HomeMy WebLinkAbout2006-12-19Minutes of Regulaz Meeting of Boazd of Aldermen of City of Riverside, Missouri December 19, 2006 A regulaz meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, on December 19, 2006 at 7:00 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Jones, Dazata, Hurt, Beard and Super. Alderman Bruns was absent at the first part of the meeting, arrived later. Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, Jane Henry, Administration Assistant, Chief Gregory Mills, Brent Miles, Drrector of Planning & Economic Development, and John McClelland, City Attorney. Motion for Closed Alderman Darata moved that the meeting go into closed session, pursuant to Session at 6:36 p.m. RSMo 610.021(1) Legal and RSMo 610.021(2) Real Estate Issues with the City Attorney, seconded by Alderman Jones, and the vote was: Aldermen Darata, Jones, Super, Hurt and Beard. Alderman Bruns, absent. Motion carries. Alderman Bruns arrived at 6:50 p.m. Motion for Open Alderman Dazata moved that the meeting go into open session, seconded by Session at 7:00 p.m. Alderman Jones, the vote was: Aye: Aldermen Super, Darata, Hurt, Beazd, Bruns and Jones. Motion carries. Minutes, Dec. 12, 2006 Alderman Bruns moved that the minutes of December 12, 2006 be approved, Approved seconded by Alderman Jones, the vote was: Aye: Aldermen Bruns, Beazd, Darata, Super, Hurt, and Jones. ' Motion carries. Public Hearing Opened Mayor Rose opened the Public Hearing at 7:10 p.m that was continued from the December 5`~ meeting to consider amending Riverside Municipal Code repealing and replacing Title IV: Land Use with a new Unified Development Ordinance (LJDO) Brent's overview of This is the third Public Hearing regazding the Unified Development Ordinance the UDO (LIDO). Brent pointed out the procedures aze in one section, definitions and, zoning districts. Three zoning districts are being eliminated, Agriculture, I-2 and MH. The major things changed aze the sign regulations, landscaping requirements, the accessory structure regulations, process and allocations and permitted uses. Most of these are contributors of the ETC citizens survey. The accessory structure was probably the number one issue with the Planning Commission. From the November 9`~ draft there was Manufactured Housing and staff has recommended this not be a permitted use. It was previously talked about to eliminate multi-family housing, but to do this would cause all multi-family housing to have to be rezoned. The City then would not have any regulations on existing multi-family housing and this would not be a wise move. The sale of motor vehicles would not be a permitted use. A section on political signs was established. Requests for permanent fireworks buildings will no longer be permitted. The code now states 1 and 21ane drives widths with curb cuts. Brent mentioned some minor corrections (typos) to the proposed code. Brent said the staff would like to change the requirements for Change of Use Permits. He suggests if it is a business for instance is, office to office, administrative approval could be completed. There is a tier system, that by be increasing the intensity, then the change of use request would go to the Planning and Zoning Commission and to the Board of Aldermen for approval. Dwelling units were discussed, four or more units attached, possibly a condo. For four units attached, there would be 1,000 square feet average of all units, 850 squaze feet, minimum. Carports will not be allowed anymore. The code has been mad to be very "process orientated." Public Comments Irene Paulhe, 4700 NW Petronella Lane asked if there would be no control over multi-family housing. Brent said it was decided not to eliminate the multi-family housing because the City would be giving up control of regu- lations so this was kept in place so the City can keep control. Alderman Super asked about the expiration of Special Use Permits. Brent said the code reads to have an information for a Special Use Permit submitted with the Director of Planning and Economic Development. Alderman Super commented this being submitted to Brent personally rather than the City as a whole. Attorney John McClelland said Brent has no liability, this is a ministerial act and the person needs to file the form with a specific person at City Hall. Alderman Super asked about Change of Use Permits, tier 2 uses and if the board should be reviewing the Change of Use Permits. Alderman Super is asking for the boazd to know what is being approved (a review) when the staff and Planning Commission have already decided upon their approval. It was decided the Planning Commission Agenda will be placed in the Board of Aldermen packets so the boazd is aware of what is being submitted before approval occurs with the Planning Commission. Alderman Super mentioned equipment sales. The state allows a person to have a wholesale license from an office in their home, but no retail sale is allowed and thinks wholesale should be taken out of this section. Mike Duffy said the concern was where a vehicle, stock or material was stored. Aldennan Super said you cannot sell anything out of the location, but can have an office out of that location. Attorney John McClelland asked if the problem is more the presence of a vehicle on the property than the fact the sale of a vehicle would take place. Mike said he thinks it's the exact location of the piece