ORDINANCE N0.2008-35
AN ORDINANCE ESTABLISHING NEW CITY LIMITS OF THE CITY OF RIVERSIDE,
MISSOURI, DESIGNATING THE WARD LOCATION THEREOF, AND AMENDING
SECTION lO5.Ol0.B.3 OF THE RIVERSIDE MiJNICIPAL CODE.
WHEREAS, on the 22nd day of May, 2007, the Board of Aldermen of the City of
Riverside, Missouri, declared by Resolution, its intent to annex a certain unincorporated area into
the City of Riverside, Missouri, as described in Section 1; and
WHEREAS, the property is adjacent and contiguous to the present corporate limits of the
City of Riverside, with the common boundary exceeding the minimum of fifteen percent
contiguous boundary; and
WHEREAS, by Ordinance No. 2007-56, duly adopted py the Board of Aldermen of the
City of Riverside, Missouri, on the 5th day of June, 2007, the Board of Aldermen did ordain to
annex an unincorporated tract of land lying north and west of the present municipal corporate
limits of the City, and the ordinance particularly described the proposed extended limits, and
provided that a proposition to extend the City Limits as described should be submitted to the
voters of the City at an election to be conducted pursuant to Section 71.015 RSMo.; and
WHEREAS, a public hearing concerning this matter was held at the Riverside City Hall
in the City of Riverside, Missouri, at 7:00 p.m. on July 10, 2007; and
WHEREAS, at the public hearing, all interested persons, corporations, or political
subdivisions were afforded the opportunity to present evidence regarding the proposed
annexation; and
WHEREAS, at the public hearing, the Board of Aldermen presented a Plan of Intent,
showing, among other things, the reasonableness and necessity of annexation, major services
provided by the City, the timeframe to provide services to the annexed area, property assessment
and taxation, proposed zoning of the annexed area, and the effective date of the proposed
annexation; and
WHEREAS, the election was held on the designated day in pursuance of the proposition
of said Ordinance, and a majority of the voters of the City voting at the election voted in favor of
extending the City Limits of the City of Riverside, Missouri; and
WHEREAS, the Platte County Election Commission, did certify the results of the
election on the proposition of extending the City Limits of the City, and found that 183 voters
voted in favor of the proposition and that 170 voters voted against the proposition; and
WHEREAS, the Circuit Court of Platte County, Missouri, issued a Declaratory Judgment
Order Authorizing Annexation in Case No. 07AE-CV03415; and
WHEREAS, the extension of the City Limits of the City of Riverside is in the best
interest of the City and its citizens.

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
SECTION 1. That the City Limits of the City of Riverside, Missouri, be and hereby are
extended and established so as to embrace and include all that part of Platte County, Missouri,
lying within the following boundary lines adjacent to the present City Limits, to-wit:
All that part of the West One Half of Section 5, Township 50, Range 33, Platte
County, Missouri, described as follows: Beginning at the Northwest corner of the
Northwest Quarter of said Section 5; thence South 89 degrees O1 minutes 09
seconds East, along the North line of the Northwest Quarter of said Section 5, a
distance of 2615.07 feet to the Northeast corner of the Northwest Quarter of said
Section 5; thence South 00 degrees 20 minutes 51 seconds West along the East
line of the Northwest Quarter of said Section 5, a distance of 2626.27 feet to the
Southeast corner of the Northwest Quarter of said Section 5; also being the
Northeast corner of the Southwest Quarter of said Section 5; thence South 00
degrees 21 minutes 08 seconds West along the East line of the Southwest Quarter
of said Section 5, a distance of 128.89 feet to the Northerly Right-of--Way line of
Missouri State Route 9; thence North 57 degrees 03 minutes 17 seconds West,
along said Right-of--Way line, a distance of 627.08 feet; thence continuing along
said line North 69 degrees 37 minutes 59 seconds West, a distance of 289.80 feet;
thence continuing along said line North 74 degrees 19 minutes 48 seconds West, a
distance of 445.37 feet; thence continuing along said line North 73 degrees 52
minutes 59 seconds West, a distance of 1085.20 feet; thence continuing along said
line North 82 degrees 34 minutes 55 seconds West, a distance of 343.65 feet to
the West line of the Northwest Quarter of said Section 5; thence North 00 degrees
21 minutes 59 seconds East, along the West line of the Northwest Quarter of said
Section 5, a distance of 1892.11 feet to the Point of Beginning. Said Tract
contains 133.27 Acres more or less.
SECTION 2. That the land described in Section 1 of this Ordinance shall be part of the
Third Ward of the City of Riverside and that Section lO5.Ol0.B.3 of the Riverside Municipal
Code is hereby amended to provide that the boundary of Ward 3 shall be as described in Exhibit
A hereto.
SECTION 3. That the land described in Section 1 of this Ordinance shall be zoned as
Residential Planned Development.
SECTION 4. The City Engineer, the City Planner, and other pertinent City personnel
are hereby authorized and directed to conform all maps, directories, drawings, plats, and other
appropriate documents to the altered City Limits of the City of Riverside as herein provided.
SECTION 5. All ordinances or parts of ordinances in conflict with this ordinance are
hereby repealed insofar as they conflict.
SECTION 6. This Ordinance shall take effect and be in force from and after its passage
by the Board of Aldermen and its approval by the Mayor of the City of Riverside, Missouri.

3. Third Ward. Boundary as follows:
A tract of land being generally described as being that part of the City of
Riverside, Platte County, Missouri which lies West of the East line of the Southeast
Quarter of Section 32, Township 51 North, Range 33 West and West of the East line
of Section 5 Township 50 North, Range 33 West and being North of the centerline of
the BNSF Railway Company right-of--way, as now established, said tract of land
includes the Southeast Quarter of said Section 32 and a portion of Sections 5 and 6 of
said Township 50 North, Range 33 West and is more particularly described as
follows:
Beginning at the Northeast corner of the Southeast Quarter of said Section 32;
thence West along the North line of said Quarter Section, (Said North line being also
the city limits of the City of Kansas City, Missouri), to the Northwest corner of said
Southeast Quarter; thence South along the West line of said Southeast Quarter, to the
Southwest corner thereof, being also a point on the North line of Section 5, Township
50 North, Range 33 West; thence West along the North line of said Section 5, to the
Northwest corner thereof; thence South along the West line of said Section 5, to a
point 300 feet North of the North right-of--way line of Missouri State Highway Route
No. 45 (as measured perpendicular to the North right-of--way line thereof), as said
North right-of--way line is now established; thence generally Northwesterly along the
several courses and distances which are 300 feet North of and parallel with and
concentric with the North right-of--way line of said Missouri State Highway Route
No. 45, to a point on the West line of the Northwest Quarter of said Section 6; thence
South along the West line of said Northwest Quarter Section to the point of
intersection with the centerline of said BNSF Railway Company right-of--way; thence
Southeasterly along said centerline to the point of intersection with the East line of
said Section 5; thence North along the East line of said Section 5 to the Northeast
corner thereof, being also the Southeast corner of the Southeast Quarter of said
Section 32; thence North along East line of said Quarter Section to the Point of
Beginning.
