HomeMy WebLinkAbout2004-03-16Minutes of Regular Meeting of Board of Aldermen of City of Riverside, Missouri March 16, 2004 A special meeting of the Boazd of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, Mazch 16, 2004 at 7:30 p.m. Those in attendance were Mayor Betty Burch, Aldermen Bums, Looker, Dazata, Legaard, Super and Beard. Also present were, David Blackburn, City Administrator, Louise Rusick, City Clerk, Chief Wylie Simpson, John Jackson, City, Engineer, Brent Miles, Planning, Zoning and Community Development Coordinator and John McClelland, City Attorney's office. Comments by Visitor Mayor Burch recognized Nathan Garvis with Troop #333 observing the meeting for his requirement to obtain a community service award. Minutes, Feb 24, 2004 Alderman Legaard moved that the minutes of February 24, 2004 be approved, Approved seconded by Alderman Darata, the vote was: Aye: Aldermen Looker, Legaazd, Burris, Darata, Beazd and Super. Motion carries. Minutes, Mar 2, 2004 Alderman Super moved that the minutes of March 2, 2004 be approved, Approved seconded by Alderman Burris, the vote was: Aye: Aldermen Looker, Dazata, Super, Legaard, Beazd and Bums. Motion carries. Public Hearing Opened Mayor Burch opened the Public Hearing at 7:38 that was continued from the Mazch 2°d meeting for a request from Beverly Lumber to consider a Special Use Permit for development in a regulatory floodway fringe and for outside storage as described in Riverside Municipal Code Sect. 410.120.7. Public Hearing Aldemum Looker moved to continue the Public Hearing until the April 6`" Continued meeting, seconded by Alderman Darata, the vote was: Aye: Aldermen Legaazd, Beard, Looker, Bums, Darata and Super. Motion carries. Building Permit A request was presented for a building permit for Midwest Construction. discussion Mayor Burch asked Mr. Holloway if the porch and canopy had been removed. He said he didn't know he was supposed to remove it. Mayor Burch said she thought a letter had been sent to him regarding this matter. The matter will be investigated. Mins. 3/16/04 Building Permit Alderman Legaazd moved to approve a building permit for Midwest Midwest Construction Construction, Tom Holloway, 4712 NW Gateway and the address of the 4706-4710 NW Gateway work at 4706-4710 NW Gateway to remodel for the purpose of future tenants Approved occupancy with the staff recommendations aze attached to these minutes, seconded by Alderman Looker, the vote was: Aye: Aldermen Super, Darata, Bums, Legaard, Beard and Looker. Motion carries. Change of Use Perrnit Alderman Looker moved to approve a Change of Use Permit for Cappo for Cappo Masonry Masonry, 4301 NW Tullison Road, (the west portion of the building) with some 4301 W. Tullison temporary outside storage and with the understanding any permanent outdoor storage of any type is granted only under a "Special Use Permit" and any outdoor storage will be considered a violation of City Municipal Code, seconded by Alderman Darata, the vote was: Aye: Aldermen Darata, Burris, Legaazd, Beazd, Looker and Super. Motion carries. McGowan Gordon Arlen Kleinsorge and Ken Henton discussed the progress on the new Public and Hoefer Wysocki Safety Building stating the drywall is now in, painting will start next week, the discussion re: the new (sheet metal) roof has been installed. Curb and gutter installation will start in Public Safety Bldg the next couple of weeks and a retaining wall. To this date, the change orders amount is $188,846. Contingency is $34,267.00. McGowan Gordon's Alderman Darata moved to approve Change Orders #19,21,22,25,28 and 29 Change Orders request in the amount of $19,366.00 with the condition Hoefer-Wysocki will pay Approved half of the Change Order #22 for $12,509.00 (the city will receive a credit) as the change order is for supplying and installing the structural support for the operable panel partition, seconded by Alderman Looker, the vote was: Aye: Aldermen Legaazd, Beazd, Looker, Darata, Super and Bums. Motion carries. Motion for Closed Alderman Darata moved that the meeting go into closed session, pursuant to Session at 8:10 p.m. RSMo 610.021(1) for discussion of Legal Issues, with the City Attorney, seconded by Alderman Legaard, and the vote was: Aldermen Super, Beazd, Legaazd, Bums, Darata and Looker. Motion carves. Motion for Open Alderman Legaazd moved that the meeting go into open session, seconded by Session Alderman Looker, and the vote was: Aye: Alderman Burns, Beard, Super, Darata, Looker and Legaard. Motion Carries. Minn. 31/6/04 Bill No. 2004-24 Alderman Beard moved to place Bill No. 2004-24 on its first reading, Payment of said Bill authorizing the payment of certain indebtedness listed therein, Indebtedness seconded by Alderman Super, the vote was: Aye: Aldermen Burns, Super, Looker, Legaazd, Darata and Beazd. Motion carries. Ordinance No. 2004-24 Alderman Bums moved to place Bill No. 2004-24 on its second reading, Approved and upon passage of same become Ordinance No. 2004-24, seconded by Alderman Looker, the vote was: Aye: Aldermen Beard, Darata, Bums, Super, Legaazd and Looker. Motion carries. Mayor Burch's' Mayor Burch read a letter from Carol Gossett, "CLG" Enterprises, Inc Comment regazding consulting services concerning the I-635 Interchange and Land development. The contents of the letter states she would like $50,000 plus $100. per hour and $65. hour for support services and Argosy is agreeable to co-share this cost. Bill No. 2004-25 Alderman Beard moved to table Bill No. 2004-25 said Bill amending Amend. Title II, Chapt Title II, Chapter 210 of the Municipal Code of the City of Riverside, Mo 210 of the city code by by adding a new Section 210.255: Skateboazding prohibited or not allowed adding a new Sec. in certain azeas, seconded by Alderman Burris, the vote was: 210.255 Skateboazding Aye: Alderman Legaazd, Beard, Looker, Bums, Super and Looker. Motion carries. Bill No. 2004-26 Alderman Dazata moved to place Bill No. 2004-26 on its first reading, Approving the form of said Bill approving the form of, and authorizing the Mayor to complete & author. the Mayor and