HomeMy WebLinkAbout1279 Amending City Code Chapter 520 City's Blight Removal and Reinvestment Program BILL NO. 2014-007 ORDINANCE NO. /3) 7 9 AN ORDINANCE AMENDING CITY CODE CHAPTER 520 RELATING TO THE CITY'S BLIGHT REMOVAL AND REINVESTMENT PROGRAM BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: SECTION 1 - AMENDMENT OF CITY CODE CHAPTER 520. City Code Chapter 520.E.4 is hereby amended to read as follows (additions are underlined; deletions contain a smikethmugh)• E. Application Process and Procedures — Demolition. 1. Submit completed application form. 2. Meet with staff on site to discuss the project and for staff to conduct blight analysis. 3. City Staff will present its blight study to the Board of Aldermen for its consideration and final determination of blight. The Board of Aldermen's declaration that the subject property is blighted is a requirement of the Program. 4. Apply for a demolition permit, which permit fees will be waived. The Director of Community Development may require an environmental analysis if he has reason to believe that hazardous materials are or have been present. The analysis must be performed by a company approved by the City. An applicant is still responsible for complying with all applicable federal, state, and local laws or regulations. 5. Demolish the blighted structure. 6. Submit invoice and lien waiver from contractor stating they have received payment. If hazardous materials were present, documentation must be submitted stating the materials were appropriately disposed of by a business possessing a hazardous waste permit per Missouri Department of Natural Resources regulations. Proof of the permit must be submitted. 7. The City will provide a Program grant for 25% of the demolition costs, up to a maximum of $4,000 per structure. 8. Once an application for the Program has been submitted, the applicant will have 180 days to complete demolition. If demolition is not completed within this timeframe the applicant will not be able to receive funds. SECTION 2 — EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval. MEMO Memo Date: January 17, 2014 Agenda Date: January 21, 2014 To: Mayor and Board of Aldermen From: Jackie Carlson, Community Development Re: Blight Removal and Reinvestment Program Amendment OVERVIEW Last November the Board approved the Blight Removal and Reinvestment Program, which aims to address the Master Plan goal of removing blighted structures and increasing investment in new construction by providing matching funds for demolition costs. The first two applications for the program have been submitted. This has allowed staff to evaluate the program and examine potential changes to improve the efficiency of the program. Staff would like to amend two items of the program as outlined below. - Permit Fee: There is a $250 demolition permit fee. Staff is recommending this fee be waived for demolitions that are part of the program. - Environmental Analysis: The program requires that applicants submit an independent environmental analysis which states whether hazardous materials are present. This requirement is above what is currently required for obtaining a demolition permit and can be costly. Staff is recommending that the requirement be amended so that an environmental analysis is not mandatory but that the Director of Community Development may require such an analysis if there is reason to believe that hazardous materials may be present. As staff performs an on -site blight analysis, it is easy to identify if an environmental analysis needs to be completed. This change would put the program in -line with the current demolition permit process. REQUESTED ACTION Approve an ordinance to amend the Blight Removal and Reinvestment Program to waive demolition permit fees and adjust the requirements for environmental analysis. 1 of 1
