AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE TO ENTER
INTO A JOINT USE AGREEMENT WITH AND PAY CERTAIN FUNDS TO
PARK HILL SCHOOL DISTRICT
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
RIVERSIDE, MISSOURI AS FOLLOWS:
SECTION 1 —AGREEMENT APPROVED The Board of Aldermen ("Board")
approves the Joint Use Agreement, in substantially the form attached hereto, with Park
Hill School District, and authorizes the Mayor to execute the Agreement on behalf of the
City; and
SECTION 2—AUTHORITY GRANTED. The Mayor, the City Administrator, the City
Attorney and other appropriate City officials are hereby authorized to take any and all
actions as may be deemed necessary or convenient to carry out and comply with the
intent of this Ordinance and to execute and deliver for and on behalf of the City all
certificates, instruments, agreements and other documents, as may be necessary or
convenient to perform all matters herein authorized.
SECTION 3— EFFECTIVE DATE. This ordinance shall be effective from and after its
date of passage.

APPROVED by a majority of the Board of Aldermen and APPROVED by the Mayor of

JOINT USE AGREEMENT
THIS JOINT USE AGREEMENT entered into on thi day ofI 2016,
by and between the City of Riverside, Missouri ("City") and the Park Hill Scho61 District
("District").
WHEREAS, the District is the owner of real property in the City, including tennis
court facilities that are capable of being used by the City for community recreational
purposes; and
WHEREAS, the Park Hill South High School was the sponsor of a grant
application for a Platte County Parks and Recreation Outreach Grant to improve the
tennis court facilities by adding shelter house facilities; and
WHEREAS, under appropriate circumstances,these facilities should be used most
efficiently to maximize use and increase recreational opportunities for the community;
and
WHEREAS, the City supported the District's grant application by in the amount
of $2,500, so that the shelter house facilities, if constructed, would contribute to the
welfare of the City and its residents; and
WHEREAS, on March 7, 2016, Platte County did award the grant in the amount
of$7,231 for the tennis shelter structure.
Now, therefore, in consideration of the mutual covenants and agreements set forth
herein, the parties agree to the following:
1. The District and the City hereby agree to cooperate in coordinating programs and
recreational activities related to tennis.
2. The District shall be entitled to the exclusive use of District Property for public
school and school-related related educational and recreational activities, and at such other times
as District Property is being used by the District or its agents.
3. At all other times and subject to the District's schedule, the City and third parties
authorized by the City will be entitled to priority use of the District's tennis facilities,
without charge, for community recreational and educational purposes.
4. The District and the City shall designate representatives to develop a schedule and
programming for use of the District tennis facilities for a term of two (2) years. The District
agrees to work in good faith with the City in making staff and volunteers available to assist the
City's Fire/Police Athletic League in providing to F/PAL participants the opportunity to learn to
play tennis.
5. The City agrees to contribute $2,500.00 to the District to be used to offset costs
associated with the tennis shelter structure.

6. No 3rd Party Beneficiaries. The provisions of this Agreement shall not be deemed to
create any third party benefit hereunder for any member of the public or to authorize any
one,not a party hereto, to maintain suit pursuant to the terms of this Agreement.
In witness whereof, the parties have executed this Agreement the day and year first written
above.
