HomeMy WebLinkAbout2005-01-18Minutes of Regular Meeting of Boazd of Aldermen of City of Riverside, Missouri January 18, 2005 A regulaz meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, January 18, 2005 at 7:30 p.m Beard. Those in attendance were Mayor Burch, Aldermen Bums, Darata, Looker, Legaard, Super, and Also present were, David Blackburn, City Administrator, Louise Rusick, City Clerk, Brent Miles, Planning, Zoning and Community Development Coordinator, John Jackson, City Engineer, John McClelland and Ben Prell, City Attorney's office. Minutes, December 21 s~, Alderman Burns moved to approve the minutes December 21st as corrected, Approved seconded by Alderman Legaazd, the vote was: Aye: Aldermen Looker, Super, Legaazd, Beard, Darata and Burns. Motion carries. Public Hearing Opened Alderman Beard opened the Public Hearing at 7:34 p.m to consider amending Riverside Municipal Code Section 440.110 pertaining to "Hotels in the Vicinity of a Commercial Vessel, seconded by Alderman Darata, the vote was: Aye: Aldermen Bums, Dazata, Super, Legaard, Beard and Looker. Motion carries. Public Hearing Alderman Legaard moved to close the Public Hearing, seconded by closed at 7:37 p.m. Alderman Dazata, the vote was: Aye: Aldermen Darata, Super, Legaard, Beazd, Looker and Bums. Motion carries. Comments Brent said 3,060 pazking spaces are planned with 92 spaces ADA. Brent said staff recommends approval, contingent upon COE approval with work within the Levee Critical Zone, as well as comments from GBA regazding the technical review. Alderman Bums asked why the height was being changed. Brent said for future hotels, as the code presently reads "buildings or structures shall not exceed sixty (60) feet in height or five stories" and these code revisions could benefit the city. Alderman Super asked about the layout plans for the hotel and Brent said they aze "double loaded" with front views. Mayor Burch asked if the Fire Code had been checked for this, Brent said "Yes". Alderman Looker said the fire issues were discussed in length ' at the last Planning and Zoning meeting. Alderman Looker asked if there is a Mins. 1/18/05 fire, "Does the Fire Department have the capability to draft water from the Missouri River?" Mayor Burch said, "No", this request would have to me made through the Levee District. Public Hearing Opened Alderman Looker moved to open the Public Hearing at 7:50 p.m. to consider a request fora "Special Use Permit" for "hotels in the Vicinity of a Commercial Vessel" as described in Riverside Municipal Code Section 440.110, seconded by Alderman Dazata, the vote was: Aye: Aldermen Dazata, Super, Legaard, Beard, Burns and Looker. Motion carries. Public Hearing Closed Alderman Legaazd moved to close the Public Hearing at 7:51 p.m, seconded by Alderman Darata, the vote was: Aye: Aldermen Super, Legaazd, Beard, Burris, Looker and Darata. Motion carries. Special Use Permit Alderman Beard moved to approve a Special Use Permit for "Hotels in the Approved Vicinity of a Commercial Vessel" as, described in Riverside Municipal Code Section 440.110, seconded by Alderman Dazata, the vote was: Aye: Aldermen Looker, Dazata, Beard, Burris, Super and Legaazd. Motion carries. Development and Alderman Looker moved to approve the Development and Site Plan for Argosy Site Plan for Argosy Casino-777 NW Argosy Parkway, seconded by Alderman Burris, the vote was: Approved Aye: Aldermen Legaard, Beazd, Burris, Looker, Darata and Super. Motion carries. Change of Use Permit Alderman Darata moved to approve a Change of Use Permit for the for Missouri Gaming Missouri Gaming Company located at 224 NW Business Park Lane and in Approved which training occurs for the Argosy Casino regazding gaming activities, seconded by Alderman Legaazd, the vote was: Aye: Aldermen Darata, Super, Legaard, Beard, Bums and Looker. Motion carries. Aristocrat Homes Alderman Looker moved to table the request for a building permit for Aristocrat Building Permit, Homes, 5123 NW Gower Court until the February 2°d boazd meeting, seconded 5123 NW Gower Ct., by Alderman Legaazd, the vote was: Tabled Aye: Aldermen Beard, Looker, Burris, Dazata, Super and Legaazd. Motion carries. Minn. 1/18/05 Aristocrat Homes Alderman Beazd moved to approve a building permit for Aristocrat Homes, Building Permit 5122 NW Gower Court (Lot 48) Brenner's Ridge, seconded by Alderman for 5122 NW Gower Ct Dazata, the vote was: Approved Aye: Aldermen Looker, Burris, Darata, Super, Legaazd and Beazd. Motion carries. Twin Traffic Mazking Alderman Looker moved to approve Twin Traffic Mazking for " Bid Approved the upper NW Gateway left turn arrow marking at a cost of $1,920, seconded by Alderman Beard, the vote was: Aye: Aldermen Looker, Bums, Dazata, Super, Beazd and Legaazd. Motion carries. Lany's Nursery John presented the boazd with amemo/analysis from Todd Thalmann, 2501 NW Platte Rd TranSystems Inc., explaining Mr. Tsevis's recent concern about access Discussion to his property, Larry's Nursery, 2501 NW Platte Road. Mr. Thalmann's recommendation is not to build a second entrance. Alderman Looker asked if there was any discussion with Larry Tsevis, John said "No". Second entrance for Alderman Bums moved to not approve building a second entrance to Larry's Larry's Nursery, Nursery, 2501 NW Platte Road, seconded by Alderman Super, the vote was: 2501 NW Platte Rd not Approved