Minutes of Special Meeting of Board of Aldermen of City of Riverside, Missouri Apri120, 2004 A special meeting of the Board of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, Apri120, 2004 at 7:30 p.m. Those in attendance were Mayor Betty Burch, Looker, Darata, Legaard, Super and Beard. Alderman Burris, Absent. Also present were, David Blackburn, City Administrator, Louise Rusick, City Clerk, Chief Wylie Simpson, John Jackson, City Engineer, Brent Miles Community Development Coordinator, Steve Crystal, Matt Kitzi and Deborah Polk, City Attorney's office. Minutes, April b, 2004 Alderman Looker moved that the minutes of Apri16, 2004 be approved, Approved seconded by Alderman Legaazd, the vote was: Aye: Aldermen Darata, Super, Legaazd, Beard and Looker. Motion carries. Public Hearing Opened Mayor Burch opened the Public Hearing at 7:32 p.m. to consider a request for a floodplain development pemrit for construction of the L-385 Levee project. Brent Miles gave a brief staff analysis report to the boazd regarding the Riverside Quindazo Levee District of Platte County's Floodplain Development Pernut for the L-385 Project for construction of a flood protection levee system. The staff analysis report completed by Brent is attached and made a part of these minutes. Public Hearing Closed Mayor Burch closed the Public Hearing at 7:35 p.m. as there were no comments from the Public. Floodplain Dev. PemuU Alderman Beazd moved to approve a Floodplain Development Permit for for const. of the L-385 construction of the L-385 Levee project, seconded by Alderman Looker, the Levee project vote was: Approved Aldermen Looker, Dazata, Super, Legaard and Beard. Absent: Alderman Burns. Motion carries. Public Hearing Opened Mayor Burch opened the Public Hearing at 7:36 p.m. to consider a request for a revision of a floodway generally located between 50's Street and I-635 along Jumping Branch Creek. Brent went over the staff analysis report with the board for this request by T.E. Woods Construction to request a revision to the NFIP map in regazds to errors pertinent to the Gatewoods LLC subdivision. George Butler Associates is applying for a Letter of Map Revision from the Federal Emergency Management Agency to make changes to the floodplain, floodway, and floodway elevations. Public Hearing Opened Mayor Burch opened the Public Hearing at 7:39 p.m to consider a request to rezone property defined as Tract C corrected Plat of Riverchase, a sub- division in Parkville and Riverside, Platte County, Missouri, from R-2 (multi- family Residential) to C-1 (commercial). The business is preparing meals that can be frozen and considered arestaurant/retail. At fast, they will be open afternoons to eazly evenings and they aze moving in to the east of Subway. Building Permit/ Alderman Beazd moved to approve a building permit/site plan and Change of Site Plan, Change Use Permit for Social Suppers, 1839 NW Vivion Road associated with tenant of Use/Social Suppers finish/retaiUoffice, seconded by Alderman Super, the vote was: 1838 IVW Vivion Rd Approved Aye: Aldermen Legaazd,Beazd, Super, Dazata and Looker. Mins. 4/20/04 Building Permit Alderman Legaazd moved to approve a building pernvt for Todd Lee-4935 NW Todd Lee/4935 NW Hillside to erect a 4' cedar fence, with the city taking no responsibility where the Hillside, Approved fence is located on the owners property, seconded by Dazata, the vote was: Aye: Aldermen Super, Looker, Legaard, Beazd and Darata. Absent: Alderman Burns. Motion carries. Discussion for building Ms. Parups said she had an existing driveway and added on to it last yeaz. for Suzanne Parups Building Permit Alderman Looker moved to approve a building permit for Suzanne Parups, 5112 Suzanne Parups NW Memmac to build a new garage, seconded by Alderman Darata, 5112 NW Merrimac the vote was: Approved Aye: Aldermen Looker, Legaard, Dazata, Beazd and Super. Absent: Alderman Burns. Motion carries. Change of Use Permit Alderman Beard moved to table a request for a Change of Use Permit for Fastenal, Tabled Fastenal, 4710 NW Gateway, seconded by Alderman Darata, the vote was: Aye: Aldermen Darata, Looker, Legaazd, Beazd and Super. Absent: Alderman Burns. Motion carries. Change Order for Alderman Looker moved to approve a change order for Leavenworth LEXICO Excavating in the amount of $24,275.00 for fly ash soil amendment, Approved seconded by Alderman Legaard, the vote was: Aye: Aldermen Looker, Darata, Super, Legaard and Beard. Absent: Alderman Bums. Motion carries. Lexico change order Alderman Beazd asked why fly ash was used on a temporary road and discussion John said because the soil was to soft and the fly ash would stiffen it. John Jackson, City John asked for guidance from the boazd regazding the use of NW Woodland Engineer, comments/ as a haul road. request Mayor Burch asked why she was just now hearing about this matter