Board members,
The Financial Services Department of BNSF has mailed the
Levee District a Notice of Delinquent Account relating to the previous
invoices submitted to the Levee District for work at the Q1 Crossing.
The Board has consistently taken the position that the Levee District is
not obligated to pay the invoices for any work or repair at the Q1
Crossing. After receiving each invoice, the Levee District has sent
emails and/or letters in response clearly stating its position of no
responsibility for the invoices. The Levee District has not received
any reply from any of the previous communications sent to BNSF.
I have emailed a letter to the Senior Manager of the
Financial Services Department in Fort Worth Texas stating the Levee
District is disputing the invoices and will not pay them. Further, I
have requested documentation upon which BNSF is relying to seek payment
from the Levee District. This request is pursuant to provisions of the
Fair Debt Collection Act. I have requested the documentation within 30
days.
I will keep you advised of any further developments with
respect to the BNSF invoices and its response to my request for
documents. Thank you.
