AN ORDINANCE APPROVING A MEMORANDUM OF UNDERSTANDING WITH THE PLATTE COUNTY HEALTH DEPARTMENT BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: SECTION 1 —AGREEMENT APPROVED. That the Riverside Board of Aldermen hereby approves the Memorandum of Understanding, regarding public health emergency planning, by and between the City of Riverside and the Platte County Health Department, in substantially the form attached hereto, and the Mayor is authorized to execute the Memorandum of Understanding. SECTION 2 — AUTHORITY GRANTED. The Mayor, the City Administrator and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary or convenient to perform all matters herein authorized. SECTION 3 — EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage and approval. MEMORANDUM OF UNDERSTANDING Between PLATTE COUNTY HEALTH DEPARTMENT&THE CITY OF RIVERSIDE Platte County Health Department and the City of Riverside have a strong working relationship and a shared vision of providing excellent service to residents. As collaborative partners, Platte County Health Department and The City of Riverside have agreed to work together during a public health emergency or other community disaster where assistance is needed. A public health emergency may include an act of bioterrorism or a naturally occurring event such as pandemic influenza. When such an event occurs,the City of Riverside agrees to be a Closed Point of Dispensing Site for its staff and members of the staff's immediate households. The Platte County Health Department and the City of Riverside agree to the following: I. Dispensing/Distribution: In the event mass prophylaxis/vaccination is required,the City of Riverside will operate as a Closed POD Site, located at City Hall/Public Safety,which will dispense prophylaxis(medications)and/or vaccinations to the staff and members of the staff's immediate households. In return,the Platte County Health Department agrees to provide prophylaxis and/or vaccine to the City of Riverside for dispensing. The dispensing of any vaccine and medications must be in accordance with established Centers for Disease Control and Prevention (CDC)guidelines, hence some exceptions may apply. II. Recipients:Operating as a Closed POD Site,the City of Riverside will serve the staff employed by the City and to immediate members of staffs households. III. Requests for Medications/Vaccinations:The City of Riverside agrees to request medications/vaccine for their staff and immediate members of the staffs households and to assume the responsibility of dispensing said medications and/or vaccinations with no liability assumed by the Platte County Health Department. IV. Medical/Non-medical Personnel:The City of Riverside agrees to dispense these medications or vaccinations free of charge per established medical protocols/algorithms provided by the Platte County Health Department at the time of the event under the supervision of licensed medical personnel. However,the requirement of licensed medical personnel to dispense medications and/or vaccinations during a public health emergency may be waived per gubernatorial order in which non-medical personnel/volunteers may take the place of those individuals. 1of4Page © CITY OF RIVERS MISSOURI Upstream from ordinary. V. Emergency Point-oftontact:The City of Riverside agrees to provide emergency point-of- contact information to ensure timely notification in the event of a public health emergency and to maintain accurate records of medications/vaccinations dispensed. The City of Riverside agrees to secure this information with any unused medications/vaccine for retrieval by the Platte County Health Department. VI. Training/Education:The Platte County Health Department agrees to provide specific training/education opportunities(Including POD training), pre-event planning, and technical assistance to ensure delivery/availability of the appropriate amount of medications/vaccinations in a reasonable and timely manner. This will be provided at no cost to the City of Riverside. VII. POD Pian:The City of Riverside will develop a POD Plan for its dispensing/vaccination operations with Platte County Health Department providing assistance as needed. VIII. Standing Orders/Medical Protocols:The Platte County Health Department agrees to provide the City of Riverside with proper standing orders and medical protocols regarding dispensing activities including, but not limited to:dosing,follow-up procedures,and releasable information regarding the public health emergency situation and to make arrangements for the collection of any unused medications as well as copies of all medical documentation. IX. After Action Report:The Platte County Health Department and the City of Riverside agree to work together to compile an After Action Report identifying both the accomplishments and weaknesses of the operations. X. Confidentiality: Confidentiality of patients and patient information will be maintained as written and enforced by the Health Insurance Portability and Accountability Act(HIPAA) in addition to state and local statutes and regulations. XI. Termination: Either party to this agreement may terminate the Memorandum of Understanding at any time upon ten(10) days written notice. XII. Notices:All notices or other communications provided for by this agreement shall be made in writing and shall be deemed properly delivered: a. If personally delivered or sent by telecopy or any form of telegraphic communication,or special courier,any notice,delivery or other communication shall be treated as being effective or having been given at any time personally delivered or 12 hours after it has been telecopied or wired. XIII. XIV. Entire Agreement and Waiver: This agreement represents the entire agreement between the parties with respect to the subject matter hereof and may be amended only by written agreement between the parties. Failure to insist upon strict compliance with any of the terms herein (by way of waiver or breach) by either party hereto shall not be deemed to be a continuous waiver in the event of any future breach or waiver of any conditions hereunder. XV. Severability: If any portion of the agreement shall,for any reason,be invalid or unenforceable,that portion shall be ineffective only to the extent of such validity or unenforceability,and the remaining portion or portions shall nevertheless be valid, enforceable,and of full force and effect. XVI. Non-Discrimination:The Platte County Health Department shall provide covered services to all eligible persons regardless of race,color, religion,gender, marital status,sexual orientation, national origin,age, disability or veteran status. The Platte County Health Department shall treat all patients fairly and equally consistent with its mission and purpose giving due and appropriate regard to a patient's medical condition. XVII. Applicable Law:This agreement shall be governed by,constructed and enforced in accordance with and shall be subject to the laws of the State of Missouri. Venue for disputes shall be the Circuit Court of Platte County, Missouri. In WITNESS WHEREOF,the parties hereto have executed this agreement.
