AN ORDINANCE GRANTING A SPECIAL USE PERMIT SUBJECT TO
CERTAIN CONDITIONS TO ROYAL FUNERAL & CREMATION OF KC, LLC
FOR OPERATION OF A FUNERAL HOME IN THE C-1 COMMERCIAL
DISTRICT ON PROPERTY LOCATED AT 2703 NW PLATTE ROAD
WHEREAS, pursuant to City Code Chapter 400, Sections 400.230 and 400.410 of
the Unified Development Ordinance, application no. PC17-04, submitted by Royal Funeral
& Cremation of KC, LLC requesting a Special Use Permit to allow the operation of a funeral
home in the C-1 Commercial District on land located at 2703 NW Platte Road was referred
to the Planning Commission to hold a public hearing; and
WHEREAS, after due public notice in the manner prescribed by law, the Planning
Commission held a public hearing on April 20, 2017 and rendered a report to the Board of
Aldermen recommending that the Special Use Permit be approved; and
WHEREAS, after due public notice in the manner prescribed by law, the Board of
Aldermen held a public hearing on May 2, 2017 and continued to May 16, 2017 and, based
upon all of the information presented, find it is in the best interest of the citizens of the City
of Riverside to grant said Special Use Permit subject to certain terms and conditions as set
forth herein;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
SECTION 1 —GRANT OF SPECIAL USE PERMIT. That a Special Use Permit
is hereby granted to Royal Funeral & Cremation of KC, LLC to allow the operation of a
funeral home in the C-1 Commercial District on property located at 2703 NW Platte
Road subject to the conditions set forth in Section 2 below.
SECTION 2—CONDITIONS OF APPROVAL AND OPERATION. That the
following conditions of approval shall apply and be followed for the duration of the Special
Use Permit.
1. The term of the Special Use Permit shall be for a period of fifteen (15) months.
Continued operation of the business beyond the initial fifteen (15) months shall
require renewal of the Special Use Permit.
2. The applicant shall provide the City with a copy of the State license to operate.
3. The applicant shall provide the City with contact information for the Function C
licensee.
4. Transfer of bodies shall occur utilizing the rear entrance of the facility.
5. No cremation or embalming services shall take place at the facility.
6. Storage of chemicals used for embalming shall be prohibited at the facility.
7. Viewings and services shall be prohibited during the fireworks season (June 13—
July 12) if a fireworks tent is located on the property(i.e., Platte County Parcel No.
23-2.0-04-400-06-003.00).
SECTION 3—FAILURE TO COMPLY. Failure to comply with any of the
conditions or provisions contained in this ordinance shall constitute a violation of both this
ordinance and the City's Unified Development Ordinance and shall also be cause for
revocation of the Special Use Permit granted herein in addition to other penalties which
may be contained in the City Code.

SECTION 4—SEVERABILITY CLAUSE. The provisions of this ordinance are
severable and if any provision hereof is declared invalid, unconstitutional or unenforceable,
such determination shall not affect the validity of the remainder of this ordinance.
SECTION 5— EFFECTIVE DATE. This ordinance shall be in full force and effect
from and after the date of its passage and approval.
BE IT REMEMBERED that the above was read two times by title only, passed
and approved by a majority of the Board of Aldermen and approved by the Mayor of the
City of Riverside, Missouri, this 16'" day of May, 2017.
