Bill No. 2007- to Ordinance No. 2007-~~ AN ORDINANCE APPROVING AMENDMENTS TO THE L-385 LEVEE REDEVELOPMENT PLAN AND THE L-385 LEVEE REDEVELOPMENT AREA AND APPROVING ACTIONS AND DOCUMENTS RELATED THERETO WHEREAS, the Board of Aldermen of the City of Riverside, Missouri (the "City") established the Tax Increment Financing Commission of Riverside, Missouri (the "Commission") pursuant to the Real Property Tax Increment Allocation Redevelopment Act, Sections 99.800 to 99.865 of the Revised Statutes of Missouri, as amended ("TIF Act"); and WHEREAS, the City, pursuant to the recommendation of the Commission, approved a redevelopment plan entitled "L-385 Levee Redevelopment Plan" (the "Original Plan") and the designation of the redevelopment area described in the Original Plan as a redevelopment area pursuant to the TIF Act (the "Original Redevelopment Area"); and WHEREAS, the Original Plan and Original Redevelopment Area were amended, pursuant to the TIF Act, by various amendments to the Original Plan (the Original Plan, as amended, the "Redevelopment Plan" and the Original Redevelopment Area, as amended, the "Redevelopment Area"); and WHEREAS, the Commission, after giving all notices required by the T1F Act, held a public hearing on May 23, 2007, relating to the 2007 Amendment to the L-385 Levee Redevelopment Plan, including the reduction of the Redevelopment Area ("2007 Amendment"), and WHEREAS, at such public hearing, all interested parties had an opportunity to be heard and the Commission heard and considered all protests, objections and comments concerning the 2007 Amendment and the reduction of the Redevelopment Area submitted by any interested persons and tax districts affected by the issues addressed at the public hearing; and WHEREAS, after the close of such public hearing, the Commission adopted Resolution No. 2007-OS-Ol on May 23, 2007, recommending the approval of the 2007 Amendment to the City; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1. The recommendations of the Commission set forth in its Resolution No. 2007-OS-Ol are accepted, the amendments to the Redevelopment Plan as set forth in the 2007 Amendment to L-385 Levee Redevelopment Plan attached as Ezhibit A are approved and the Redevelopment Area is reduced accordingly as described in Ezhibit A. ~' Section 2. The Redevelopment Plan, as amended hereby, shall continue in full force and effect. Section 3. The Mayor, City Administrator, City Clerk and other City officials are authorized to take such further actions and execute such documents as are necessary or desirable to effectuate the intent of this Ordinance and the Redevelopment Plan, as amended hereby. Section 4. This Ordinance shall be in force and become effective immediately upon passage of this Ordinance. Rose, ayor ~- Attest: [s al] uise Rusick, i Clerk 2 ~i EXI~IT A 2007 AMENDMENT TO L-385 LEVEE REDEVELOPMENT PLAN (Attached hereto.) 2007 AMENDMENT TO THE L-385 LEVEE REDEVELOPMENT PLAN WHEREAS, the Board of Aldermen of the City of Riverside, Missouri (the "City") established the Tax Increment Financing Commission of Riverside, Missouri (the "Commission") pursuant to the TIF Act; and WHEREAS, the Commission recommended and the City approved a redevelopment plan entitled "L-385 Levee Redevelopment Plan" (the "Original Plan") and the designation of a redevelopment area described in the Plan (the "Redevelopment Area"); and WHEREAS, after Commission recommendation, the City has amended, from time to time, the Original Plan (the Original Plan, as amended, the "Plan'; and WHEREAS, pursuant to this 2007 Amendment, the Redevelopment Area is being reduced. PLAN AMENDMENTS NOW THEREFORE, the Plan is amended as follows: 1. The Redevelopment Area under the Plan is reduced by removing and deleting from such Redevelopment Area the property legally described on Exhibit 2007A-1. 2.