execute an agreement by and between the City of Riverside, Missouri to complete and execute and Patek and Associates, LLC regarding consulting services for a total an agreement between of $30,000, not including reasonable expenses (the "Agreement"), seconded by Patek & Assoc & the Alderman Super, the vote was: City Aye: Aldermen Beard, Looker, Darata, Burris, Super and Legaard. Motion carries. Ordinance No. 2004-26 Alderman Burris moved to place Bill No. 2004-26 on its second reading, Approved and upon passage of same become Ordinance No. 2004-26, seconded by Alderman Darata, the vote was: Aye: Aldermen Beard, Dazata, Bums, Super, Legaard and Looker. Motion carries. Bill No. 2004-27 Alderman Looker moved to table Bill No. 2004-27 said Bill approving Approv. The form of the form of, and authorizing the Mayor to complete and execute an agreement & author. the Mayor by and between the City of Riverside, Missouri and CLG Enterprises, Inc. to complete and execute regazding consulting services, seconded by Alderman Darata, the vote was: an agreement with CLG Mins 3/16/04 Aldermen's & Mayor Burch's comments Adjournment Enterprises, Inc. tabled Aye: Aldermen Legaazd, Looker, Darata, Burris, Super and Beard. Motion carries. Alderman Looker asked about resident, Karen Gordy's yard problem. Larry Meyer placed dirt in the troubled azea, but there is a wash problem. Grass doesn't grow along Gary McMichael's driveway. Alderman Dazata says the defective street light on Hermosa appears to be fixed. Mayor Burch said the tax issue, if passed, would be segregated from other funds. By unanimous decision, the meeting adjc Minn. 3/16/04 Planning Commission City of Riverside Staff Analysis Report Applicant: Tom Holloway-Midwest Construction Case Number: PC03-26 Location: 4706-4710 NW Gateway Requested Action: Building Permit & Site Development Plan Adiacent Zoning & Land Use Direction Zonin Land Use Activi North CPO Civic Professional Office South CPO Civic Professional Office East C-1 Commercial West R-3 Multi-Famil Project Description The applicant, Tom Holloway, has submitted a site development plan and is wishing to obtain a building permit for renovations to the building located at 4706-4710 NW Gateway. The applicant will be doing the proposed renovations to the building for the purpose of showing the building for a possible tenant finish. This building permit is for the "shell" of the building, and any occupant will need to obtain a "Change of Use Permit" and a building permit for tenant finishes. Due to this being the "shell" permit, a site plan must also accompany the application, and must meet the requirements of Chapter 450 of Riverside Municipal Code. 1 Staff Analysis Zoning The property is zoned "CPO" Civic and Professional Office District. A use has not been determined for the building as of 3/7/04, but all tenants must conform in use to Appendix B OF Title N of the Riverside Municipal Code. Appendix B is the list of all permitted and special uses in the "CPO" district. Parking & Circulation Parking for this project is defined in Chapter 420 of Riverside Municipal Code. The parking calculations for this project must use the strictest use possible since ause/tenant is unknown at this time. With this, the shell must have thirty-six (36) parking spaces. The applicant on the original site plan indicated only thirty-four (34) spaces. Meeting with the applicant, the two needed spaces will be added to the south side of the building. The placement of these two spots will be indicated on the site plan presented to the Planning & Zoning Commission. The site plan for this project has thirty-six (36) parking spaces. Within these 36 spaces is the required 2 ADA spaces needed for this proposed site. The original site plan submitted by the applicant indicated two one-way drives. Staff does not believe that this is the best circulation pattern and recommends changing the southernmost drive to a two-way drive for circulation to the spaces located on the south side of the building. Sign striping need to be incorporated into these drives for directional purposes. The original site plan submitted indicates a thirteen (13) foot island on the east side abutting Gateway Drive. This distance is incorrect, and meets the proper setback of fifteen (15) feet. This distance also affects the isle lane width, indicated on the plan as fifteen (15), but will actually be seventeen (17) feet. This is an adequate drive aisle for double stacked 45° parking lanes. Landscaping No landscaping plan has been submitted at this time. Staff would recommend that the landscaping be deferred until improvements along Gateway Drive are made. Lighting No lighting plan was submitted. Existing lighting is present on the east side building of the building in the form of can lighting under the canopy. This is an existing structure and much of the parking lot is already existing as well. If two or more of the tenant spaces are occupied by retail tenants and/or have hours of business after 6:00 p.m., then the parking areas should be lighted in conformance with Section 410.088.P. The Planning & Zoning Commission has the power to recommend that at a minimum, metal halide wall pack lighting be installed on the south side of the building. Staff Recommendation ^ Two (2) additional parking spaces be added to the site. This will be checked at inspection and occupancy will not be granted until all items on the site plan and any recommendations from the Governing Bodies are in place. ^ Directional signage and striping for drives. ^ Landscaping be deferred until improvements along NW Gateway are made. ^ Exit signs be added to all doors. Exit signs must be installed before occupancy is granted. ^ GFIC outlet added to all bathrooms. GFIC outlets must be installed prior to occupancy being granted. ^ Smoke detectors are not illustrated on the plan. Smoke detectors must be installed before occupancy is granted. ^ All tenants must obtain "Change of Use Permit" and "Building Permits" when applicable. ^ Paving be installed per site plan. ^ Lighting recommendation from Planning & Zoning Commission.
