BILL N0.2007- 84 ORDINANCE N0.2007-84 AN ORDINANCE APPROVING THE FORM OF, AND AUTHORIZING THE EXECUTION OF A NUISANCE ABATEMENT CONTRACT WITH EMBASSY LANDSCAPE GROUP FOR NUISANCE ABATEMENT IN THE CITY OF RIVERSIDE, MISSOURI. WHEREAS, the City of Riverside, Missouri ("City") desires to engage the services of a contractor to perform nuisance abatement services in connection with the property maintenance ordinance; WHEREAS, the City has received multiple bids for Mowing and Nuisance abatement; and WHEREAS, the City of Riverside, Missouri (the "City") has determined that the City requires the services for a public purpose, and the City desires to retain Embassy Landscape Group to provide such services; and WHEREAS, Embassy Landscape Group has provided the City with a contract detailing the costs and services for mowing and nuisance abatement. NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri as follows: Section 1. The City of Riverside shall enter into the Agreement, to be substantially in the form attached hereto as Exhibit A, with Embassy Landscape Group, whereby Embassy Landscape Group will provide services specified in the Agreement, and as consideration for such services the City shall pay fees described in the Agreement. Section 2. The Mayor and the City Clerk are authorized and directed to execute the Agreement, execution of such document being conclusive proof of such approval. The Mayor, City Clerk, and City Administrator are each authorized and directed to perform all acts and execute any other documents necessary or desirable to effectuate the intent of this Ordinance. Contractors performing weed and nuisance (debris) abatement for the City of Riverside, Missouri are required to carry minimum Commercial General Liability insurance on their companies as follows: (1) Each Occurrence (2) General Aggregate (3) Products/completed operations aggregate- The following coverage shall include: ~ Blanket contractual liability a9 Products/completed operations 4 Personal/advertising injury 4~ Broad form property damage ~ Independelrt contractors oa Explosion, Collapse, and Underground Damage $1,000,000.00 $ 2,000,000.00 $a,oooooo.oo The contractor is also required to carry a rider on the insurance policy insuring the City of Riverside for the seine coverage. A Certificate of Insurance and a copy of the inswtance rider must be preserrted to the City before work orders are issued to contractor. 2. Equipment required for weed and nuisance (debris) abatement are as follows: A Push mower and/or riding mower for residelriial and small lots; a brash hog or flail mower for large areas and vacant lots; a weed eater for required trim work; a tYollt loader for large debris removal; a chainsaw; and any other hand tools necessary to perform debrisand/or weed abatement. 3. The City of Riversido, Missouri requires that all work orders be completed within 48 hours of the work order being issued. If the contractor caanot meet this requiremelrt due to rain or another unforeseen reason, the contractor should contact the Neighborhood Servicos Officer imluediately. 4. Mowing requirements shall be as follows: (1) Residential and Commercial Properties (occupied and vacant) (a) Most residential and commercial lots will require hand mowing. Residential and commereial lob shall bo cut and trimmed to a height not to exceed 3 inches. (b) Vegetation should be cut up to the street pavement, including any adjacent ditch, right oP--way or easement. (This includes any area between the properly Iiua and the curb or attest paveamant lino of any adjacent street or allay whether improved or unimproved.) Trimming shall be done around any tree, shrubbery, utility pole or other obstruction located in these areas. (c) Trim work is required on all n.sidartial and commercial properties. This includes areas along fence lines, foundations, walkways, lawn statuary and any other items located on the Iot. (2) Vacant Lots and Open FIe1ds (a) Grass shall be cut to a height not to exceed 3 inches whenever possible. (b) Remove any Dens, bottles, or other litter necessary to perform mowing. 5. Nuisance/Debristemoval requirements shall be as follows: (a) Remove only the items specifically mentioned in the work order. (b) Any dump fees to be compensated wIU require the original receipt to accompany the invoice and work order turned auto the City upon completion of work order. (c) If the contractor has questions regarding items to ba removed, he/she shall contact the Neighborhood 3ervicss Officer immediately. 6. Tha contractor shall contact the Neighborhood Services Officer once the work order is completed. 7. The contractor is expected to perform all abatements in a professional manner. Contractors must exhibit good conduct when working on City jobs. In accordance with the laity of Riverside's noise ordinance, no work shall be perforn~ed between the hours of 10:00 p.m. and 7:00 a.m. Monday thru Saturday and between the hours of 10:00 p.m. and 8:00 a.m. on Sunday. 8. Ifthe contractor is ordered offaproperty or is denied entry to a property, the contractor should immediately remove hisJher equipment, leave the property immediately and contact the Neighborhood Services Officer. The contractor is entitled to one (1) hour of compensation at the contracted rata in accordance with the type of work that was scheduled to ba performed if ordered off a properly. 9. If the contractor has any questions regarding the work to be performed, the items to ba abated, or if the contractor encounters an unusual situation he/she should contact the Neighborhood Services Officer immediately. l0. After the work order is completed the contractor shall retwr- a signed copy of the work order, an attached invoice, and origtnal receipt of any dump fees to be reimbursed within seven (7) business days of completed work. -,. 11. The City reserves the right to refuse payment of work orders if any of the above requirements are not satisfied.
