J�-4-1 AN ORDINANCE AUTHORIZING AND GRANTING A PRELIMINARY PLAT AND REZONING OF WOODLAND PLACE FROM "R-1 SINGLE FAMILY RESIDENTIAL" TO "PD PLANNED DEVELOPMENT DISTRICT" IN ACCORDANCE WITH THE PROVISIONS OF THE UNIFIED DEVELOPMENT ORDINANCE FOR THE CITY OF RIVERSIDE, MISSOURI WHEREAS, Application PC16-13 submitted by Phelps Engineering/David Barth ("Applicant") requesting approval of a preliminary plat and a change in zoning from "R-1 Single Family Residential" to "PD Planned Development District' on land Legally described as Exhibit A (the"Property')was referred to the Planning Commission to hold a public hearing; and WHEREAS, after due public notice in the manner prescribed by law, the Planning Commission held a public hearing on October 13, 2016, wherein it considered and reviewed the request of the Applicant and rendered a report to the Board of Aldermen recommending that the preliminary plat and zoning change requested be; and WHEREAS, after due public notice in the manner prescribed by law, the Board of Aldermen of the City of Riverside, Missouri at its regular meeting on October 18, 2015 held a public hearing regarding the preliminary plat and rezoning request of the Applicant; and WHEREAS, the Board of Aldermen, after considering the evidence presented during such public hearings, has determined adoption and approval of the preliminary plat and rezoning for Woodland Place to be in the City's best interest and to promote the public health, safety and welfare; NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: SECTION 1 —APPROVAL OF PRELIMINARY PLAT/PRELIMINARY DEVELOPMENT PLAN. That the Preliminary Plat for Woodland Place in the City of Riverside, Platte County, Missouri, a true and correct copy of which is attached hereto and incorporated herein, is hereby approved, platting the property legally described in Exhibit"A" attached hereto SECTION 2—APPROVAL OF PLANNED DISTRICT DEVELOPMENT STANDARDS. The planned district development standards for Woodland set forth in Exhibit B are hereby approved. Development of the Property shall be subject to and comply with the Woodland Place Planned Development District standards together with all other provisions set forth in the City Code and Unified Development Ordinance of the City of Riverside. Approval of the Woodland Place Planned Development District does not relieve the Applicant from following all other applicable codes and laws of the City of Riverside or other governmental agency, nor does it relieve the applicant from submitting necessary site plans or applying for all necessary building permits, electrical permits, sign permits, or occupation licenses required by City Code. The standards set forth in the Woodland Place Planned Development District shall have precedence where such conditions are more restrictive than those set forth in City Code. SECTION 3—FAILURE TO COMPLY. That failure to comply with any of the conditions or provisions contained in this ordinance shall constitute a violation of both this ordinance and the City's Unified Development Ordinance in addition to other penalties which may be contained in the City Code. BILL NO. 2016-048 ORDINANCE NO. SECTION 4- EXECUTION OF DOCUMENTS. The Mayor shall have authority to take such actions to execute such documents as she shall deem reasonably necessary to cant' out the provisions and intent of this ordinance. SECTION 5-SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 6- EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval. The meeting was called to order at 6:30 p.m. Answering roll call were Stephen King,Ray Uhl, Harold Snoderley,Mike Lombardo,Nathan Cretsinger and Mike Soler.Also present: City Planner Sarah Wagner and Community Development Assistant Rhonda Smith. Members absent were Al Bowman, Steven Kaspar and Mayor Kathy Rose. Approval of Minutes of Commissioner Snoderly moved to approve the minutes of September September 22,2016. 22, 2016, seconded by CommissionerUhl. Motion passed 6-0. Public Hearing— Chair Stephen King opened the public hearing at 6:32 pm. Preliminary Plat/Rezoning —Woodland Place City Planner Sarah Wagner gave a brief report stating this is a preliminary plat for 66 acres off of West Platte Road and Riverside Drive that will be developed as a high end residential development. She explained that the land has been rezoned from a single family RI to a Planned Development to allow for customized setbacks due to the topography of the land. Vicki Russell questioned the difference between the single family zoning to planned development. City Planner Wagner explained that the change was due to special circumstances for the setbacks due to the land topography. Judith Green asked if the planned greenspace in the development would provide separation between the new development and Woodland. City Planner Wagner said the greenspabe would provide separation. Anthony Shores asked if the Riverside Drive entrance would remain the same or if the road would move.City Planner Wagner said the road would remain the same but the city would continue to study traffic patterns at the intersection.David Barth,the developer,noted that Riverside Drive would not be the main entrance to the development. Commissioner Stephen King asked if the connection to the Line Creek Trail would remain the same or if the city Park Board would make improvements.Commissioner Cretsinger suggested coordinating the development with the Park Board to make improvements to the trail. 