HomeMy WebLinkAbout2005-04-12 Special.~ Minutes of Special Meeting of Boazd of Aldermen of City of Riverside, Missouri April 12, 2005 A special meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, on Apri15, 2005 at 7:30 p.m. Those in attendance were Mayor Betty Burch, Aldennen Burns, Looker, Dazata, Legaard, Super, Jones and Beazd. Also present were, David Blackburn, City Administrator, Louise Rusick, City Clerk, Brent Miles, Planning & Zoning and Community Development Coordinator, John McClelland and Ben Prell, City Attorney's office. Bill No. 2005-30 Alderman Looker moved to place Bill No. 2005-30 on its first reading, said Bill Ratifying the certi- ratifying the certification of the election held on Apri15, 2005 as follows: fication of the special election Alderman Ward I Linda Jones 68 votes Absentee 6 Al Bowman 54 votes Absentee 7 Alderman Ward II Ray Beazd 37 votes Patricia Traw 36 votes Absentee 1 Tie Vote Alderman Wazd IH Pamela Dazata 68 votes Absentee 4 Rick Turner 48 votes Absentee I Tourism Promotion Tax Yes 224 votes No 109 votes Alderman Bums seconded the motion and the vote was: Aye: Aldermen Super, Dazata, Legaazd, Beard, Burris an Looker. Motion carries. Ordinance No. 2005-30 Alderman Super moved to place Bill No. 2005-30 on its second reading, Approved and upon passage of same become Ordinance No. 2005-30, seconded by Alderman Legaazd, the vote was: Aye: Aldermen Looker, Bums, Darata, Super, Beazd and Legaazd. Motion carries. Mins. 4/12/05 Swearing in Ceremony Louise Rusick, City Clerk swore in the newly elected officials, Aldermen Linda Jones and Pamela Darata. There was a tie vote in the April 5th election in Wazd II and there will be a special election on Tuesday, Apri126, 2005 to determine the elected official. Recess A brief recess was called at 7:13 p.m. Reconvened The Mayor and all Board members answered to roll call at 7:25 p.m Brent Miles speaks Brent told the board a "Special Use Permit" has been applied for by Mike to the board Purcell for the location at 6105 NW Riverpazk Drive. There will be a Public Hearing before the Planning and Zoning Commission on Apri128s' and if the P&Z approve the Special Use Permit, it will be on the May 3`~ agenda for the Board of Aldermen's consideration. Brent said he visited the site and issued a "Stop Work Order" on April 12, 2005. The berm had neazly been finished. Mr. Purcell has applied for a Land Disturbance Permit and it has been approved. The Corps of Engineers has to review the 404 permit as this location is in the Levee Critical Area. The Land Disturbance permit has not been returned yet but once it does, it will be placed in the city files. Brent visited with Don Dressler three to four weeks ago and outlined everything that needs to be done, Change of Use, Grading and Special Use Pennits. Mike Purcell speaks Mike Purcell with Damon Purcell Construction said he purchased Scherer to the board Trucking six weeks go and has been talking about a compost site to the twenty- eight acres at the back of the property. He was building a dirt benn and plans to place trees and put down gravel then a "Stop Work Order" was issued by the city. The previous "Special Use" Permit has expired since Scherer Trucking went out of business. The Levee District has Corps of Engineers Permits for runoff and there will have to be a retention pond constructed. The property in the front maybe leased for retail. Mike said he has hauled in one-hundred fifty (150) truckloads of dirt a day so far. The land has not been raised over one foot except for the stockpile. He would like to finish the berm Mike said rebaz is being separated and the Department of Natural Resources knows. He stated organic wood, asphalt and concrete will be processed. Mayor Burchs' Mayor Burch suggested a traffic study. Brent will discuss this with Chief comment Mills and decide. Brent said a time frame needs to be addressed for hauling because the trucks are Winning nine hours a day. Brent speaks to the Bob Ball, Ball Industries, 9 Highway reported to the city a rock broke his board windshield from a Purcell truck hauling dirt. David Blackburn and Brent went to investigate the newly acquired Purcell site. Motion for Closed Alderman Dazata moved that the meeting go into closed session, pursuant to Session at 8:23 p.m. RSMo 610.021(1) for discussion of Legal and RSMo 610.021(2) Real Estate Issues with the City Attorney, seconded by Alderman Looker, and the vote was: Mins. 4/12/05 2 Aye: Alderman Beard, Darata, Jones, Super, Looker and Legaard. Motion carries. Motion for Open Alderman Looker moved that the meeting go into open session at Session at 8:33 seconded by Alderman Darata, and the vote was: Aye: Alderman Jones, Looker, Darata, Legaard, Beazd and Super. Motion Carries Motion Carries. Bill No. 2005-31 Alderman Beazd moved to place Bill no. 2005-31 on its first reading said Author. & Approv. th 8~' , Bill authorizing and approving the eighth amendment to lease and develop- e amendment to lease & develop- ment agreement and documents and actions relater thereto, between the city and the Missouri Gazning Company, seconded by Alderman Dazata the vote ment agreement & , was: documents & actions between city & Mo. Aye: Aldermen Looker, Super, Darata, Legaard Beard and Jones Gaming Company , . Motion carries. Ordinance No. 2005-31 Alderman Super moved to place Bill No. 2005-31 on its second reading Approved , and upon passage of same become Ordinance No. 2005-31, seconded by Alderman Looker, the vote was: Aye: Aldermen Looker, Jones, Darata, Super, Beazd and Legaazd. Motion carries. Aldermen's comments Alderman Legaazd asked about "cleanup days" if the city could pick up one day for each wards, bulky items, excluding white items. Mayor Burch said this would be taken into consideration. Alderman Dazata asked if NW Petronella Lane could be brought up to standards because there is a drainage problem. No decision was made. Alderman Super said he is curious about the occupancy of houses across from Alderman Legaazd. It was mentioned there was one temporary occupancy permit issued for the house on the north.
