HomeMy WebLinkAbout1277 Amending City Code 500.070 Pool Covers BILL NO. 2013-082 ORDINANCE NO. a 77 AN ORDINANCE AMENDING CITY CODE SECTION 500.070 RELATED TO POOL COVERS. WHEREAS, the Board of Aldermen of the City of Riverside, Missouri (the "Board ") has determined that it is necessary and desirable for the welfare, protection and safety of the residents of the City to enact ordinances governing the construction of buildings and continued occupancy thereof; governing plumbing, mechanical, electrical, construction; and conditions hazardous to life and to better protect the residents of the City from the danger of fire and faulty construction; and WHEREAS, the Board adopted the 2012 edition of the International Residential Code for One and Two - Family Dwellings; and WHEREAS, the City wishes to further amend the adopted technical codes; and WHEREAS, Missouri law provides that an amendment to the adopted technical code be on file with the City Clerk for a period of ninety days prior to its final adoption. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN FOR THE CITY OF RIVERSIDE, MISSOURI, as follows: SECTION 1— ADOPTION OF AMENDMENT. Section 500.070.0 of the City Code of the City of Riverside, Missouri is hereby amended by addition of the following subsection "18 ": 18. Section AG105.2 — Barrier Requirements A. Section AG105.2. is amended by adding subsection 11 as follows: Notwithstanding any ordinance to the contrary, the use of a swimming pool, hot tub, or spa, power safety cover that complies with ASTM F 1346 -91 shall be acceptable either in lieu of, or in addition to, the barrier requirement as otherwise set forth in Section AG105.2. B. It shall be an ordinance violation for any owner or occupant to own, maintain, use or operate a swimming pool, hot tub, or spa on his or her property that does not comply with the barrier requirements as established in Section AG105.2. C. If a power safety cover is utilized in lieu of the barrier requirement otherwise set forth in Section AG105.2, it shall be unlawful for any owner or occupant to fail to cover the swimming pool, hot tub, or spa, when not in use or when not under observation by a person at least 18 years old. SECTION 2 — REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 3 — SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 4 — EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval.
