HomeMy WebLinkAbout1246 Approving Services Agreement with Park Hill School District for Band PerformancesBILL NO. 2013-069 ORDINANCE NO. 1246 AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE TO ENTER INTO A SERVICES AGREEMENT WITH AND PAY CERTAIN FUNDS TO PARK HILL SCHOOL DISTRICT BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: SECTION 1 —AGREEMENT APPROVED The Board of Aldermen ("Board") approves the Agreement, in substantially the form attached hereto, with Park Hills School District, and authorizes the Mayor to execute the Agreement on behalf of the City; and SECTION 2 — AUTHORITY GRANTED. The Mayor, the City Administrator, the City Attorney and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary or convenient to perform all matters herein authorized. SECTION 3 — EFFECTIVE DATE. This ordinance shall be effective from and after its date of passage. Rose ATTEST: /s/ Robin Littrell Robin Littrell, City Clerk SERVICES AGREEMENT THIS SERVICES AGREEMENT entered into on this day of , 2013, by and between the City of Riverside, Missouri ("City") and the Park Hills School District ("Service Provider"). WHEREAS, the City desires to sponsor at least three musical performances ("Performances") so as to contribute to the welfare of the City and its residents; and WHEREAS, the Service Provider desires to provide such musical performance services to the City in an effort to showcase its musical program. Now, therefore, in consideration of the mutual covenants and agreements set forth herein, the parties agree to the following: 1. Place, date, and time of Show. The parties agree that the Service Provider shall provide musical performance to at least three events, presently estimated to be: • Holiday lighting ceremony on December 5 at the Riverside Welcome Plaza — a small group from the band to play. • Senior Lunch on Monday, December 9. Jazz Band. • One of the City sponsored Senior Dances in the Spring (from 1 to 3 p.m. on the last Monday of the month). The parties agree to work in good -faith on any changes to the event schedule, and different or additional events may be added. 2. Description of Show. Performances will be a musical performance with musical content decided by Service Provider that is consistent with the respective event's theme. 3. Payment. Compensation for the Service Provider will be $5,500.00, which shall be in full satisfaction of Service Provider's expenses in providing the Performances, including any transportation costs. 4. No Admission Fees. The City will not charge admission fees to the Performances. 5. No 3rd Party Beneficiaries. The provisions of this Agreement shall not be deemed to create any third party benefit hereunder for any member of the public or to authorize any one, not a party hereto, to maintain suit pursuant to the terms of this Agreement.
