HomeMy WebLinkAbout2004-06-15 Minutes of Regulaz Meeting of Boazd of Aldermen of City of Riverside, Missouri June 15, 2004 A regulaz meeting of the Boazd of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, June 15, 2004 at 7:30 p.m. Those in attendance were Mayor Betty Burch, Aldermen Bums, Looker, Darata, Legaazd, Super and Beard. Also present were, David Blackburn, City Administrator, Louise Rusick, City Clerk, Chief Wylie Simpson, John Jackson, City, Engineer, Brent Miles, Planning, Zoning and Community Development Coordinator and Matt Kitzi, City Attorney's office. National Weather Mike Hudson and Lynn Maximuk with the National Weather Service spoke to Service presents the boazd about last yeaz's tornado in the Riverside azea and surrounding azeas. award to the city Mr. Hudson presented the boazd with a plaque saying Riverside is a storm rated community and two road signs saying "Storm Ready Community" 2004-2007. This is a high honor as there are only nine juridisictions in the area that have earned this awazd and four cities and the City of Riverside is one. Visitors speak Mr. Gus Vandepopulier , 5304 NW Walden, Kansas City, Mo. (great grandson regarding Vandepop- of "Blackie" Vandepopulier). "Blackie" was of Belgian descent and farmed the ulier Road land off of Vandepopulier and lived in a house there. The Vandepopulier family would like the name of the road to remain the same and if not, at least some sort of recognition, such as a statue. Joe Vandepopulier, Columbia, Mo. (grandson) is of three grandchildren of "Blackie" and said "Blackie" was instrumental in supporting democracy, politics and so on. Joe would like for the name of the road to remain Vandepopulier. Irene Paulhe, 4700 Petronella Ln. asked the boazd to leave the name of the road Vandepopulier because there's a lot of history. Mayor Burch said this would be taken under consideration. Oleta Roger speaks Oleta Rogers, 5004 NW Merrimac spoke to the Boazd about water running onto to the board her property on June 13'h when it rained. She stated this happens everytime it rains or when the sod is watered on the neazby property, the Northwood Estates Subdivision that includes certain lots owned by Syntec Constmction. Mrs. Rogers showed the Boazd pictures of the lay of the land before construction started on the new homes built by Syntec and after construction. Mrs. Rogers stated that her property was flooded with water and mud several days in June. Mrs. R ogers s fated t hat S yntec C onstruction p romises t o c lean up a nd f ix t he problem and that the Department of Natural Resources cited Syntec Constrnction for violation of its regulations on June 4, 2004. Mrs. Rogers said she was told Syntec was cited May 25, 2004 for not complying with the city's storm water ordinance. She also asked why a wall hasn't been built, and stated that the preventive measures put into place, silt fences, had been taken down. Mrs. Rogers said she would like to see all state inspections that have been done and that the flooding has ruined their landscaping. Mrs. Rogers said Syntec hasn't complied with the storm water ordinance and would like for the boazd to get involved with the storm water ordinance. Mins. 6/15/04 It was stated Aylett Surveying was to be hired by Syntec to solve the problem Minutes, May 11, 2004 Alderman Legaazd moved that the minutes of May 11, 2004 be approved Approved as corrected, seconded by Alderman Dazata, the vote was: Aye: Aldermen Bums, Darata, Super, Legaard, Beard and Looker. Motion carries. Minutes, May 18, 2004 Alderman Looker moved that the minutes of May 18, 2004 be approved Approved as corrected, seconded by Alderman Darata, the vote was: Aye: Aldermen Looker, Dazata, Super, Legaard, Beazd and Burris. Motion carries. Public Hearing Opened Mayor Burch opened the Public Hearing at 8:05 p.m to consider amending the The Municipal Code Section 410.100.2.A, revising carports from a permitted accessory use to an accessory use permitted only by special permit. Public Hearing Closed As there were no comments from the public, Mayor Burch closed the Public Hearing at 8:07 p.m Change of Use for Alderman Beazd moved to approve a Change of Use Permit for Advanced Advanced Hospital Hospital Staffing, 1831 NW Vivion Road, Suite 101, Riverside, Mo, seconded Approved by Alderman Burris, the vote was: Aye: Aldermen Looker, Dazata, Super, Legaazd, Beard and Burris. Motion carries. Building Permit/ Alderman Looker moved to approve a building permit for Advanced Advanced Hospital Hospital Staffing, 1831 NW Vivion Road, Suite 101, Riverside, Mo. tenant Staffing, Approved finish, seconded by Alderman Legaard, the vote was: Aye: Aldermen Beazd, Burris, Looker, Dazata, Super and Legaazd. Motion carries. Building Permit/ Alderman Looker moved to approve a building permit for Marvin Pool, Marvin Pool, 349 NW Woodland to build a wood frame roof, composition shingles, over an 349 NW Woodland existing deck, seconded by Alderman Super, the vote was: Approved Aye: Aldermen Legaard, Beazd, Looker, Burris, Darata and Super. Motion carries. City Administrator David Blackburn, City Administrator said the NlV Gateway project right- Comment of-way documents are being examined. Plans have been submitted by Bucher, Willis, Ratliff. The right-of--way documents must be approved before looking at the street plans. City Engineer comments John Jackson, City Engineer said Missouri Gas Energy has advised him that it would be required to relocate the gas line within the city right-of way on W. Mins. 6/15/04 Platte Rd by