ORDINANCE N0.2007-56
AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE CITY LIMITS OF
THE CITY OF RIVERSIDE, MISSOURI BY EMBRACING AND INCLUDING
UNINCORPORATED REAL PROPERTY LOCATED IN A CERTAIN ADJACENT,
UNINCORPORATED AREA OF PLATTE COUNTY, MISSOURI, LYING NORTH
AND WEST OF THE PRESENT CITY LIMITS OF THE CITY OF RIVERSIDE,
MISSOURI, AND HEREINAFTER PARTICULARLY DESCRIBED
WHEREAS, on May 22, 2007, the City of Riverside, Missouri declared by
resolution of the Board of Aldermen its intent to annex the unincorporated territory
described herein into the City of Riverside, Missouri; and
WHEREAS, the real estate is adjacent and contiguous to the present corporate
limits of the City of Riverside, Missouri.
NOW THEREFORE, BE IT ORDAINED by the Board of Aldermen of the City
of Riverside, Missouri, as follows:
Section 1. That the corporate limits of the City of Riverside, in the County of
Platte, State of Missouri, be extended so as to embrace and include all of the real estate
included within the following boundary lines, to-wit:
All that part of the West One Half of Section 5, Township 50, Range 33, Platte
County, Missouri, described as follows: Beginning at the Northwest corner of the
Northwest Quarter of said Section 5; thence South 89 degrees O1 minutes 09
seconds East, along the North line of the Northwest Quarter of said Section 5, a
distance of 2615.07 feet to the Northeast corner of the Northwest Quarter of said
Section 5; thence South 00 degrees 20 minutes 51 seconds West along the East
line of the Northwest Quarter of said Section 5, a distance of 2626.27 feet to the
Southeast corner of the Northwest Quarter of said Section 5; also being the
Northeast corner of the Southwest Quarter of said Section 5; thence South 00
degrees 21 minutes 08 seconds West along the East line of the Southwest Quarter
of said Section 5, a distance of 128.89 feet to the Northerly Right-of--Way line of
Missouri State Route 9; thence North 57 degrees 03 minutes 17 seconds West,
along said Right-of--Way line, a distance of 627.08 feet; thence continuing along
said line North 69 degrees 37 minutes 59 seconds West, a distance of 289.80 feet;
thence continuing along said line North 74 degrees 19 minutes 48 seconds West, a
distance of 445.37 feet; thence continuing along said line North 73 degrees 52
minutes 59 seconds West, a distance of 1085.20 feet; thence continuing along said
line North 82 degrees 34 minutes 55 seconds West, a distance of 343.65 feet to
the West line of the Northwest Quarter of said Section 5; thence North 00 degrees
21 minutes 59 seconds East, along the West line of the Northwest Quarter of said
Section 5, a distance of 1892.11 feet to the Point of Beginning. Said Tract
contains 133.27 Acres more or less.

Section 2. The perimeter of the area as described above is 10,055.161ineaz feet
and the length of the contiguous boundary common to the existing corporate limits of the
City of Riverside, Missouri, and the area being annexed is 5,548.701ineaz feet, which
length is equal to at least fifteen percent of the length of the perimeter of the azea being
annexed.
Section 3. The Board of Aldermen of the City of Riverside, Missouri, has
determined, and does hereby fmd and determine, that the annexation is reasonable and
necessary to the proper development of the City, that the City is able to furnish normal
municipal services to the area within a reasonable time after the annexation, and that it is
in the best interest of the City and its citizens to annex the property described herein.
Section 4. The City of Riverside, Missouri has developed a Plan of Intent to
provide services to the azea on the same basis upon which services aze presently provided
to the residents of the City.
Section 5. A public hearing considering this matter shall be held at the City Hall
in Riverside, Missouri, at 7:00 p.m. on Tuesday, July 10, 2007, at which time the Plan of
Intent will be presented.
Section 6. The City Clerk of the City of Riverside, Missouri is hereby ordered to
cause notice of this public hearing to be published and served upon all fee owners of
record within the area proposed to be annexed by certified mail, not less than thirty nor
more than sixty days before the hearing, and notify all residents of the area by publication
of notice in a newspaper of general circulation qualified to publish legal matters in Platte
County, Missouri, at least once a week for three consecutive weeks prior to the hearing,
with at least one such notice being not more than twenty days and not less than ten days
before the hearing.
Section 7. Provided that the annexation of the azea described herein is subject to
the approval of the voters to the extent required by Sec. 71.015 RSMo.
Section 8. Provided that the annexation of the azea described herein is subject to
the City of Riverside, Missouri, obtaining a declazatory judgment from the Circuit Court
of Platte County, Missouri authorizing the annexation.
Section 9. The annexation of the above described azea shall be effective
immediately upon approval and authorization as provided in Section 7 and Section 8 of
this Ordinance, and no more than thirty-six months following any election as provided in
Section 7 of this Ordinance.

Section 10. This Ordinance shall take effect immediately.
