PLANNING AND ZONINING COMMISSION
RIVERSIDE, MISSOURI
January 23, 2002
The Planning and Zoning Commission for the City of Riverside, Missouri, met in regular session in
the Board of Aldermen Room at City Hall, 2950 Northwest Vivion Road, Riverside, Missouri.
Chairman Steve Warger called the meeting to order at 7:35 p.m. The following members answered
roll call Jim Burch, Rosa Curttright, Alderman George Flaws, Karen Gordy, Toni Looker,
Gale Perkins, Vice Chairman Larry Reece, and Chairman Steve Warger. Absent were: Mayor Betty
Burch, Cy Houston, Aaron Locke, Fire Commander Mike Shelton, Jim Smith and Barbara Snyder.
Also present were Codes Enforcement Officer Dwight Flowers, City Engineer John Jackson, and
City Attorney Matt Kitzi.
Approval of the Minutes of Vice Chairman Reece moved that the minutes of January 10, 2002,
January 10, 2002 be approved as printed. Alderman Flaws seconded. The motion
carried. Ms. Looker and Ms. Curttright abstained due to absence.
Presentation by Sandra Sandra Schmude, 7357 Southeast Hanesville, Holt, Missouri, made a
Schmude presentation to the Commission. Ms. Schmude passed out statistics
from the Heartland Multiple Listing Service on the types of homes
and income for the Northland area. Based on the statistics Ms.
Schmude presented, 2,161 homes in Platte County, 40% of the
homes, are multi -level homes and would not meet the requirements
of proposed ordinance concerning minimum square footage. In the
area that includes Riverside, there are 467 multi -level homes or
57 %. Ms. Schmude said she wanted to caution the Commission
against exclusionary zoning. Of the homes built sold in Riverside in
2001, only one of the ten would meet the requirements set by the
proposed standard. Ms. Schmude also presented scenarios of the
level of income that would be necessary to build the size of home
required. Based on her calculations, a homeowner would need a
monthly income of $4,252 or $27 per hour.
Motion to Approve Vice Chairman Larry Reece moved that it be recommended to the
Amending City Code Board of Aldermen to approve amending City Code Section 410.020
Section 410.020 related to related to Single Family Residential Buildings in Districts Zoned R-
Single- Family Residential 1 "Minimum Floor Area." Mr. Burch seconded. Discussion

Ms. Looker asked what would happen if a disaster should occur to a
home in Riverside that does not currently fit the proposed
ordinance? Would it be possible to have the appropriate insurance?
It was stated that if the home was more than 50% destroyed, as
determined by the Codes Enforcement Officer, the building would
need to be rebuilt under the proposed ordinance.
Mr. Burch asked if it was necessary to do the entire city the same
way or if homes could be grandfathered.
Mr. Burch stated that homes on slopes could have a basement but
still be above grade because of the slope, and that would allow that
area to be counted, so looking solely at the types of homes as
presented by Ms. Schmude may not be accurate.
Mr. Burch stated that he believed it would not restrict people. It will
restrict lot sizes and some types of homes. He hopes we are looking
for something better for Riverside than it currently has for its future.
He also cautioned that if the proposed standards are relaxed, they
need to be done carefully.
Ms. Looker stated she is concerned about the numbers Ms. Schmude
presented. She does not want to shut out people.
Mr. Burch pointed out that Riverside is one of the poorest in the area
because of lack of housing and the number of apartments in the City.
Chairman Warger asked if a garage could be required. He wonders
if the residential area could be labeled as a planned district that
would require changes to come before the Commission.
The pre-1995 requirement was 1,500 square feet excluding the
basement. The current total is $1,500 square feet.

Approval of Motion to Ms. Gordy moved that with further recommendation that
Amend consideration be made to protect or grandfather the homeowners
who have had their residences destroyed by 50% or more by fire,
tornado or other natural disaster ore event of force majuere.
Alderman Flaws seconded. The motion carried. Ms. Perkins and
Ms. Looker voted against.
Ms. Looker said she is concerned about excluding one - income
families.
Approval of Motion as The motion to recommend to the Board of Aldermen to approve

ore event of force majuere carried. Ms. Looker, Ms. Perkins and
Chairman Warger voted against.
General Discussion Mr. Flowers passed out fliers on a Land Use Seminar sponsored by
MARCIT. Mr. Flowers also provided updates on projects.
Brenners Ridge is started and they should appear before the
Commission soon about the 13 houses being built in Riverside.
Mr. Lefstad changed some of his plans before between the Planning
& Zoning meeting and the Board of Aldermen meeting. It is
suggested that the Chairman will initial plans that are passed to
ensure a copy that is passed makes it to the Board of Alderman.
Subway is coming along. They are also planning an ice cream shop.
There is potentially a car wash to be built next to Sonic.

Mr. Jackson stated that West 50 is out to bid. There is a one -week
extension. The bid will close on February 22.
It was suggested that members of the Commission might want to
attend the Board of Aldermen meeting since there were concems in
passing this recommendation that should be voiced.
Adjournment Alderman Flaws moved that the meeting be adjourned. The meeting
adjourned at 9:17 p.m.
