HomeMy WebLinkAbout1394 CO 6 Gunter Construction Company Horizons Phase 1 Landscape, Signage & Obelisk BILL NO. 2015-020 ORDINANCE NO. 13 9 `i AN ORDINANCE AUTHORIZING AND APPROVING CHANGE ORDER 6 TO THE AGREEMENT BETWEEN NORTHPOINT DEVELOPMENT, LLC AND GUNTER CONSTRUCTION COMPANY, RESULTING IN AN APPROVED REVISED CONTRACT AMOUNT OF $375,814.71 WHEREAS, by and through Ordinance No. 1177, the City approved an Agreement between Northpoint Development, LLC ("Northpoint') and Gunter Construction Company ("Gunter') for completion of certain public infrastructure improvements known as Horizons Phase I Landscape, Signage & Obelisk Project (City Project No. 607-004) for an estimated cost of installation and construction of Three Hundred Seventy-Two Thousand Eight Hundred Twenty-Three Dollars and Fifty Cents ($372,823.50) (the "Gunter Contract'); and WHEREAS, the Board has previously approved Change Orders 1-5 to the Gunter Contract resulting in a revised contract amount of Four Hundred Four Thousand One Hundred Eighty-Two Dollars and Fifty Cents ($404,182.50); and WHEREAS, Northpoint and Gunter request approval of, and City staff recommend and request the Board to approve, Change Order 6 to the Gunter Contract, attached hereto as Attachment A and incorporated herein: Change Order 6: a) Deduct for reduced hydroseed, resulting in a decrease in the overall contract total of($8,666.00); and b) Deduct for reduced PB - Bloodgood London Plane Trees, resulting in a decrease in the overall contract total of($2,130.00); and C) Deduct for reduced PA — Exclamation London Plane Trees, resulting in a decrease in the overall contract total of($10,200.00); and d) Deduct for reduced AF— Sienna Glen Freeman Maple, resulting in a decrease in the overall contract total of($1,875.00); and e) Deduct for removal from contract of all MR — Royal Raindrops Crab Apple, resulting in a decrease in the overall contract total of($2,350.00); and f) Deduct for removal from contract of all PP —Colorado Blue Spruce, resulting in a decrease in the overall contract total of ($1,200.00); and g) Deduct for reduced SI — Ivory Silk Japanese Tree Lilac, resulting in a decrease in the overall contract total of ($560.00); and h) Deduct for reduced CK — Karl Foerster Feather Reed Grass, resulting in a decrease in the overall contract total of($1,650.75); and i) Deduct for reduced JS — Arcadia Savin Juniper, resulting in a decrease in the overall contract total of ($5,372.00); and j) Deduct for removal from contract of all RG — Grow Low Fragrant Sumac, resulting in a decrease in the overall contract total of($7,486.00); and k) Overrun of mulch (117 cubic yards installed instead of 111), resulting in an increase in the overall contract total of$300.00; and WA 6732621.1 BILL NO. 2015-020 ORDINANCE NO. /39 q 1) Miscellaneous final changes to contract extension, resulting in an increase in the overall contract total of$5,980.00; and m) Unusable stored trees, resulting in an increase in the overall contract total of $6,841.86; and n) Typo on CK — Karl Foerster Feather Reed Grass, resulting in an increase in the overall contract total of$.10 For a total net cost decrease pursuant to Change Order 6 of Twenty-Eight Thousand Three Hundred Sixty-Seven Dollars and Seventy-Nine Cents ($28,367.79) to decrease the overall contract total to Three Hundred Seventy-Five Thousand Eight Hundred Fourteen Dollars and Seventy-One Cents ($375,814.71); and WHEREAS, pursuant to Sections 5.5 and 5.6 of that certain Master Development Agreement ("MDA") by and between Briarcliff Realty, LLC and the City dated May 10, 2011, any change orders to the Infrastructure Construction Documents, which includes the Gunter Contract, must be approved by the City in order to be effective; and WHEREAS, the Board of Aldermen find that Change Order 6 to the Gunter Contract is in the best interest of the City in that such action fulfills a public purpose and will further the growth of the City, facilitate the development of the entire Horizons site, improve the environment of the City, foster increased economic activity within the City, increase employment opportunities within the City and otherwise be in the best interests of the City by furthering the health, safety, and welfare of its residents and taxpayers. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1. BEST INTEREST OF THE CITY TO APPROVE CHANGE ORDER. SECTION 2. AUTHORITY TO EXECUTE. The Mayor, City Administrator and all other required city officials are authorized to execute the change order authorized herein together with any and all documents necessary or incidental to the performance thereof and to take such other actions and/or execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance. SECTION 3. SEVERABILITY CLAUSE. The provisions of this Ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this Ordinance. SECTION 4. EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after the date of its passage and approval.