of equipment versus where the transaction may necessarily be in place. Attorney John McClelland said "Wholesale" cannot be removed from the code because the City wouldn't have any regulation, but something could be made more cleaz to not apply to the home office type situation, retail or wholesale. Brent said what the staff was looking at was `ho selling" on the premises and that's it's a home office. Brent said they would clarify the definition for "Wholesale". Public Hearing Closed Mayor Rose closed the Public Hearing at 7:52 p.m. City Administrator Bud Keckler prepazed a report on the percentages of the projects for Merrimac as comment 92% complete, Petronella, 96.5% and Cliffview at 43%. David said Bartleby Content compared salaries with MARC's survey for the salary survey. They cross-referenced to match jobs, then ranked and did positioning. Salary Survey Alderman Hurt moved to approve the salary survey for the City, except Approved for the the rank of Sergeant, seconded by Alderman Darata, the vote was: except the rank of Sergeant Aye: Aldermen Super, Darata, Hurt, Jones, Beard and Bruns. Motion carries. Salary Survey Alderman Beard moved to approve the salary survey for the Sergeant Approved for the rank of classification, seconded by Alderman Bruns, the vote was: Sergeant Aye: Aldermen Darata, Hurt, Beazd, Bruns and Super. Alderman Jones did not vote due to a conflict of interest. Motion carries. Increase in budget Alderman Jones moved to approve an increase in the budget to $99,470.00 Approved to take place on January la`, seconded by Alderman Beard, the vote was: Aye: Aldermen Hurt, Beard, Bnuvs, Super, Jones and Darata. Motion carries. Court Report for Alderman Hurt moved to approve the court report for October, seconded by October, Approved Alderman Jones, the vote was: Aye: Aldermen Beazd, Bruns, Super, Jones, Dazata and Hurt. Motion carries. Court Report for Alderman Dazata moved to approve the court report for October, seconded by November, Approved Alderman Hurt, the vote was: Aye: Aldermen Bruns, Super, Jones, Darata, Beazd and Hurt. Motion carries. Mayor's comment Mayor Rose said Argosy was awazded "business of the yeaz" by the Chamber. Mayor Rose had a conversation with the Platte County Mayor's Council, Platte County Commission, Wayside Waif s and they will be a meeting in January to discuss an animal shelter. Mayor Rose said she attended a Public Hearing at the NKC Community Center regazding a smoking ban. She said everyone there owned a bar or restaurant. Everyone there was against taking smoking out of bars and restaurants. There is a calendaz that North Kansas City gave the Mayor for residents of anyone who wants it with the Riverside race track pictures in it. Bill No. 2006-168 Alderman Beazd moved to place Bill No. 2006-168 on its first reading, Payment of said Bill authorizing the payment of certain indebtedness listed therein, Indebtedness seconded by Alderman Darata, the vote was: Aye: Aldermen Darata, Beard, Bruns, Jones, Hurt and Super. Motion carries. Ordinance No. 2006-168 Alderman Dazata moved to place Bill No. 2006-168 on its second reading, Approved and upon passage of same become Ordinance No. 2006-168, seconded by Alderman Jones, the vote was: Aye: Aldermen Bruns, Super, Jones, Darata, Hurt and Beard. Motion carries. Bill No. 2006-169 Alderman Jones moved to place Bill No. 2006-169 on its fast reading, said Bill Employing Sazah authorizing the City of Riverside, Missouri to employ Sarah Thompson as an Thompson as an Intern for the Administration Department for the City of Riverside, Missouri Intern and the salary for this position be set at $10.00 per hour with no benefits. The the employment dates will be January 2, 2007 through June 15, 2007, seconded by Alderman Beard, the vote was: Aye: Aldermen Darata, Bruns, Hurt, Super, Jones and Beazd. Motion carries. Ordinance No. 2006-169 Alderman Darata moved to place Bill No. 2006-169 on its second reading, Approved and upon passage of same become Ordinance No. 2006-169, seconded by Alderman Hurt, the vote was: Aye: Aldermen Bruns, Hurt, Super, Jones, Dazata and Beard. Motion carries. Bill No. 2006-170 Alderman Beazd moved to place Bill No. 2006-170 on its fast reading, said Bill Repealing "Title N" repealing "Title IV: Land Use" of the Municipal Code of the City of Riverside, Missouri, and replacing it with a Unified Development Ordinance (UDO), seconded by Alderman Hurt, the vote was: Aye: Aldermen Dazata, Bruns, Hurt, Beard, Jones and Super. Motion carries. Ordinance No. 2006-170 Alderman Jones moved to place Bill No. 2006-170 on its second reading, Approved and upon passage of same become Ordinance No. 2006-170, seconded by Alderman Dazata, the vote was: Aye: Aldermen Bruns, Hurt, Super, Jones, Dazata and Beard. Motion carries. Bill No. 2006-171 Alderman Jones moved to place Bill No. 2006-171 on its first reading, said Bill Approving Amends. Approving Amendments to the Personnel Policies of the City of Riverside, to the Personnel Missouri, seconded by Alderman Beard, the vote was: Policies Aye: Aldermen Jones, Dazata, beazd, Super, Hurt and Bruns. Motion carries. Ordinance No. 2006-171 Alderman Dazata moved to place Bill No. 2006-171 on its second reading, Approved and upon passage of same become Ordinance No. 2006-171, seconded by Alderman Super, the vote was: Aye: Aldermen Bruns, Hurt, Super, Jones, Darata and Beard. Motion carries.
