HomeMy WebLinkAbout2017-10-17 Regular Meeting MINUTES REGULAR MEETING BOARD OF ALDERMEN RIVERSIDE, MISSOURI The Board of Aldermen for the City of Riverside, Missouri, met in regular session in the Board of Aldermen Chambers at City Hall, 2950 NW Vivion Road, Riverside, Missouri, on Tuesday, October 17, 2017. Mayor Rose called the regular meeting to order at 6:31 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Art Homer, Ron Super, Chet Pruett, Aaron Thatcher, and Al Bowman. Alderman Sal LoPorto was absent. Also present were City Administrator Greg Mills, Community Development Director Mike Duffy, City Clerk Robin Kincaid, City Planner Sarah Wagner, Finance Director Donna Oliver, and City Engineer Travis Hoover. Also present were City Attorney Paul Campo and Special Counsel Joe Bednar. MOTION TO ENTER INTO Alderman Homer moved that the meeting go into closed CLOSED @ 6:31 P.M. session pursuant to RSMo 610.021 (1) Legal Action and litigation, RSMo 610.021 (2) Leasing, Purchase or sale of real estate, and RSMo 610.021(12) Sealed bids and related documents, until the bids are opened; and sealed proposals and related documents or any documents related to a negotiated contract until a contract is executed, or all proposals are rejected, second by Alderman Thatcher. Yes: Homer, Thatcher, Super, Bowman, and Pruett. Motion carried 5-0. MOTION TO ADJOURN Alderman Super moved at 6:58 p.m. to adjourn closed CLOSED @ 8:58 P.M. session with no action taken, second by Alderman Thatcher. Yes: Super, Thatcher, Bowman, Pruett, and Homer. Motion carried 5-0. REGULAR SESSION Mayor Rose called the Regular Session Meeting to order at 7:00 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Art Homer, Ron Super, Chet Pruett, Aaron Thatcher, and Al Bowman. Alderman Sal LoPorto was absent. Also present were City Administrator Greg Mills, Community Development Director Mike Duffy, City Clerk Robin Kincaid, Public Works Director Tom Wooddell, City Engineer Travis Hoover, City Planner Sarah Wagner, Police Captain Gary McMullin, Fire Chief Gordon Fowlston, Finance Director Donna Oliver, and Capital Projects & Parks Manager Noel Challis. Also present was City Attorney Paul Campo. 1 PLEDGE OF ALLEGIANCE Mayor Rose led the Pledge of Allegiance. PUBLIC COMMENT None. CONSENT AGENDA Alderman Bowman moved to approve the consent agenda as presented, second by Alderman Thatcher. Yes: Bowman, Thatcher, Super, Pruett, and Homer. Motion carried 5-0. MINUTES OF 10-03-17 Alderman Bowman moved to approve the minutes of the Special October 03, 2017 p.m. Special meeting, second by Alderman Thatcher. Yes: Bowman, Thatcher, Super, Pruett, and Homer. Motion carried 5-0. MINUTES OF 10-03-17 Alderman Bowman moved to approve the minutes of the October 03, 2017 meeting, second by Alderman Thatcher. Yes: Bowman, Thatcher, Super, Pruett, and Homer. Motion carried 5-0. MINUTES OF 10-10-17 Alderman Bowman moved to approve the minutes of the Special October 10, 2017 p.m. Special meeting, second by Alderman Thatcher. Yes: Bowman, Thatcher, Super, Pruett, and Homer. Motion carried 5-0. COURT REPORT Alderman Bowman moved to approve the September 2017 Court Report, second by Alderman Thatcher. Yes: Bowman, Thatcher, Super, Pruett, and Homer. Motion carried 5-0. RESOLUTION 2017-073 Alderman Bowman moved to approve Resolution 2017-073 CO 1 - Metro Asphalt, Inc. authorizing, approving, and ratifying change order 1 to the Street Maintenance agreement with Metro Asphalt, Inc. for 2017 Street Maintenance Project, second by Alderman Thatcher. Yes: Bowman, Thatcher, Pruett, Super, and Homer. Motion carried 5-0. REGULAR AGENDA PUBLIC HEARING Mayor Rose opened the public hearing at 7:03 p.m. to consider SUP at 4302 NW Mattox Rd approval of the request for a Special Use Permit for barbed wire at a site located at 4302 NW Mattox Road, in the City of Riverside, Missouri. City Planner Sarah Wagner explained the SUP request and showed pictures of the location. The applicant is not present. Planning Commission did not recommend passage and the Board of Aldermen agree that unless there are proven safety concerns 2 for that area, there does not seem to be a need. Mayor Rose asked if there were any comments from the public regarding this matter and hearing none, the public hearing was closed at 7:09 p.m. BILL NO.2017-064 City Clerk Robin Kincaid gave first reading of Bill No. 2017-064. SUP for Barbed Wire The Bill No. 2017-064 failed for lack of motion. BILL NO.2017-065 City Clerk Robin Kincaid gave first reading of Bill No. 2017-065. Refunding of Bonds Finance Director Donna Oliver explained that this Bill authorizes the city to sell the bonds and to complete all necessary documents to close the deal following the sale. Peter Charkowski with Stifel Nicolaus introduced himself and reviewed the process of selling the bonds. Alderman Thatcher moved to accept first reading and place Bill No. 2017-065 on second and final reading, second by Alderman Pruett. Yes: Thatcher, Pruett, Bowman, Homer, and Super. Motion carried 5-0. Alderman Pruett moved to approve Bill 2017-065 and enact said bill as ordinance, second by Alderman Thatcher. Yes: Pruett, Thatcher, Homer, Super, and Bowman. Motion carried 5-0. BILL NO. 2017-066 City Clerk Robin