AN ORDINANCE AMENDING CITY CODE CHAPTER 205 RELATED TO FEEDING OF
DEER.
WHEREAS, the City of Riverside has within its limits urban deer in such numbers that
they are a threat to the safety of people and property; and
WHEREAS, it is appropriate to prohibit the aggravation of this problem by prohibiting
the feeding of deer so as not to actively encourage their presence.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN FOR THE
CITY OF RIVERSIDE, MISSOURI, as follows:
SECTION 1 —ADOPTION OF AMENDMENT. Section 205.125 of the City Code of the City
of Riverside, Missouri is hereby added to read as follows:
A. Definitions. The following words, terms and phrases, when used in this
Section, shall have the meanings ascribed to them in this Section, except where
the context clearly indicates a different meaning:
DEER - Any of various hoofed ruminant mammals of the family Cervidae,
characteristically having deciduous antlers borne chiefly by the males. The deer
family includes the white-tailed deer, elk, moose, and caribou.
FEED OR FEEDING - The intentional act of furnishing or otherwise making
available food or other substance which is likely to be consumed by deer.
NATURAL - Food or other substances consumed by deer, produced by or
existing in nature, not artificial.
B. Prohibition of Feeding. No owner or occupier of land within the City of
Riverside, Missouri, shall intentionally feed, cause to be fed or provide or make
available food or other substances for the consumption by deer within the City,
either on private property or on public property.
C. Exception.
1. This Section shall not apply to any item that can be used as food if its
source in nature is native to the subject premises on which the food is
available. For example, by way of illustration only, this Section shall not
apply to apples or acorns generated from an apple tree or oak/acorn tree
located upon the subject premises or carrots and corn grown in a garden
located upon the subject premises.
2. A property of ten (10) acres or more shall be exempt from this Section and
shall follow the current applicable rules of the Missouri Conservation
Department pertaining to the feeding and baiting of deer.
3. This Section does not apply to naturally growing vegetation, or to planted
vegetation growing in yards, gardens, or flower beds; or bird feeders.
SECTION 2 — EFFECTIVE DATE. This ordinance shall be in full force and effect from and
after the date of its passage and approval.
BE IT REMBERED that the above was read two times by heading only, PASSED AND
APPROVED by a majority of the card of Aldermen and APPROVED by the Mayor of the
