AN ORDINANCE AUTHORIZING AND APPROVING A SUPPLEMENTAL AGREEMENT TO
THE CONTRACT WITH PATTI BANKS ASSOCIATES, L.L.C., D/B/A VIREO FOR AN
AMOUNT NOT TO EXCEED $5,600.00
WHEREAS, the City of Riverside, Missouri ("City") entered into that certain Professional
Services Agreement with Patti Banks Associates, L.L.C., a Missouri limited liability company
doing business as Vireo ("Vireo') for the Horizons Phase I — Irrigation Project (City Project No.
607-005), dated April 8, 2013, in the original contract amount of Nine Thousand Eight Hundred
Ninety Dollars and No Cents ($9,890.00) ("Vireo Contract'); and
WHEREAS, Vireo requests approval of, and City staff recommend and request the
Board to approve, a supplemental agreement ("Supplemental Agreement') to the Vireo Contract
attached hereto as Attachment A and incorporated herein, for the certification of irrigation
design plans for an amount not to exceed $5,600.00, for a total amount payable to Vireo
pursuant to the Vireo Contract and the Supplemental Agreement of Fifteen Thousand Four
Hundred Ninety Dollars and No Cents ($15,490.00); and
WHEREAS, the Board of Aldermen find that the Supplemental Agreement to the Vireo
Contract is in the best interest of the City in that such action fulfills a public purpose and will
further the growth of the City, facilitate the development of the entire Horizons site, improve the
environment of the City, foster increased economic activity within the City, increase employment
opportunities within the City and otherwise is in the best interests of the City by furthering the
health, safety, and welfare of its residents and taxpayers.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
SECTION 1. BEST INTEREST OF THE CITY TO APPROVE SUPPLEMENTAL
AGREEMENT. Vireo requests approval of, and City staff recommend and request the Board to
approve, the Supplemental Agreement to the Vireo Contract, attached hereto as Attachment A
and incorporated herein, and the Board finds it is in the best interest of the City and that such
approval fulfills a public purpose and will further the growth of the City, facilitate the
development of the entire Horizons site, improve the environment of the City, foster increased
economic activity within the City, increase employment opportunities within the City and
otherwise is in the best interests of the City by furthering the health, safety, and welfare of its
residents and taxpayers, to approve the Supplemental Agreement, and the Board does hereby
approve of the Supplemental Agreement in an amount not to exceed $5,600.00, for a total
amount payable to Vireo pursuant to the Vireo Contract and the Supplemental Agreement of
Fifteen Thousand Four Hundred Ninety Dollars and No Cents ($15,490.00).
SECTION 2. AUTHORITY TO EXECUTE. The Mayor, City Administrator and all other
required city officials are authorized to execute the Supplemental Agreement authorized herein,
together with any and all documents necessary or incidental to the performance thereof, and to
take such other actions and/or execute and deliver for and on behalf of the City all certificates,
instruments, agreements and other documents as may be deemed necessary or convenient to
carry out and comply with the intent of this Ordinance.

SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full force and effect from
and after the date of its passage and approval.
BE IT REMEMBERED that the above was PASSED AND APPROVED by a majority of
the Board of Aldermen, and APPROVED by the Mayor of the City of Riverside, Missouri, this
18'" day of September, 2014.

Horizons Phase I — Irrigation (607-005)
BACKGROUND: The Professional Services Agreement dated April 8, 2013 between Vireo and the
City of Riverside included the design and plans preparation for the Horizons
Irrigation Project. Change Order I consists of an addition to the Agreement for
certification of the Irrigation design plans.
BUDGETARY IMPACT: The certification will be an additional $5,600 to the agreement with Vireo.
Approximately $15,490.00 will be expended out of the Horizons Phase I —
Irrigation for the design and certification under this contract.

RECOMMENDATION: Staff recommends approval of the ordinance and acceptance of the change order
with Vireo for Horizons Phase I — Irrigation.

FOR
LANDSCAPE ARCHITECTURAL SERVICES
The City of Riverside('RIVERSIDE"), has solicited the services of Patti Banks Associates d.b.a Vireo
("VIREO"),to perform professional consulting services in connection with the Riverside Horizons
Development project This AGREEMENT shall consist of the Scope of Services as detailed below,and the
attached General Provisions.
SCOPE OF SERVICES
Vireo will perform project administration services during the construction phase of the project. By performing
these services,Vireo shall not have authority or responsibility to supervise,direct,or control the Contractor's
work or the Contractor's means,methods,techniques,sequences,or procedures of construction. Vireo shall not
have authority or responsibility for safety precautions and programs incident to the Contractor's work or for any
failure of the Contractor to comply with laws,regulations,rules,ordinances,codes,or orders applicable to the
Contractor furnishing and performing the work. Specific services to be performed by Vireo are as follows:
. Perform site visits to observe irrigation installation activities and prepare observation reports(4 total)
• Verify general completion of irrigation work is consistent with the requirements of the plans and specifications.
• Review shop drawings and other applicable submittals
• Complete and prepare documentation(ASI's,Proposal Requests,etc.)for irrigation related items
• Complete(1)punch qst review
FEE
The scope of services shall be completed under this authorization for an houdy-not-to-exceed fee of
5 600. RIVERSIDE shall compensate VIREO for these services,based upon hourly rates. The current
houdy rate schedule is attached.
