HomeMy WebLinkAbout1490 Special Use Permit Capital Electric Temporary Modular Unit BILL NO. 2016-049 ORDINANCE NO. p4q0 AN ORDINANCE GRANTING A SPECIAL USE PERMIT SUBJECT TO CERTAIN CONDITIONS TO CAPITAL ELECTRIC FOR A TEMPORARY MODULAR UNIT IN THE GENERAL PLANNED INDUSTRIAL (GP-q DISTRICT ON PROPERTY LOCATED AT 4400 NW MATTOX ROAD. WHEREAS, pursuant to City Code Chapter 400, Section 400.410 of the Unified Development Ordinance, application no. PC16-14, submitted by Capital Electric requesting a Special Use Permit to allow a temporary modular unit associated with their business in the General Planned Industrial (GP-1) District located at 4400 NW Mattox Road was referred to the Planning Commission to hold a public hearing; and WHEREAS, after due public notice in the manner prescribed by law, the Planning Commission held a public hearing on October 13, 2016 and rendered a report to the Board of Aldermen containing findings of fact and a recommendation that the Special Use Permit be approved; and WHEREAS, after due public notice in the manner prescribed by law, the Board of Aldermen held a public hearing on October 18, 2016 and, based upon all of the information presented, find it is in the best interest of the citizens of the City of Riverside to grant said Special Use Permit subject to certain terms and conditions as set forth herein; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1 —GRANT OF SPECIAL USE PERMIT. That a Special Use Permit is hereby granted to Capital Electric to allow a temporary modular unit associated with their business on property located at 4400 NW Mattox Road in the General Planned Industrial (GP-I) District, subject to the conditions set forth in Section 2. SECTION 2—CONDITIONS OF APPROVAL AND OPERATION. That the following conditions of approval shall apply and be followed for the duration of the Special Use Permit. a. The modular unit shall only be permitted on the property described above and may not be moved to a different location or expanded without first obtaining approval in accordance with the provisions for special use permits as specified in City Code. b. The applicant shall work with staff for appropriate placing of the unit. c. The modular unit shall be kept in an orderly manner. d. The Riverside Planning and Zoning Commission may review the Special Use Permit if the applicant has any code violations. e. The Special Use Permit shall expire after 1 year. f. The issuance of the Special Use Permit does not relieve the applicant from following all other applicable codes and laws of the City of Riverside or other govemmental agency. This permit does not relieve the applicant from submitting BILL NO. 2016-049 ORDINANCE NO. necessary site plans or applying for all necessary building permits, electrical permits, sign permits, or occupation license required by City Code. The conditions set forth in this permit shall have precedence where such conditions are more restrictive than those set forth in City Code. SECTION 3—FAILURE TO COMPLY. Failure to comply with any of the conditions or provisions contained in this ordinance shall constitute a violation of both this ordinance and the City's Unified Development Ordinance and shall also be cause for revocation of the Special Use Permit granted herein in addition to other penalties which may be contained in the City Code. SECTION 4—SEVERABILITY CLAUSE. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. SECTION 5— EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and approval. Procedure: In accordance with Section 400.410 of the Unified Development Ordinance(UDO,a special use permit is required to allow for the temporary use of modular units. Therefore,the procedure for a special use permit is a public hearing before the Planning Commission and the Board of Aldermen after notification has been given in a paper of general circulation at least 15 days before the hearing date and property owners within 185' of the subject property have been notified of such hearing. These requirements have been fulfilled on this application. Proiect Description The applicant is requesting a Special Use Permit pursuant to Chapter 400.410 of the Riverside Municipal Code to allow for the temporary use of a modular unit for office space. The applicant has experienced significant growth and is no longer able to accommodate all of its office staff. The applicant is working to plan for abuilding expansion,but is requesting the use of a temporary modular unit until those plans can be finalized. Analysis Section 400.440.L.of the Code allows for modular units serving as temporary or less than permanent facilities according to the following standards: 1. Building Code-All applicable provisions of the currently adopted building code shall be followed. 2. Expiration-The special use permit allowing the modular unit to be used as a temporary facility shall expire one(1)year after the approval date by the Board of Aldermen. The holder of the special use permit may apply for an extension of the special use permit by following the procedure outlines in Section 400.230 Special Use Permit Applications. Conformance to Master Plan: The Master Plan discusses developing this area as an industrial use. The City acknowledges the needs of business to grow and expand within the City. In general, the City is supportive of the applicants request for the special use permit for a temporary modular unit with the following conditions. 1. The special use permit is valid for one year. 2. The applicant work with the city for appropriate placement of the unit. Page 1 of 2 Attachments - Project Location Map - Site Plan Page 2 of 2 MINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION RIVERSIDE, MISSOURI Thursday, October 13, 2016 6:30 p.m. The Planning and Zoning Commission for the City of Riverside, Missouri, met in regular session at Riverside City Hall,2950 NW Vivion Road,Riverside,Missouri. The meeting was called to order at 6:30 p.m. Answering roll call were Stephen King,Ray Uhl, Harold Snoderley, Mike Lombardo,Nathan Cretsinger and Mike Soler. Also present: City Planner Sarah Wagner and Community Development Assistant Rhonda Smith. Members absent were Al Bowman, Steven Kaspar and Mayor Kathy Rose. Approval of Minutes of Commissioner Snoderly moved to approve the minutes of September September 22,2016. 22,2016, seconded by Commissioner Uhl. Motion passed 6-0. Public Hearing— Chair Stephen King opened the public hearing at 6:32 pm. Preliminary Plat/Rezoning —Woodland Place City Planner Sarah Wagner gave a brief report stating this is a preliminary plat for 66 acres off of West Platte Road and Riverside Drive that will be developed as a high end residential development. She explained that the land has been rezoned from a single family RI to a Planned Development to allow for customized setbacks due to the topography of the land. Vicki Russell questioned the difference between the single family zoning to planned development. City Planner Wagner explained that the change was due to special circumstances for the setbacks due to the land topography. Judith Green asked if the planned greenspace in the development would provide separation between the new development and Woodland. City Planner Wagner said the greenspace would provide separation. Anthony Shores asked if the Riverside Drive entrance would remain the same or if the road would move. City Planner Wagner said the road would remain the same but the city would continue to study traffic patterns at the intersection. David Barth,the developer,noted that Riverside Drive would not be the main entrance to the development. Commissioner Stephen King asked if the connection to the Line Creek Trail would remain the same or if the city Park Board would make improvements. Commissioner Cretsinger suggested coordinating the development with the Park Board to make improvements to the trail. 1 Chair Stephen King closed the public hearing at 6:49 pm. Commissioner Cretsinger moved to recommend approval of the Preliminary Plat/Rezoning—Woodland Place to the Board of Aldermen, seconded by Commissioner Uhl. Motion passed 6-0. Public Hearing—Special Chair Stephen King opened the public hearing at 6:50 pm. Use Permit Capital Electric 4400 NW Mattox City Planner Sarah Wagner gave a brief report. She explained that Road Capital Electric was a thriving business that had outgrown the current office space. City code 410 would allow the use of a modular office for one year with renewals annually. She also stated that due to growth at Park Hill South the school would soon be making the same request. Commissioner Soler questioned the one-year time frame and if this would be adequate time to complete the expansion. Andy Pachasa,President of Capital Electric, said the modular unit would need to be utilized for 3 -5 years due to budget cuts from corporate headquarters.The funding to build would not be available for at least two years. Vice Chair King closed the public hearing at 7:03 pm. Commissioner King moved to recommend approval of the Special Use Permit Capital Electric 440 NW Mattox Road, Seconded by Commission Snoderly.
