HomeMy WebLinkAbout1232 CO 1 HB Construction 41st Street West & Helena Road BILL NO. 2013- 055 ORDINANCE NO. f a3 AN ORDINANCE AUTHORIZING AND APPROVING CHANGE ORDER 1 TO THE AGREEMENT BETWEEN THE CITY OF RIVERSIDE MISSOURI AND HB CONSTRUCTION, INC., AMENDING CERTAIN SPECIFICATIONS AT AN ADDITIONAL COST OF $24,401.03 AND REVISING THE AGREEMENT COST TO $921,372.86 WHEREAS, by and through Ordinance No. 1211 the City approved an Agreement between The City of Riverside Missouri ('Riverside ") and HB Construction ( "HB ") for completion of that certain public infrastructure improvement City Project No. 149 -000, also known as the 41 Street West and Helena Road Project, for an estimated cost of installation and construction of Eight Hundred Ninety -six Thousand Nine Hundred Seventy -one Dollars and Eighty -three Cents ($896,971.83) (the "Agreement "); and WHEREAS, City staff recommends and requests, and HB requests, the Board to approve Change Order 1, attached hereto as Attachment A and incorporated herein, to the Agreement and summarized as follows: Change Order 1: Specifications are being modified to: a) provide additional fill in the Public Utility Easement Corridor at a cost of $22,238.23; b) increase the size of the sanitary sewer pipe from six to eight inches at a cost of $402.80; and c) include an additional Performance and Maintenance Bond to meet KCMO requirements for the Sanitary Sewer at a cost of $1,760.00; For a total net cost INCREASE pursuant to Change Order 1 of Twenty -four Thousand Four Hundred One Dollars and Three Cents ($24,401.03) to increase the NEW TOTAL COST of the Agreement to Nine Hundred Twenty -one Thousand Three Hundred Seventy -two Dollars and Eighty -six Cents ($921,372.86) for HB. WHEREAS, the Board of Aldermen find that the Change Order 1 to the AGREEMENT is in the best interest of the City in that such action fulfills a public purpose and will further the growth of the City, facilitate the development of the entire Horizons site, improve the environment of the City, foster increased economic activity within the City, increase employment opportunities within the City and otherwise is in the best interests of the City by furthering the health, safety, and welfare of its residents and taxpayers. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1. BEST INTEREST OF THE CITY TO APPROVE CHANGE ORDER. SECTION 2. AUTHORITY TO EXECUTE. The Mayor, City Administrator and all other required city officials are authorized to execute the change orders authorized herein together with any and all documents necessary or incidental to the performance thereof and to take such other actions and /or execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance. SECTION 3. SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 4. EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after the date of its passage and approval. (149 -000) BACKGROUND: The construction of 41" St. & Helena Rd. is funded with a CDBG grant as part of Project Trim. In an effort to improve utility placement, staff is proposing to increase fill on the north side of 41" and east side of Helena. The additional fill will create a level utility corridor for the placement of water, electric, and gas lines. This change order will improve access to and maintenance of these utilities. The additional fill will also require the extension of storm outlets and a sanitary sewer service line. The total cost for these changes is $22,641.03. This change order also includes an additional Performance and Maintenance Bond to meet KCMO requirements for the Sanitary Sewer. The total cost for the bonding is $1,760.00. BUDGETARY IMPACT: The addition of $24,401.03 for Change Order No. I will result in a total amount of $921,372.86 for HB Construction, Inc. There are additional cost of $1760.00 to provide these bonds to the City of Kansas City, MO because I am bonding an additional person. I told Travis around $400.00 but that is not the case.
