AN ORDINANCE AMENDING TITLE I, GOVERNMENT CODE OF
THE MUNICIPAL CODE OF THE CITY OF RIVERSIDE, MISSOURI,
BY REVISING AND RESTATING SECTIONS 110.010 THROUGH 110.140,
REGARDING THE ELECTED AND APPOINTED OFFICIALS.- GENERALLY
WHEREAS, the City of Riverside, Missouri (the "Cit}~') has in place regulations
addressing the elected and appointed officials, and the requirements for qualifying, and the duties
and power of each position; and
WHEREAS, the City and its staff have reviewed of the City's Municipal Code (the
"Code") sections regarding the elected and appointed officials, and have determined that the
provisions must be revised and clarified so as to conform to state statutes and allow for greater
ease of use, uniformity, simplicity, and clarity; and
WHEREAS, the City staff and the Board of Aldermen have reviewed, examined and
deemed adoption of the amended and restated Code provision regarding the elected and
appointed officials to be advisable and in the City's best interests for the promotion of the health,
safety and welfare of the residents of the City;
NOW, THEREFORE, be it ordained by the Board of Aldennen of the City of Riverside,
Missouri, as follows:
Section 1. Article I. Elected and Appointed Officials -Generally, Sections 110.010
through 110.140, inclusive, of the Municipal Code of the City of Riverside, Missouri are hereby
repealed in their entirety and replaced to read as follows:
A. ARTICLE I. ELECTED AND APPOINTED OFFICIALS -- GENERALLY
SECTION 110.010: ELECTED OFFICERS
The Mayor and members of the Board of Aldermen are hereby declared to be the only officers of
the City of Riverside to be elected by the people.
SECTION 110.015: ANY ELECTED OFFICE -QUALIFICATIONS
No person shall be certified as a candidate for a municipal office, nor shall such person's name
appear on the ballot as a candidate for such office, who shall be in arrears for any unpaid City
taxes or municipal user fees on the last day to file a declaration of candidacy for the office.
SECTION 110.020: ALDERMEN -- QUALIFICATIONS
No person shall be an Alderman unless he/she be at least twenty-one (21) years of age, a citizen
of the United States, and an inhabitant and resident of the City for one (1) year next preceding
his/her election, and a resident of the ward from which he/she is elected.

SECTION 110.030: MAYOR -QUALIFICATIONS
No person shall be Mayor unless he/she be at least twenty-five (25) years of age, a citizen of the
United States and a resident of the City at the time of and for at least one (1) year next preceding
his/her election.
SECTION 110.040: APPOINTIVE OFFICERS
The City Administrator, Municipal Judge, City Prosecutor, City Clerk, Treasurer, Attorney,
Assistant Attorneys, Engineer, Director of Public Safety and Secretary to the Board of Aldermen
are hereby declared to be appointive officers of the City.
SECTION 110.050: EMPLOYEES
All persons holding or that may hold other positions under the City Government other than those
set forth in Sections 110.010 and 110.020 of this Article are hereby declared to be employees.
SECTION 110.060: TERM OF OFFICE
Terms of all elected officials shall be for two (2) years or until their successors are elected and
qualified. The term of the appointive officers shall be until resignation or termination. The
Mayor may, with the consent of a majority of all the members elected to the Board of Aldermen,
remove from office any appointive officer of the city at will, and any such appointive officer
may be so removed by atwo-thirds vote of all the members elected to the Board of Aldermen,
independently of the Mayor's approval or recommendation.
SECTION 110.070: DUTIES AND POWERS OF THE CITY ADMINISTRATOR
A. Chief Administrative Oj~cer. The City Administrator shall be the Chief
Administrative Officer of the City Government and subject only to the direction
of the Board of Aldermen. Except as otherwise specified by ordinance or by the
law of the State of Missouri, the City Administrator shall coordinate and generally
supervise the operation of all departments of the City of Riverside.
B. Purchasing. The City Administrator shall be the Purchasing Agent for the City of
Riverside and all purchases shall be made under his/her direction and supervision,
and all such purchases shall be made in accordance with purchasing rules and
procedures approved by the Board of Aldermen.
C. Budget. The City Administrator shall be the Budget Officer of the City of
Riverside and shall assemble estimates of the financial needs and resources of the
City for each ensuing year and shall prepare a program of activities within the
financial power of the City, embodying in it a budget document with proper
supporting schedules and an analysis to be proposed by the Mayor and the Board
of Aldermen for their final approval. As Budget Officer, the City Administrator
shall project the City's short and long term expenditures and shall be responsible
for recommending investments which are approved by law and which maximize
the City's financial return.

