J� AN ORDINANCE APPROVING THE FINAL PLAT OF THE REPLAT OF LOTS 62 & 63, MONTEBELLA FIRST IN THE CITY OF RIVERSIDE, PLATTE COUNTY, MISSOURI WHEREAS, Application No. PC14-12, submitted by North River Holdings LLC requesting approval of the Final Plat of the REPLAT OF LOTS 62 & 63, MONTEBELLA FIRST PALT, in the City of Riverside, Platte County, Missouri, was referred to the Planning Commission; and WHEREAS, the Planning Commission considered the application on July 10, 2014 and rendered a report to the Board of Aldermen recommending that the final plat be approved; and WHEREAS, that it is in the best interest of the City of Riverside, Missouri to approve the Final Plat of the REPLAT OF LOTS 62 & 63, MONTEBELLA FIRST PALT as set forth herein; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1 —APPROVAL OF FINAL PLAT. That the Final Plat of of the REPLAT OF LOTS 62 & 63, MONTEBELLA FIRST PALT in the City of Riverside, Platte County, Missouri, a true and correct copy of which is attached hereto and incorporated herein, is hereby approved, platting the property legally described in Exhibit "A". SECTION 2 -ACCEPTANCE OF DEDICATION. That the City of Riverside hereby further accepts the dedication of all streets, municipal uses, easement, access, and utilities shown on the plat, not heretofore dedicated to the public for the purpose(s) as therein set out. SECTION 3— REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 4—SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 5— EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval. Chair Al Bowman called the meeting to order at 6:30 p.m. Answering roll call were Al Bowman,Ray Uhl,Harold Snoderley,Stephen King,and Steven Kaspar. Also present:Jackie Carlson City Planner, Keith Payne,Fire Marshall,and Community Development Assistant Sarah Wagner. Members absent were Mike Lombardo,Jim Frakes, Mike Soler,Art Homer and Mayor Kathy Rose. Approval of Minutes of Commissioner Snoderley moved to approve the minutes of June June 26,2014 26, 2014, seconded by Commissioner Uhl. Motion passed 5-0. Replat-Lots 62&63 Sarah Wagner gave the staff report. She explained that the Montebella applicant,North River Holdings, is requesting approval of a replat for Lots 62&63 in Montebella. This request is similar to one the Planning Commission heard in December. Due to soil conditions the applicant is requesting that the east lot line of Lot 63 be moved three feet to the east to accommodate new construction. By doing so, both Lots 62&63 will still meet all setback requirements. Commissioner Kaspar moved to recommend approval of the replat of Lots 62 & 63 Montebella to the Board of Aldermen, seconded by Commissioner King. Motion passed 5-0. Commissioner Uhl moved to adjourn at 6:34 p.m. Adjourn Commissioner Snoderley seconded and the meeting was adjourn 5-0. Sarah agner Community Development 1 CITY OF City of Riverside RIVER�S1� Staff Analysis Report MISSOURI Case # PC 14-12 Replat of Lots 62 & 63, Montebella First Plat (Modifications to previously approved plat) General Information Applicant:North River Holdings, LLC Location: Lots 62 & 63 (4427 & 4431 NW Sienna Ridge) Application: Replat of Lots 62& 63 of Montebella First Plat(modification to previously approved plat) Current Zoning: PD-Planned Development Existing Land Use: Undeveloped Proposed Land Use: Single Family Homes Site Area: 26,901 sq.ft. Lot Size: Current Proposed Lot 62 15,318.49 sq. ft. 14,848 sq. ft. Lot 63 11,582.51 sq. ft. 12,053 sq. ft. Procedure: The plat will be reviewed by the Commission and the Board of Aldermen. Analysis Overview: North River Holdings, LLC is developing the Montebella Subdivision just north of Highway 9 and west of Northwood Road. The applicant is requesting that the eastern lot line for Lot 63 be moved 3 feet to the east to accommodate the construction of a new single family home. It was determined that a portion of the soil on Lot 63 was unsuitable for construction. In order to accommodate the new construction the lot line needs to be moved. While this does make Lot 62 slightly smaller it still meets the required minimum lots size and will be able to accommodate city standards for minimum square footage and setbacks. Site Layout: The land included in the plat will be developed into single family housing and does not require any new right-of-way or easements. All roads and utilities to the site have been installed. Conformance to Comprehensive Master Plan: The modified plat and proposed use is in conformance with the Comprehensive Master Plan as the plan identifies the area for single family homes.
