'.,~, BILL NO.2006-22 ORDINANCE N0.2006-22 AN ORDINANCE AMENDING TITLE IV, SECTIONS 405.070 AND SECTIONS 420.020 REGARDING OFF-STREET PARKING AND LOADING REGULATIONS MINIMUM REQUIREMENTS FOR LAYOUT AND DESIGN WHEREAS, the City of Riverside, Missouri (the "City") is charged with protecting the public health, safety, and welfare, and desires to do so fairly and responsibly; and WHEREAS, the City desires to implement zoning mechanisms intended to protect this public health, safety, and welfare; and WHEREAS, the City Planning & Zoning Commission, at a public hearing held on December 19, 2005, considered and discussed amendments to the City Code's Section regarding Off Street Parking and Loading Regulations Minimum Requirements for Layout and Design; and WHEREAS, after such consideration and discussion, the Planning & Zoning Commission recommended that the City's Board of Aldermen adopt the proposed amendments; and WHEREAS, during a public hearing held during its meeting on December 27, 2005, the Board of Aldermen considered and discussed the proposed amendments and the recommendation of the Planning & Zoning Commission; and WHEREAS, the Board of Aldennen has determined it to be in the City's best interests to accept the Planning & Zoning Commission's recommendation and adopt the proposed amendments, NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. Section 405.070 of the City Code of the City of Riverside regarding the definition of "Parking Space" is hereby amended and shall read as follows: SECTION 405.070: DEFINITIONS [Definitions for "Accessory Building or Use" to "Parking Lot, Commercial" are unchanged] PARKING SPACE: Space within a public or private parking area for the storage of passenger automobile or commercial vehicle permanently reserved for the temporary storage of one (1) automobile and connected by anall-weather hard surfaced driveway which affords satisfactory ingress and egress for automobiles. [Definitions for "Planning Commission" to "Zoning Code" are unchanged] Section 2. Section 420.020 of the Municipal Code of the City of Riverside regarding Off-Street Parking Regulations is hereby amended and shall read as follows: .r SECTION 420.020.D: Minimum Requirements For Layout and Design 1. The provisions of this Section apply to all vehicle parking spaces and pazking areas, whether the parking meets or exceeds the number of spaces established in this Chapter to serve a particular use or the pazking lot is operated as a principal use on a property and not dedicated to servicing a particular use. A. Vehicle parking spaces. 1. Every parking space shall provide a useable rectangular azea at least nine (9) feet wide by eighteen (18) feet long. Access aisles shall not encroach into this minimum rectangular area. Every parking space shall be clearly demazcated by lines painted on or otherwise applied to the pazking lot surface. 2. Off-street pazking facilities for trucks at restaurants, service stations, and other similar and related uses shall be of sufficient size to adequately serve trucks and not interfere with other vehicles that use the same facility. Such truck spaces shall not be less than ten (10) feet in width by sixty-five (65) feet in length. B. Access and circulation. 1. Access aisles in pazking lots shall have the dimensions described in Table 420.020.D.2.a.i and Table 420.020.D.2.a.ii below. One-way traffic aisles must be clearly marked with directional arrows on the pavement at each intersection with another aisle. This ordinance shall take effect immediately. Parking areas shall be designed so that sanitation, emergency and other public service vehicles can serve the development without backing unreasonable distances or making other dangerous or hazardous turning movements. The minimum width of driveways for ingress and egress shall be the same as those specified above for aisles. Driveway width, for the purpose of this section, shall include only the pavement and not the curbs and gutters. Section 3. The provisions of the Municipal Code of the City of Riverside, Missouri revised herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. Section 4. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Section 5. This Ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri.