and it could have been taken care of before now. John said he didn't know they we're going to get to this area this soon. The telephone company has six lines that go through the area. Many of E.S.I. trucks are going back and forth across the highway and they will be for 5-6 more weeks for the work on the levee. July 18` the sill will be fmished, weather Mins. 4/20/04 3 permitting. E.S.I. said they will fully rebuild NW Woodland, but they need the board's permission to use NW Woodland as a haul road. Alderman Looker asked if there was any other way. She would like John to talk to E.S.I. about the priorities and the steel grates that were put in place. It was suggested some black top to be used as fill so cazs traveling along the road won't get damaged. The steel plates on West Platte Mayor Burch said she had complaints about people having to wait 20 minutes to get out on the street. Ron said he didn't know of anyone who had to wait 20 minutes to get out on the street, maybe 5-6 minutes. Alderman Super said the biggest complaint is the condition of the sheet. The street got torn up (rain) and the contractor dropped his drop deck on the street traveling back and forth, i.e. E.S.I. worker's or subs and used offroad heavy machines. They are hauling on the south side of Line Creek now. The telephone work and sill is on the south side of Gateway. Alderman Beazd said the road must be kept open. He asked if a temporary road could be built next to NW Woodland, "John said," If there's enough right-of- way. Mayor Burch said if she starts getting complaints (phone calls) she'll be down to City Hall to see John. E.S.I. using NW Alderman Super made a motion approving E.S.I. (Environmental Specialists), to Woodland as a haul use NW Woodland as a haul road during the levee construction with road with contingencies, contingencies that: (the road, NW Woodland) needs to be immediately in better Approved condition; the road should be rendered able to provide ingress and egress for emergency vehicles; and ESI coordinates between public traffic so that E.S.I. doesn't get >saffic priority; seconded by Alderman Dazata, the vote was: Aye: Aldermen Super, Beazd, Legaazd, Dazata and Looker. Absent: Alderman Burris. Motion carries. Mayor Burch said she does not agree with the motion or its approval. McGowan Gordon's Alderman Super made a motion to table Change Order #37 in the amount of request fora change $8,691 for construction services due to the revised grading plan, seconded by order for $8,691 Alderman Darata, the vote was: Aye: Aldermen Legaazd, Beazd, Looker, Dazata and Super. Absent: Alderman Burris. Motion carries. McGowan Gordon's Alderman Looker moved to approve payment to sub contractor for costs Payment request in the ($46,449.00) related to work resulting from revisions to grading plan, pro- amount of $46,449. vided that such approval does not constitute final approval of McGowan Approved Gordon's change order #38 and does not and should not in any manner Mins. 4/20/04 4 constitute a waiver of the city's right to pursue contribution to the pay- ment of such costs and further provided that such approval does not entitle any party to delay claims or payments or any other additional compensation, seconded by Alderman Legaard, the vote was: Aye: Aldermen Super, Darata, Looker, Legaard and Beard. Bldg. 9128 Mazshall Drive, Lenexa, Ks 66215 in the amount of $18,300, seconded by Approved Alderman Dazata, the vote was: Aye: Aldermen Legaard, Beazd, Looker, Darata and Super. Absent: Alderman Burris. Motion carries. Letter of resignation Alderman Legaard moved to accept Dispatcher Judith Volkman's resignation Dispatcher, 7. Vollanan as of April 17, 2004, seconded by Alderman Super, the vote was: Aye: Aldermen Beazd, Looker, Darata, Super and Legaazd. Absent: Alderman Burris. Motion carries. Frank Weatherford, Frank Weatherford, TranSystems Corp. spoke to the board regazding three TranSystems comments options for the Vandepopulier-I-635 project. Frank said they aze working with Intercontinental on the drainage. In addition, right-of--way and permanent drainage easements will be needed and from 9 highway under the I-635 Interchange about thirty acres will be taken. 1. There would be a channel in between the two roads (243' channel)and spreads the roadways out. The volume of traffic making a left turn would cause the channel to be wider. Mins. 4/20/04 2. The channel would be outside of the roadway and two 24' lanes with a 32' median and two left tum lanes and this option would need a section of guardrail. 