because the City does not have all right -of -ways. Mr. Flowers stated that the Bell Tower project is progressing by the Argosy. The Med4Home building is coming along. Chairman Warger asked about the Gateway Right -of -Way. Mr. Jackson said it is still in the acquisition process. It will probably be 60 days. There will be some condemnations. On behalf of the Commission, Chairman Warger thanked the Mayor and others involved in allowing the Commission to meet in the Board of Aldermen Room Adjournment Alderman Flaws moved that the meeting be adjourned.
