HomeMy WebLinkAbout2014-11-04 Regular Meeting MINUTES REGULAR MEETING BOARD OF ALDERMEN RIVERSIDE, MISSOURI Tuesday, November 4, 2014 6:30 p.m. The Board of Aldermen for the City of Riverside, Missouri, met in regular session in the Board of Aldermen Chambers at City Hall, 2950 NW Vivion Road, Riverside, Missouri, on Tuesday, November 4, 2014. Mayor Rose called the regular meeting to order at 6:30 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Ron Super, Art Homer, Brad Cope, Chet Pruett, and Mike Fuller. Alderman Aaron Thatcher was absent. Also present were City Administrator Greg Mills, City Attorney Paul Campo, City Clerk Robin Littrell, Community Development Director Mike Duffy, Community Development Assistant Sarah Wagner, City Engineer Travis Hoover, Fire Chief Gordon Fowlston, Police Captain Mike Costanzo, and Administration Director Meredith Hauck. MOTION TO ENTER INTO Alderman Cope moved that the meeting go into closed CLOSED @ 5:37 P.M. session pursuant to RSMo 610.021 (1) Legal Action and litigation, RSMo 610.021(2) Leasing, purchase or sale of real estate, RSMO 610.021 (3) Hiring, firing, disciplining or promoting a particular employee when personal information about the employee is discussed, and RSMo 610.021(12) Sealed bids and related documents, until the bids are opened; and sealed proposals and related documents or any documents related to a negotiated contract until a contract is executed, or all proposals are rejected second by Alderman Homer. Yes: Cope, Homer, Super, Pruett, and Fuller. Motion carried 5-0. MOTION TO ADJOURN Alderman Homer moved at 6:53 p.m. to adjourn closed CLOSED @ 5:53 P.M. session with action taken, second by Alderman Pruett. Yes: Homer, Pruett, Cope, Super, and Fuller. Motion carried 5-0. REGULAR SESSION Mayor Rose called the Regular Session Meeting to order at 7:02 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Art Homer, Mike Fuller, Brad Cope, Chet Pruett, and Ron Super. Alderman Aaron Thatcher was absent. Also present were City Administrator Greg Mills, City Attorney Paul Campo, City Clerk Robin Littrell, Public Works Director Tom Wooddell, Community Development Director Mike Duffy, Community Development Assistant Sarah Wagner, City Engineer Travis Hoover, City Planner 1 Jackie Carlson, Finance Director Donna Oliver, Fire Chief Gordon Fowlston, Administration Director Meredith Hauck, and Police Captain Mike Costanzo. PLEDGE OF ALLEGIANCE Mayor Rose led the Pledge of Allegiance. PUBLIC COMMENT None. PRESENTATION Representative Craig Hill presented the Riverside Police Department with a plaque for their initiative to obtain certification and implementation of the program with the National Center for Missing and Exploited Children. The first 911 Center and Police Department combined to achieve this certification in the State of Missouri. Mr. Hill presented the plaque to Captain Mike Costanzo. AUDITOR'S REPORT Chelsea Forge with McGladrey, LLC reviewed audit highlights with the Board of Alderman. Copies of the 2014 Audit Report were given to each alderman to view. CONSENT AGENDA Alderman Cope moved to approve the consent agenda as presented, second by Alderman Homer. Yes: Cope, Homer, Pruett, Fuller, and Super. Motion carried 5-0. MINUTES OF 10-22-14 Alderman Cope moved to approve the minutes of the October 22, 2014 meeting, second by Alderman Homer. Yes: Cope, Homer, Pruett, Fuller, and Super. Motion carried 5-0. RESOLUTION 2014-095 Alderman Cope moved to approve Resolution 2014-095 Bill Pay authorizing the expenditure of funds for fiscal year 2014- 2015, for weeks ending October 24`h and October 31 ST in the amount of$132,788.59, second by Alderman Homer. Yes: Cope, Homer, Pruett, Fuller, and Super. Motion carried 5-0. REGULAR AGENDA PUBLIC HEARING @ Mayor Rose opened the public hearing to consider a request for a 7:19 PM Special Use Permit for outdoor storage at the location of 4600 NW 41ST Street, Riverside, Platte County, Missouri. Mayor Rose asked that this public hearing be continued until November 18, 2014. Alderman Fuller moved to continue the public hearing until November 18, 2014, second by Alderman Pruett. Yes: Fuller, Pruett, Super, Homer, and Cope. Motion carried 5-0. PUBLIC