D. Financial Reports. The City Administrator shall make monthly reports to the
Mayor and the Board of Aldermen relative to the financial condition of the City.
Such reports shall show the financial condition of the City in relation to the
Budget.
E. Annual Report. The City Administrator shall prepare and present to the Mayor
and the Board of Aldermen an annual report of the City's affairs, including in such
report a summary of reports of department heads and such other reports as the
Board of Aldermen may require.
F. Personnel System. The City Administrator shall act as the Personnel Officer of
the City and shall recommend an appropriate classification system and pay plan to
the Mayor and Board of Aldermen. The City Administrator shall have the power
to appoint and remove, with the approval of the Mayor and a majority of all the
members elected to the Board of Aldermen, or a two thirds vote of all the
members elected to the Board of Aldermen independently of the Mayor's
approval or recommendation, all department heads and subordinate employees of
the City of Riverside. The City Administrator shall be responsible for the proper
administration of the City's personnel system, including all communications to
subordinate employees regarding work assignments and job performance.
G. Policy Formulation. The City Administrator shall recommend to the Mayor and
Board of Aldermen adoption of such measures as he/she may deem necessary or
expedient for the health, safety or welfare of the City or for the improvement of
administrative services for the City.
H. Board Of Aldermen Agenda. The City Administrator shall submit to the Mayor
and Board of Aldermen a proposed agenda for each meeting at least forty-eight
(48) hours before the time of the regular Board of Aldermen meeting.
I. Board And Committees. The City Administrator shall work with all City Boards
and Committees to coordinate the work of each.
J. Attend Board Of Aldermen Meetings. The City Administrator shall attend all
meetings of the Board of Aldermen.
K. Bid Specifications. The City Administrator shall supervise the preparation of all
bid specifications for services and equipment, and receive sealed bids, open the
bids in the presence of one (1) or more witnesses, review, and make
recommendations for acceptance to the Board of Aldermen.
L. State And Federal Aid Programs. The City Administrator shall coordinate
Federal and State programs which may have application to the City of Riverside.
M. Conference Attendance. The City Administrator shall attend State, Regional,
and/or National Conferences and programs applicable to the office and the
business of the City of Riverside, whenever such attendance is directed and
approved by the Board of Aldermen.

