R-2016-056 A RESOLUTION APPROVING AN AMENDMENT TO THE AGREEMENT WITH ENET,LLC FOR EXTENSION OF IT SERVICES FOR THE CITY OF RIVERSIDE WHEREAS,the City issued a request for the submission of proposals or the purpose of IT services for all city facilities September 2013; and WHEREAS,the City received one response to its request for proposals and the services proposed by eNet LLC had been evaluated and recommended as an advantageous proposal for performance of such services and approved by Resolution R-2013-101 on October 1,2013; and WHEREAS,the Board of Aldermen find it is in the best interest of the City to authorize and approve an amendment of the agreement with eNet LLC to extend the term of the agreement for one year(Oct. 2016—Sept. 2017)with the option for two additional one year terms(Oct. 2017 - Sept. 2018 & Oct. 2018—Sept. 2019)to perform such services; NOW THEREFORE,BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,MISSOURI,AS FOLLOWS: THAT the proposal for extension of eNet LLC for the computer support services at an hourly rate of$85 per hour is hereby accepted and approved; and FURTHER THAT an amended agreement by and between the City of Riverside and eNet LLC in substantially the same form as attached hereto in Exhibit"A"and incorporated herein by reference is hereby authorized and approved; and FURTHER THAT the City Administrator, Mayor or her designee are hereby authorized to execute all documents and agreements necessary or incidental to carry out the terms and conditions of such bid award and the City Clerk is authorized to attest thereto. Citi Clerk AMENDMENT FOR EXTENSION OF SERVICE AGREEMENT THISENDMENT FOR EXTENSION OF SERVICE AGREEMENT entered into on this Z day of�2016,by and between the CITY OF RIVERSIDE, MISSOURI ("City") and EDDIE SEAS LTZ d/b/a eNET, LLC,PO Box 24285, Stanley,Kansas 66283-0285 ("Service Provider"). WHEREAS, Service Provider is an individual desiring to provide services, including computer support services(the"Services"),to the City. WHEREAS,the City requires computer support services from time to time, desires Service Provider to provide necessary Services,and requires funding to provide Services to the City. WHEREAS,the City has found that the provisions of the Services contributes to the welfare of the City as well as the economic and social potential of the City and its residents,that the Services are important to the welfare of the City and that the provisions of funds to assist in providing such services are for a public purpose. IN CONSIDERATION of the mutual covenants and agreements set forth herein,the parties agree to the following: 1. That Service Provider shall provide computer support services to the City as deemed necessary by the City pursuant to the terms of this Service Agreement and the terms and conditions set forth in Service Provider's proposal attached hereto as Exhibit "A", which are incorporated herein by reference. 2. That the City shall purchase from Service Provider Services as needed at the rate of eighty-five($85)per hour. 3. That the Service provided by Service Provider shall include,but not be limited to, computer support services for the City's computer equipment. 4. The term of this amendment for the service agreement shall be an extension for one year(Oct. 2016—Sept. 2017), and may be renewed at the same hourly rate for up to two additional one year terms (Oct. 2017—Sept. 2018 & Oct. 2018—Sept. 2019) upon written notice by the City at least 30 days prior to expiration of the then current term. Mills SUBJECT: IT Service Agreement For a number of years the City has contracted for IT services from eNET LLC and the current service agreement expires in September, 2016. While the hourly rate billed by eNET has not changed from $85 per hour since the beginning, the City's technology infrastructure has grown dramatically. Attachment A contains a listing of the skills, certifications and law enforcement authorizations that a contract IT provider for the City would be required to have. In past solicitations for proposals for IT services we have found that these skills and certifications cannot be matched at the same cost as eNET. Section 135.070.13 allows the Board to waive the procurement requirements: `Notwithstanding any of the provisions of Subsection(A) of this Section, the City may, upon concurrence of a majority vote of the members of the Board of Aldermen, extend any contract for the purchase of goods or services without utilizing the bidding procedures as herein described, when, in the opinion of the Board of Aldermen, such extension is deemed to be in the best interest of the City." It is my recommendation that the contract for IT services with eNET LLC be extended for one year with the option for two additional one year terms (Oct. 2016 — Sept. 2017; Oct 2017 — Sept. 2018; Oct. 2018 — Sept 2019) at the rate of $85 per hour. My recommendation is based upon the following, all of which are in the best interests of the City: • The service provided by eNET has been very satisfactory. • The City's IT infrastructure contains a number of complex systems that while not directly connected are required to function in the same environment. The City cannot tolerate the disruption of service that would inevitability occur with a change of service provider that likely would not have the necessary skills and knowledge. Familiarity with the different systems means quicker solutions and minimal downtime. • Certification and authorization are both required to work within the various criminal history databases. eNET has long had both and is known by the different administrators. • Using past proposals as a guide the hourly rate charged by eNET and their practice of not adding a surcharge to equipment purchased will not be matched by another provider.