HEARING @ Mayor Rose reviewed the opened Public Hearing to consider a 7:25 PM rezoning; preliminary development plan, and preliminary plat for property legally described as: All that part of Lots 1& 2, Partition 2 Plat of the Estate of George Roberts, located in the Southeast '/4, of Section 6, Township 50, Range33, in the City of Riverside, Platte County, Missouri. City Planner Jackie Carlson reviewed the location and actions the Board is considering on the agenda this evening, which include rezoning, planned development, and approval of preliminary and final plat. The Planning Commission recommends approval of the project. Attorney Curtis Hall with Posinelli Law Firm and is here on behalf of BABRA, LLC and the Babcock brothers. He first thanked the staff for the work the city has done for this project. There were display boards out so the Board could see the rendering of the building being proposed. Hall reviewed details of the building and plans for tenants. Mayor Rose thanked the Babcocks for all they have done for Riverside over the years and now for the new building. Mayor Rose asked if there were any other comments for the public hearing and hearing none, she closed the public hearing at 7:30 p.m. BILL NO. 2014-089 City Clerk Robin Littrell gave first reading of Bill No. 2014-089. Rezoning 4106 NW Mattox Rd Alderman Cope moved to accept first reading and place Bill No. 2014-089 on second and final reading, second by Alderman Pruett. Yes: Cope, Pruett, Homer, Super, and Fuller. Motion carried 5-0. Alderman Cope moved to approve Bill 2014-089 and enact said bill as ordinance, second by Alderman Homer. Yes: Cope, Homer, Fuller, Pruett, and Super. Motion carried 5-0. BILL NO.2014-090 City Clerk Robin Littrell gave first reading of Bill No. 2014-090. Preliminary/Final Plat Alderman Cope moved to accept first reading and place Bill No. 2014-090 on second and final reading, second by Alderman Pruett. Yes: Cope, Pruett, Super, Fuller, and Homer. Motion carried 5-0. Alderman Cope moved to approve Bill 2014-090 and enact said bill as ordinance, second by Alderman Super. Yes: Cope, Super, Homer, Fuller, and Pruett. Motion carried 5-0. BILL NO. 2014-091 City Clerk Robin Littrell gave first reading of Bill No. 2014-091. Final Dev. Plan BABRA, LLC Alderman Cope moved to accept first reading and place Bill No. 2014-091 on second and final reading, second by Alderman Pruett. Yes: Cope, Pruett, Fuller, Super, and Homer. Motion carried 5-0. Alderman Cope moved to approve Bill 2014-091 and enact said bill as ordinance, second by Alderman Homer. Yes: Cope, Homer, Super, Pruett, and Fuller. Motion carried 5-0. 3 BILL NO. 2014-094 City Clerk Robin Littrell gave first reading of Bill No. 2014-094. Infrastructure Dev. Agreement Alderman Ron Super inquired about the dollar figure being blank BABRA, LLC on the ordinance, following discussion by Community Development Director Mike Duffy and BABRA Attorney Curtis Hall stated that he and Attorney Bednar have had discussions regarding this figure and understand that if a number needs to be inserted, all parties would be comfortable with "not to exceed $435,000". Alderman Cope moved to accept first reading and place Bill No. 2014-094 as amended "not to exceed $435,000" on second and final reading, second by Alderman Pruett. Yes: Cope, Pruett, Fuller, Super, and Homer. Motion carried 5-0. Alderman Cope moved to approve Bill 2014-094 as amended and enact said bill as ordinance, second by Alderman Super. Yes: Cope, Super, Fuller, Homer, and Pruett. Motion carried 5-0. RESOLUTION 2014-096 City Attorney Paul Campo reviewed the details to gain the public Riverside Townhouses, Inc. access easement for the property with the Riverside Townhouses, Inc. Alderman Cope moved to approve Resolution 2014-096 accepting An easement from Riverside Townhouses, Inc., second by Alderman Pruett. Yes: Cope, Pruett, Homer, Fuller, and Super. Motion carried 5-0. CITY ADMINISTRATOR City Administrator Greg Mills reported research on the deer control within the City and he had a meeting with the Missouri Conservation Department. There is the managed hunt option that many cities participate in, but there are requirements that the Mo. Dept. of