3. The channel would be on one side of the roadway with a 250' right-of--way and no guard rail is needed. David Blackburn, City Administrator asked who would be responsible for the stormwater control. An investigation will be made on the effect of the overall property. Option #3 for the Alderman Beard moved to approve Option 3 for the I-635 and Vandepopulier I-635 & Vandepopulier project with a 250' right-of--way and a channel on one side of the road and no project, Approved guardrail is needed, seconded by Aldermau Darata, the vote was: Aye: Aldermen Supet, Datata, Legaazd, Beazd and Looker. Brent Miles comments Brent said two master plan dates are in place for rezoning the CPO district and returning the designation to Cl and creating the "Town Center," overlay district and Gateway and Vivion Roads. There will be a Public Hearing May 18'". Craig Rhodes comments Craig Rhodes, Patti Banks Associates said TranSystem's survey does not include their project. The survey done will be "not to exceed". There will be five miles of trails in the city. They aze thinking of going under the railroad with the existing bridge, but are still in negotiations with the railroad on this, too. Bill No. 2004-34 Alderman Looker moved to place tabled bill from the 4-13 meeting Bill No. Approving Patti 2004-34, on its first reading said Bill approving the form of, and authorizing the Banks Assoc. for Mayor to complete and execute, an agreement by and between the City of consulting services Riverside, Missouri and Patti banks Associates (PBA) to perform professional to complete design consulting services to complete design and construction documents for approx- & const. services for imately one (1) mile of a multi-use trail running from E.H. Young Riverfront a one mile trail Pazk north along Line Creek to Renner Brenner Pazk, in the amount of $55,390.00, all reimbursable expenses and the scope of services, seconded by Alderman Darata, the vote was: Aye: Aldermen Legaazd, Looker, Darata, Super and Beard. Absent: Alderman Burris. Motion carries. Ordinance No. 2004-34 Alderman Darata moved to place Bill No. 2004-34 on its second reading, Approved and upon passage of same become Ordinance No. 2004-34, seconded by Alderman Legaazd, the vote was: Aye: Aldermen Beazd, Darata, Super, Legaazd and Looker. Absent: Alderman Bums. Motion carries. Bill No. 2004-37 Alderman Darata moved to place Bill No. 2004-37 on its first reading, Payment of said Bill authorizing the payment of certain indebtedness listed therein, Indebtedness seconded by Alderman Beard, the vote was: Mins. 4/20/04 Aye: Aldermen, Beard, Looker, Super, Dazata and Legaazd. Ordinance No. 2004-37 Alderman Super moved to place Bill No. 2004-37 on its second reading, Approved and upon passage of same become Ordinance No. 2004-37, seconded by Alderman Looker, the vote was: Aye: Aldermen Beard, Legaazd, Super Looker and Dazata. Motion for Closed Alderman Beazd moved that the meeting go into closed session, pursuant to Session RSMo 610.021(1) for discussion of Legal Issues and RSMo 610.021(2) Real Estate with the City Attorney, seconded by Alderman Super, and the vote was: Aldermen Beard, Dazata, Super, Looker and Legaard. C' Cler Mins. 4/20/04 1 City of Riverside Staff Analysis Report Applicant: Riverside-Quindaro Bend Levee District of Platte Count, Missouri Case Number: PC04-16 Location: See attached map Requested Action: Floodplam Development Permit for L-385 Levee Project Project Description The applicant wishes to obtain a "Floodplam Development Permit" for construction of a flood protection levee system in cooperation with the US Army Corps of Engineers (COE). The chief engineer, Affinis Corp., has completed a review of available information in deterrn;n;ng that the construction of the L-385 Levee Project does not increase the 100-year flood elevation as shown in the Riverside, Missouri Flood Insurance Study. Affinis has reviewed the Limited Evaluation Report of the Missouri Levee System Unit L-385 prepared by the US Army Corps of Engineers,. Kansas City District. Affinis declares that-the result of research and review is: ^ In general the alignment of the L-3851evee follows the boundary of the Designated Floodway shown in the flood insurance study. ^ In the vicinity of the Argosy Casino, the L-3851evee encroached on the Designated Floodway. However, water surface profile computations prepared by Stanley Engineering show no increase in the flood elevations within the floodway. ^ The results of the UNET model profiles, calibrated to the 1993 flood event, highlighted in the January 31, 1997 Hydraulic Review indicate no change in the 100-year flood elevations with or without the levee. t Staff Analysis Due to the L-385 Levee unit being located in the floodway in some areas, Chapter 455 of Riverside Municipal Code states that a "No Rise Certificate" must be completed in order to suffice SEMA and FEMA requirements for floodway development. According to Affinis Corp's research and review of available information, Affinis concurs that the construction of the L-385 Levee Project does not increase the 100-year flood elevation of the Missouri River shown in the Riverside, Missouri Flood Insurance Study.