N. Press Release. The City Administrator or his designee shall be responsible for
keeping the public informed in the purposes and methods of City Government
through all available news media and shall act as the only spokespersons for City
news releases and conferences.
O. Record Keeping. The City Administrator shall keep full and accurate records of
all actions taken by him/her in the course of his/her duties, and shall safely and
properly keep all records and papers belonging to the City of Riverside and
entrusted to his/her care. All such records shall be kept on the premises at City
Hall and remain the property of the City of Riverside, and open to inspection by
the Mayor and the Board of Aldermen at all times.
P. Miscellaneous. In addition to the foregoing duties, the City Administrator shall
perform any and all other duties or functions prescribed by the Board of
Aldermen.
Q. City Property. The City Administrator shall be accountable to the Board of
Aldermen for all real and personal property of the City of Riverside. He/she shall
have responsibility for all inventories of such property and for the upkeep of all
such property. Personal property maybe sold by the City Administrator only with
approval of the Boazd of Aldermen. Real property may be sold only with the
approval of the Board of Aldermen by ordinance.
R. Set Administrative Policies. The City Administrator shall recommend to the
Board of Aldermen such rules and regulations as he/she may deem necessary or
expedient for the conduct of administrative agencies subject to his/her authority.
He/she shall have the power to revoke, suspend, or amend any rule or regulation
of the administrative service, subject to the approval of the Board of Aldermen.
S. Coordinate Department. The City Administrator shall have the power to
coordinate the work of all the departments of the City, and at times of an
emergency, shall have authority to assign the employees of the City to any
department where they aze needed for the most effective discharge of the
functions of City Government.
T. Investigate And Report. The City Administrator shall have the power to
investigate and to examine or inquire into the affairs or operation of any
department of the City under his/her jurisdiction, and shall report on any
condition or fact concerning the City Government, requested by the Mayor or the
Board of Aldermen.
U. Coordinate Officials. The City Administrator shall have the power to overrule
any action taken by a department head, and may supersede him/her in the function
of his/her office.
V. Appear Before The Board Of Aldermen. The City Administrator shall have the
power to appeaz before and address the Board of Aldermen at any meeting.

W. Administrator May Not Supersede Action Of The Board Of Aldermen. At no time
shall the duties or powers of the City Administrator supersede the action by the
Board of Aldermen.
SECTION 110.080: DUTIES OF CITY CLERK
The duties of the City Clerk shall be as follows:
1. To keep a journal of the proceedings of the Board of Aldermen (the minutes).
2. To keep all ordinances and code books current.
3. To safely and properly keep the records and papers belonging to the City which
maybe entrusted to her care.
4. To be the general accountant for the City.
5. To administer official oaths.
6. To administer oaths to persons certifying to demands or claims against the City.
7. To do such administrative duties as may be delegated to her. by the Mayor or
City Administrator.
8. To attend all regular and special meetings of the Board of Aldermen unless
otherwise directed by the Mayor or Board of Aldermen.
9. To collect all taxes and sums due to the City of Riverside and to perform all
statutory duties of the City Collector.
SECTION 110.090: DUTIES OF THE TREASURER
The Treasurer shall keep such records and make such reports as may be required by State
Statute, the ordinances or the Board of Aldermen.
SECTION 110.100: DUTIES OF CITY ENGINEER
The City Engineer shall perform such engineering duties as may be delegated to him/her by the
Board of Aldermen. All records made by him/her or which come into his/her possession shall be
kept on file by him/her.
SECTION 110.110: DUTIES OF CITY ATTORNEY
The City Attorney shall act as counselor for the Mayor and Board of Aldennen on all City
matters, attend all meetings of the Board of Aldermen when requested to attend same by the
Mayor, any member of the Board of Aldermen or the City Administrator. He/she shall represent
the City in all matters of a civil or police nature in which the City may be interested, draw all
ordinances and legal documents, and oversee the retention and supervision of outside counsel in
cases of specialized work.

SECTION 110.120: DUTIES OF THE CITY PROSECUTOR
The City Prosecutor shall prosecute all violations of City ordinances.
SECTION 110.130: DUTIES OF MUNICIPAL JUDGE
The Municipal Judge shall perform all duties imposed upon him/her by the laws of the State.

SECTION 110.140: SALARY OF OFFICERS AND EMPLOYEES
The officers and employees of the City shall receive such salary as may be determined by
ordinance by the majority of the members elected to the Board of Aldermen.
Section 2. The provisions of the Municipal Code of the City of Riverside, Missouri revised
herein shall not be construed to revive any former ordinance, clause or provision of the
Municipal Code of the City of Riverside, Missouri.
Section 3. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and
if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction
order of a court of competent jurisdiction, such ruling shall not affect any of the remaining
phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the
Ordinance not specifically declared to be unlawful shall remain in full force and effect.
Section 4. This Ordinance overrides any conflicting provision or regulation within the
Municipal Code of the City of Riverside, Missouri.
Section 5. This ordinance shall take effect immediately.