Kincaid gave first reading of Bill No. 2017-066. Final Plat Horizons Ind. VII Community Development Director Mike Duffy explained the Lots 2&3 Replat location of this plat request and the final development plan as well. Alderman Thatcher moved to accept first reading and place Bill No. 2017-066 on second and final reading, second by Alderman Pruett. Yes: Thatcher, Pruett, Bowman, Homer, and Super. Motion carried 5-0. Alderman Pruett moved to approve Bill 2017-066 and enact said bill as ordinance, second by Alderman Thatcher. Yes: Pruett, Thatcher, Super, Homer, and Bowman. Motion carried 5-0. BILL NO.2017-067 City Clerk Robin Kincaid gave first reading of Bill No. 2017-067. Final Dev. Plan 4960 NW 41st Alderman Thatcher moved to accept first reading and place Bill No. 2017-067 on second and final reading, second by Alderman Pruett. Yes: Thatcher, Pruett, Homer, Super, and Bowman. Motion carried 5-0. Alderman Pruett moved to approve Bill 2017-067 and enact said bill as ordinance, second by Alderman Super. Yes: Pruett, Super, Bowman, Homer, and Thatcher. Motion carried 5-0. 3 BILL NO.2017-068 City Clerk Robin Kincaid gave first reading of Bill No. 2017-068. CBC Agreement for Services Alderman Thatcher moved to accept first reading and place Bill No. 2017-068 on second and final reading, second by Alderman Pruett. Yes: Thatcher, Pruett, Homer, Super, and Bowman. Motion carried 5-0. Alderman Pruett moved to approve Bill 2017-068 and enact said bill as ordinance, second by Alderman Thatcher. Yes: Pruett, Thatcher, Bowman, Homer, and Super. Motion carried 5-0. RESOLUTION 2017-077 Alderman Thatcher moved to approve Resolution 2017-077 Bill Pay authorizing the expenditure of funds for fiscal year 2017- 2018, for week ending October 61° and October 13'" in the amount of$308,663.53, second by Alderman Pruett. Yes: Thatcher, Pruett, Super, and Homer. No: none Abstain: Bowman Motion carried 4-0-1. CITY ADMINISTRATOR City Administrator Greg Mills stated that the Missouri Riverfront Recreation Development Study has been going on and Alderman Homer has been attending all the meetings for this group. The group is going to become more active and we feel staff member should be included in this group as well and appropriately our Capital Projects and Parks Manager Noel Challis will be attending these meetings as well. City Administrator Mills explained the history of the amendment to the City Administrator Code that took place several years ago and discussed the amendment presented by Bill No. 2017-069 that would bring the code back into compliance to mirror state statute. City Attorney Paul Campo reviewed the amendment with the Board, following their inquiries. BILL NO.2017-069 City Clerk Robin Kincaid gave first reading of Bill No. 2017-068. Amend City Code 110.070.A Alderman Thatcher moved to accept first reading and place Bill No. 2017-069 on second and final reading. There was no second for the motion made, so Bill No. 2017-069 failed for lack of second. Mayor Rose stated, for the record, that the City is operating against State Statute and out of compliance by not amending our City Code. COMMUNITY DEVELOPMENT Nothing to report. ENGINEERING Capital Projects and Parks Manager Noel Challis presented a brief overview of the RFQ proposed Master Plan update process for the E.H. Young Park. Advertising will begin tomorrow with responses due back on December 15'. FINANCE Nothing to report. 4 FIRE Fire Chief Gordon Fowlston reported that the Fire Open House was held and around 200 attendees. Next year we hope to move it to a Saturday. I also attended the National Fallen Fire Fighters Memorial and it was an honor to be there and to represent our City. Next year I hope to have two of us attend. We have been given a grant by Firehouse Subs in the amount of$24,000 to help purchase 12 sets of new gear that costs approximately $32,000. POLICE Nothing to report. PUBLIC WORKS Nothing to report. LEVEE BOARD Alderman Super stated that the monthly meeting is tomorrow and the annual election for board members will held. MAYOR'S DISCUSSION Mayor Rose reported that she had a neighborhood get together last Saturday and Fire and Police shared presentations. Thank you for helping and sharing with the neighbors. National League of Cities is coming in November, but I will not be able to attend. November 9'"the City of Riverside will sponsor the Riverside Chamber meeting. I attended the Better KCI meeting and the NRCC monthly luncheon today. TTPC met at MARC this morning and Mayor James has presented a letter requesting that funding be made for the Buck O'Neil Bridge. Trunk or Treat is this Thursday evening. BOARD OF ALDERMEN Alderman Homer—The Fire Dept. introducing us to the"Lock Box" will be very helpful for our elderly. The meeting about the Missouri River had a greater number attend this meeting with MARC involved and there are discussions of what is existing now and what is wanted in the future. We will be gathering information Alderman Pruett— Nothing to report. Alderman Bowman—Nothing to report. Alderman Thatcher—There is a possibility I may be selected for jury duty for a case where we would be sequestered for three weeks. I will keep you all informed. Alderman Super—Nothing to report.