Aye: Aldermen Looker, Bums, Dazata, Super, Beazd and Legaazd. Motion carries. Flood Staff Gage The gage determines when to close the floodgate. Discussion Mounting a Flood Alderman Beard moved to approve the Quindazo Bend's Levee Commission Gage on the left request to mount a flood staff gage on the left bank downstream pier of the left bank downstream Argosy Parkway Bridge over Line Creek, seconded by Alderman Burris, pier of the Argosy Pky the vote was: Bridge over Line Creek Approved Aye: Aldermen Super, Legaard, Beazd, Looker, Darata and Burris. Motion carries. NW Gateway (middle) John reported to the boazd there are 9-10 sets of plans out to bidders for the bid opening discussion (middle) NW Gateway project. Bid opening is February 1" at 10:00 a.m and at 2:00 p.m. there is a bid opening for material testing contract here at City Hall. Three copies of all bids are sent to MoDot for their review, this will take about 9-10 days, and then all information comes back to the boazd of aldermen for their approval. Hopefully, the contracts and notice to proceed will be ready by Mazch 1". The federal government's matching funds apply to north of Line Creek. There are no matching funds for the south side of Line Creek. John said the Missouri American Water Company has agreed to locate their mains. Mins. 1/18/OS Mayor Burch asked, "Where are we going to start?" John said, "We won't know until the contractor has been chosen." Alderman Super asked, "Are the acceptance of bids only on the MoDot approved list?" John said, "Yes." Alderman Super requested John to obtain in writing, with confirmation the bidders and ground rules. Alderman Beazd asked about the stop log gap on Argosy Pazkway. John said he will refer this to the Corps of Engineers. Edward W. Truitt Alderman Beazd moved to approve Edward W. Truitt's appointment as a Approved as a volunteer firefighter for the City of Riverside with a start date of January 1,2005 volunteer firefighter seconded by Alderman Looker, the vote was: Aye: Aldermen Beard, Dazata, Looker, Bums, Super and Legaard. Motion carnes. Kevin Wattenbazger's Alderman Super moved to accept Kevin Wattenbazger's resignation resignation from the city as a volunteer fire fighter, seconded by Alderman Bums, Approved the vote was: Aye: Aldermen Dazata, Looker, Bums, Super, Legaard and Beard. Motion carries. MARC Solid Waste Alderman Super moved to accept the re-appointment of Gloria re-appointment of Hickman as a representative to the MARC Management Council Gloria Hickman & Representative for the Solid Waste Management District for two years Kathy Rose and Kathy Rose as the alternate, seconded by Alderman Dazata, the as Mgmt. Council vote was: District, Approved Aye: Aldermen Legaazd, Burns, Beazd, Super, Looker and Dazata. Motion carries. Payment of Bills Alderman Beard asked if the contractor's final estimates are being paid Discussion in this Bill Pay Ordinance. John said, "Yes." Any problems we have with contractors now are being worked out with the wazranty. Bill No. 2005-04 Alderman Looker moved to place Bill No. 2005-04 on its first reading, Payment of said Bill authorizing the payment of certain indebtedness listed therein, Indebtedness seconded by Alderman Darata, the vote was: Aye: Aldermen, Beazd, Looker, Bums, Super, Darata and Legaard. Motion carries. Ordinance No. 2005-04 Alderman Legaard moved to place Bill No. 2005-04 on its second reading, Approved and upon passage of same become Ordinance No. 2005-04, seconded by Alderman Looker, the vote was: Aye: Aldermen Darata, Super, Beard, Bums, Looker and Legaazd. Motion carnes. Mins. 1/18/OS 4 Bill No. 2005-OS Alderman Looker moved to place Bill No. 2005-OS on its first reading, said Ord. amend. Title V, Bill amending Title V, Chapter 500 of the Municipal Code of the City of Chapter 500 of the Riverside, Missouri, by amending provisions regarding the adoption of Municipal Code of building and construction codes, seconded by Alderman Beard, the vote was: the City of Riverside, Missouri, by amending Aye: Aldermen Bums, Dazata, Legaazd, Beazd and Looker. Provisions regazding the Abstain: Alderman Super. adoption of building & construction codes Motion carries. Ordinance No. 2005-OS Alderman Legaazd moved to place Bill No. 2005-OS on its second reading, Approved and upon passage of same become Ordinance No. 2005-05, seconded by Alderman Looker, the vote was: Aye: Aldermen Darata, Beard, Burris, Looker and Legaard. Abstain: Alderman Super. Motion carries. Aldermen comments Alderman Bums said when you're driving on NW Valley Lane and hit the manhole, it rattles. John said it is cracked and would be taken caze of. Recess A brief recess was called at 8:35 p.m. Reconvene The Mayor and all Board members answered to roll call. Motion for Closed Alderman Darata moved that the meeting go into closed session, pursuant to Session RSMo 610.021(1) for discussion of Legal Issues and RSMo 610.021(2) Real Estate with the City Attorney, seconded by Alderman Legaard, and the vote was: Aldermen Beard, Darata, Burris, Super, Looker and Legaazd. Motion carries. Motion for Open Alderman Rochelle moved that the meeting go into open session at Session seconded by Alderman Dazata, and the vote was: Aye: Alderman Burris, Looker, Darata, Legaazd, Beazd and Super. Motion Carries. Adjournment By unanimous decision the meeting adjourned at 9:33 City Clerk