1 Chair Stephen King closed the public hearing at 6:49 pm. Commissioner Cretsinger moved to recommend approval of the Preliminary Plat/Rezoning—Woodland Place to the Board of Aldermen, seconded by Commissioner Uhl. Motion passed 6-0. Public Hearing—Special Chair Stephen King opened the public hearing at 6:50 pm. Use Permit Capital Electric 4400 NW Mattox City Planner Sarah Wagner gave a brief report. She explained that Road Capital Electric was a thriving business that had outgrown the current office space. City code 410 would allow the use of a modular office for one year with renewals annually. She also stated that due to growth at Park Hill South the school would soon be making the same request. Commissioner Soler questioned the one-year time frame and if this would be adequate time to complete the expansion. Andy Pachasa,President of Capital Electric, said the modular unit would need to be utilized for 3 -5 years due to budget cuts from corporate headquarters.The funding to build would not be available for at least two years. Vice Chair King closed the public hearing at 7:03 pm. Commissioner King moved to recommend approval of the Special Use Permit Capital Electric 440 NW Mattox Road, Seconded by Commission Snoderly. Adjourn Commissioner Soler moved to adjourn at 7:09 p.m. Commissioner Uhl seconded and the meeting was adjourned 6-0. City of Riverside Staff Analysis Report Case Number PC 16-13 Preliminary Development Plat and Rezoning North of West Platt Rd. between Riverside Dr. and Valley Ln. General Information Applicant: Phelps Engineering/Barth Development Location: North side of West Platte Road between Riverside Dr. and Valley Ln. Application: Preliminary Plat and Rezoning Current Zoning: R-1 Single Family Residential Proposed Zoning: PD- Planned Development Existing Land Use: Undeveloped Proposed Land Use: Single Family Residential Site Area: 66.6 Acres Lots: 89 Lots Procedure: The Preliminary Plat and Rezoning will be reviewed by the Planning Commission and the Board of Aldermen for approval. Overview The applicant is proposing a new 89 lot residential subdivision on approximately 66 acres. The proposed development also has five tracts of open greenspace. The development will have access off NW Riverside Drive and NW Valley Lane. The development will connect to existing utilities in the area and is the responsibility of the developer. Preliminary Plat A preliminary plat is required to ensure that"the layout of the proposed subdivision conforms to this Chapter,the Comprehensive Plan and City Policy"(Section 400.245). The applicant has provided the majority of the information required for a preliminary plat. The following information is necessary: 1. Plat tied to the Geographic Reference System 2. Preparer's stamp and signature 3. Notations for any easements,reservations or endorsements names of all proposed streets 4. Area of all proposed and existing lots Pagel of 2 5. Proposals for connection with existing water supply and sanitary sewer systems or alternative means of providing water supply and sanitary waste treatment and disposal; provision for collection and discharging surface water drainage Rezonine The applicant is requesting to rezoning the property from R-1 Single Family Residential to PD-Planned Development. The applicant is proposing 20' front setback,30' rear setback and 6.5' side setbacks to accommodate the unique terrain and view in the area. Analysis The Comprehensive Master Plan discusses the community's support for the need for more housing and more variety of housing. The proposed plat is in conformance with all of these goals. Because much of Riverside's housing stock is multi-family,the approval of the Woodland Place Plat will provide current and future residents of Riverside with additional housing options. Others goals of the Plan are to improve the City's image and be environmentally conscious. The application accomplishes these goals by including entrance monuments, landscaping and preserving several acres as open space. Recommendation The preliminary plat meets the criteria for platting and is in conformance with the Comprehensive Master Plan,as well as the rezoning request;therefore,staff recommends approval of the Final Plat.
