MINUTES OF REGULAR MEETING OF THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI FEBRUARY 26, 1985 A regular meeting of the Board of Aldermen of the City of Riverside, Missouri was held in the City Hall in Riverside, on February 26, 1985, at 7:30 p.m. On a roll call, Aldermen Karr, Gordy, Best, Peeler, Wedua and Brenner were present, said meeting was called to order by Mayor Holmes. It was decided to dispense with the reading of the minutes of February 5 and 19, 1985, at the present time. Roland A. Mayotte, Route #5, Box 95A Liberty, M0. presented a Business License application for May Yachts, Inc. which is for manufacturing of power- boats at 4125 N.W. Riverside (Old Structo Building). This application was approved subject to the inspection of the building by the Public Safety Department for fire safety and the payment of the fee. Rick Turner, 6520 Melody Lane, Parkville, M0, presented Change of Use Application, and Business License Application for Mobil-Crete at 3200 N.W. Vivion road. He also presented a plot plan for his property at this location. He said he would use the present building as an office, that he would have a stock pile of gravel and sand and that the cement would be in the portable silo which he plans to move from his present place of business. He said there would be no dust from the mixing of the sand, gravel and cement, since it would be mixed in his truck. He also said he has only one truck that he uses `-~ in this business. Mr. & Mrs. Webb, 3003 N.W. Oak Crest Drive, Kansas City, MO and Mr. Norman Springer 6139 N.W. Wales, Kansas City, MO were present to express their interest in Mr. Turner's business. Their main concern was whether or not it would cause dust to blow across Vivion Road and on to Windemere Boarding Home. Mr. Turner assured these people as well as the Council that this would not cause a dust problem, and if it did cause dust,. he would correct the situation. It was brought out by City Attorney Don Witt that Mr. Turner would need a Special Use permit, which would have to go through the Planning Commission. This matter was discussed further and Mr. Turner is to go to the Planning Commission with his Special Use Permit. Mr. and Mrs. Webb and Mr. Springer said the only thing they are concerned about is the dust it may cause, and Mr. Turner again said that there would be no dust, and there is any, he will correct the situation. Mayor Holmes said the next subject on the agenda would ~ the the Sale of Used Vehicles proposed ordinance. He explained >, to the group of people why the proposed ordinance was initiated, and that it has been on two readings, however, he said that Reg. Meetingg Page 2, 2-26-85 he would be interested in knowing what the Used Car Sales People thought about .the proposed ordinance. and would welcome sugges- tions. Most of the regulations were geared to mostly effect the new car sales people coming into the City. Donald Meyers spoke and thought the ordinance would not be workable and he was opposed to Sections 6, 7, 8, 9, 10, 11, 12, 13 and 16. Mrs. Mary Campbell, -spoke and said she also was opposed to literally the same things that Mr. Meyers was opposed to - she disagreed with that portion pertaining to rest rooms, and no larger than 3/4 pick-ups. Thomas Simms, 1904 N.E. 76th Street, Gladstone, said that sometime there are cars that look like Junkers and can pass inspection, and also the State of Kansas does not have the inspection of vehicles before obtaining State License. Jim Franklin, 4400 N.W. Gateway, felt that this would probably run the Used Car Sales out of the City and he felt that if there is a problem with Used Car Dealers now, that the City should give the Car Dealers a chance to work on this matter, find out what is most objectionable and work with the city. ~"' Mr. McKibbin, 3925 N.E. 59th Terrace of K&M Motors was opposed to Sectins 9, 10, 11, and 12. He said he has at times traded for boats, motor homes, recreational vehicles, etc. and thought the 3/4-ton pickups was not fare. Richard Enloe, 3611 N. Walnut, K.C., M0. brought up the matter that if they cannot- trade in for cars, the people will go elsewhere - places that will take their cars as trade-ins. IG:'was suggested that the Used Car Sales, people get to- gether and .discuss the proposed ordinance and come back by the second meeting in March, (19th) with something they have agreed upon and that will be workable with the City, and this was agreed to by the Use Car Sales People. Chuck Isley, 6003 N. Monroe, Gladstone, Mo. said he had heard that the-City was planning to pass an ordinace regulating roller skating rinks. He said he didn't know if it was going to to be on the agenda, but would like to discuss certain restric- tions the ordinance would put on the rinks. The Mayor explained that this was not going to be on the agenda tonight, since he and the Aldermen had just received a copy of the proposed ordinance and had no chance ~ to read it. ,` ~~ ~. Meeting Page 3, Feb. 26, 1985 Mr. Isley said he would like to try to work with the Mayor and Board on regulating the skating rinks and wanted to find out whether or not there have been problems. It was then brought out that some of the people in the apartment complex did have problems with the noise at the early morning hours and also there has been lots of litter. The Public Safety Department was concerned of a possible fire hazard when they have such large crowds. .There were several people if favor of the skating rink. Mrs. Ron Gordy spoke in favor of the skating rink and brought out the favorable things Mr. Isley has done in working .with the children at the rink.' in the audience speaking The proposed Skating Rink Ordinance was discussed and it was decided to see if Mr. Isley could get with the Public Safety people and the Mayor and Board and come up with something everyone could agree to. Concerning the Renner Estate Property which the City's bid was accepted, it was brought out that the property would have. to be surveyed and that concerning the Memorial Plaque, the heirs would like to approve the wording on said plaque. ~~~ Karr moved that Bill No. 85-11 being bill authorizing the Mayor to execute a contract with the Executor of the Carolina Renner Estate in-the sum of .$20,000 as per Exhibit "A" attached thereto, be placed on its first reading, seconded by Wedua, the roll was called and votes were as follows: Karr, Gordy, Best, Peeler and Wedua voted aye; Brenner abstained, said bill was accordingly read. Best moved that Bill No. 85-11 be placed on its second reading, seconded by Karr, the roll was called and votes were as follows: Karr, Gordy, Best, Peeler and Wedua- voted aye; Brenner abstained, said bill was accordingly read. Wedua moved that Bill No. 85-11 be placed on its third reading and upon passage of same become Ordinance N0. 85- 11, seconded by Karr, the roll was called and votes werea as follows: Karr, Gordy, Best, Peeler and Wedua voted aye; Brenner abstained, said bill was accordingly read, attached hereto and made a .part hereof, approved by Mayor Holmes and became Ordinance N0. 85-i1. The minutes of February 5, 1985 were read and approved as corrected. The minutes of February 19, 1985, were read and approved as corrected. ~. Minutes of Reg. Meeting Page 4 - Feb. 26, 1985 A letter concerning Motor .Cycle Awareness Days was read, the date would be set from April 20 thru-May 20. A discussion was had concerning Peeler getting easements for drainage from Woodland on private property and he would see if this could be done. City Clerk Betty Burch said that Charley Stewart called inquiring for an extension on his building permit. The Mayor and Board agreed to giving Charley Stewart an extention on his buidling permit. There being no further business to comve before the Board, the meeting was, upon motion duly made, seconded and carried, adjourned at 11:55 p.m. ~~~ ~ car. -~ .- ~.
