R-2019-040 A RESOLUTION APPROVING A WASTE DISPOSAL AGREEMENT WITH RADMACHER BROTHERS EXCAVATING COMPANY, INC. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: THAT the Board of Aldermen hereby approves the Waste Disposal Agreement between the City and Radmacher Brothers Excavating Company, Inc., attached hereto in its substantial form, and authorizes the Mayor to execute the agreement on behalf of the City; and FURTHER THAT the Mayor,the City Administrator,and other appropriate City officials are hereby authorized to take all actions as may be deemed necessary or convenient to carry out and comply with the intent of the agreement and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as may be necessary or convenient to perform all matters herein authorized. Rose '.AT'TENT: Robin-,Kincaid, ity Clerk WASTE DISPOSAL AGREEMENT This agreement, made this 1 st day of May A.D., 20 19 , by and between Radmacher Brothers Excavating Company, Inc. hereinafter called the Contractor, and the City of Riverside, Missouri hereinafter called the Owner, WITNESSETH THAT: WHEREAS the Contractor has removed various waste products, deleterious materials and debris from the Right of Way of Project: Route 169 County Clay and WHEREAS the Owner of the adjacent land gives permission for the Contractor, his agents and approved subcontractors to deposit various waste products, deleterious materials and debris on the Owner's land, at the Riverside fill location. THEREFORE it is agreed between the parties hereto that the aforementioned various waste products, deleterious materials and debris may be deposited on the Owner's land and that said Owner shall make no claim for damages from the contractor, his agents, subcontractors or the Missouri State Highway Commission consequent to such deposit.