Conservation must follow to gather information on numbers to calculate the deer population. There are two sample ordinances in your packet that other cities have adopted. Parkville's ordinance simply states that you cannot feed the deer. The other ordinance is from Lee's Summit and it says that you cannot feed wildlife. Staff would like the Board's direction on this issue. Following discussion, Mills responded that the Missouri Conservation Department will conduct the deer population count this winter and they expect the count to be excessive. Consensus of the Board was to move forward with the Missouri Conservation Department to do the population count first and then bring that back to the Board. ADMINISTRATION Administration Director Meredith Hauck stated that the Tourism Commission currently has their RFP out for 2015 Tourism Projects. Proposals are due November 25'" and the projects that the City will be submitting for consideration; a historical sign the Fairfax Bridge that will be located at the MRT trailhead, additional directional signage for the trail system, funding for the history intern for the summer, and funding for an art's commission. 4 COMMUNITY DEVELOPMENT Nothing to report. ENGINEERING Nothing to report. FINANCE Finance Director Donna Oliver introduced Kelsi Spurgeon with Columbia Capital to further discuss the update and changes of the investment policy. She reviewed details of the revised investment policy with the Board. There will be a resolution at the next board meeting to adopt the revised policy, if the Board has no questions after reviewing the information. Finance Director Resz then passed out information regarding TriStem and discussed their services of utility auditing. During discussion the Board gave general consensus to move forward with bringing a resolution before them at the next meeting to engage TriStem's services. PUBLIC SAFETY Nothing to report. PUBLIC WORKS Nothing to report. LEVEE BOARD Nothing to report. ETC SURVEY Administration Director Meredith Hauck presented a PowerPoint PRESENTATION presentation that reviews the highlights of the 2014 ETC Survey results. The top three priorities are quality of water and sewer services, overall enforcement of codes and ordinances, and effectiveness of community development and planning. Top priorities for Public Safety, Public Works, Code Enforcement, Parks and Recreation, City Communications, Customer Service, and responses from businesses were reviewed. Discussion on future survey responses and length of time between surveys was discussed. The Board asked that the City Administrator consult with them in two years to decide the best opportune time for the next survey to be conducted. MAYOR'S DISCUSSION Mayor Rose said that the Trunk or Treat was a huge success with 350 children attending. It was a beautiful evening, we had great participation from our businesses and it was so much fun! The MRT Trail has reopened. We will have the Town Hall Meeting on Thursday evening at 6 p.m. I will not be able to attend because I have been invited along with several other Mayors to attend a dinner at the Governor's Mansion. Friday I will be attending a MML meeting in Jefferson City as well. November a is the open house for the YMCA at the Community Center. KCP&L has announced that they will be asking for a 15% increase in rates. We also just received an announcement from Mike McMillian that he is leaving Missouri American Water. We are sad to announce that Chris Byrd, Chairman of the Northland Chamber Board, passed away this morning. In December we will be honoring Dr. Michael Arnett, DDS at the Platte County Economic 5 Development Council Award Ceremony that will be given for his Give Back Day when he and his staff offered free dental services for a day. BOARD OF ALDERMEN Alderman Fuller— Nothing to report. Alderman Cope—Congratulations to Donna Oliver for her financial reporting. Alderman Pruett— Nothing to report. Alderman Homer— Nothing to report. Alderman Super— I want to thank Public Safety again for their presence in the Indian Hills area on Halloween. City Administrator Greg Mills stated that the program was started by Captain Mike Costanzo and he continues to shepherd it.