Red-X. This would be a bypass for temporary service but, the line will be left as permanent and the cost is $16,380.67 to be paid by Missouri Gas Energy. John will talk to the Corps of Engineers about this even though he said he talked to them before and the Corps said it was okay. Bypass gas line for Alderman Beazd moved to approve the bypass gas line for temporary service, W. Platte reconstruction to remain a permanent line on W. Platte Road by Red-X and subject to Approved approving the payment of (not to exceed) $16,380.67 by the city to expedite Missouri Gas Energy's work, and the city to be reimbursed by Missouri Gas Energy and Missouri Gas Energy is solely responsible for all other costs of relocating its lines, seconded by Alderman Burris, the vote was: Aye: Aldermen Burris, Looker, Darata, Super, Beazd and Legaazd. Motion carries. McCown Gordon's Alderman Beard moved to approve payment in the amount of $765.00, but Change order requests rejects Change Order #52- request for shields for radiant heating located in denied, but payment the fire apparatus bay and payment is approved in the amount of $4,190.00 to Approved remove the piers at the retaining wall, but rejects Change Order request #62a at the new Public Safety Building. These payments aze subject to the city engineer speaking with the architect, seconded by Alderman Looker, the vote was: Aye: Aldermen Legaazd, Beazd, Looker, Darata, Super and Bums. Motion carries. Proposal submitted Alderman Beazd moved to approve payment of $22,632.00 for a new 20 ton for replacement of a new rooftop unit at the city's annex building, 3050 NW Vivion Road, seconded by HVAV roof top unit at Alderman Burris, the vote was: the city's annex bldg, Approved Aye: Aldermen Beazd, Burris and Looker. No: Aldermen Legaazd, Super and Dazata. Mayor Burch broke the tie voting, yes. Motion carries. LEXICO'S change Alderman Beard moved to approve Change Order #0005 in the amount of order in the amount of $2,140 for ADA ramps, red in color, seconded by Alderman Burris, the vote $2,140 Approved was: Aye: Aldermen Legaard, Beazd, Darata, Super and Burris. Municipal Court Alderman Beazd moved to approve the Municipal Court Report for May, Report for May seconded by Alderman Darata, the vote was: Approved Aye: Aldermen Beazd, Looker, Burris, Darata, Super and Legaard. Motion carries. Mins. 6/15/04 Bill No. 2004-56 Alderman Beard moved to place Bill No. 2004-56 on its first reading, Payment of said Bill authorizing the payment of certain indebtedness listed therein, Indebtedness seconded by Aldenman Super, the vote was: Aye: Aldermen Looker, Burris, Super, Legaazd, Beazd and Darata. Motion carries. Ordinance No. 2004-56 Alderman Darata moved to place Bill No. 2004-56 on its second reading, Approved and upon passage of same become Ordinance No. 2004-56, seconded by Alderman Legaazd, the vote was: Aye: Aldermen Burris, Beard, Darata, Legaard, Looker and Super. Motion carries. Bill No. 2004-57 Alderman Beazd moved to place Bill No. 2004-57 on its fast reading, Author. the City said Bill authorizing the City of Riverside, Missouri, to employ Anthony to employ Anthony R. Snyder and Kyle Becker as part-time seasonal employees in the Pazks R. Snyder & Kyle Department for the City of Riverside, Missouri to be effective June 3, 2004 Becker at an hourly rate of $8.50, seconded by Alderman Bums, the vote was: Aye: Aldermen Bums, Dazata, Super, Legaazd, Beard and Looker. Motion carries. Ordinance No. 2004-57 Aldenman Bums moved to place Bill No. 2004-57 on its second reading, Approved and upon passage of same become Ordinance No. 2004-57, seconded by Alderman Super, the vote was: Aye: Aldermen Bums, Beazd, Darata, Legaazd, Looker and Super. Motion carries. Bill No. 2004-58 Alderman Legaazd moved to place Bill No. 2004-58 on its first reading, Author. the City said Bill authorizing the City of Riverside, Missouri, to employ Natalie to employ Natalie Zanders as a seasonal employee/ Night Supervisor at the Community Zanders Center for the City of Riverside, Missouri to be effective June 1, 2004 at an hourly rate of $8.00, seconded by Alderman Looker, the vote was: Aye: Aldermen Legaazd, Beazd, Looker, Darata, Super and Bums. Motion carries. Ordinance No. 2004-58 Alderman Burris moved to place Bill No. 2004-57 on its second reading, Approved and upon passage of same become Ordinance No. 2004-57, seconded by Alderman Super, the vote was: Aye: Aldermen Super, Dazata, Legaazd, Beazd, Looker and Burris. Motion carries. Title N, Title N, Chapter 410 of the Municipal Code of the City of Riverside, Chapt. 410 of the Missouri, by amending Section 410.100: Accessory Uses, seconded by City code amend.. Alderman Dazata, the vote was: Accessory Uses Aye: Aldermen Dazata, Legaard, Beard, Looker, Burris and Super. Motion carries. Ordinance No. 2004-60 Alderman Bums moved to place Bill No. 2004-60 on its second reading, Approved and upon passage of same become Ordinance No. 2004-60, seconded by Alderman Looker, the vote was: Aye: Aldermen Looker, Super, Dazata, Legaard, Beazd and Bums. Motion carries. Motion for Closed Alderman Beazd moved that the meeting go into closed session, pursuant to Session RSMo 610.021(1) for discussion of Legal Issues, RSMo 610.021(2) Real Estate and 610.021(3) Personnel Issues with the City Attorney, seconded by Alderman Looker, and the vote was: Aye: Alderman Beazd, Burris, Looker, Legaazd, Super and Darata Motion Carries. Motion for Open Alderman Darata moved that the meeting go into open session at 10:00 p.m, Session seconded by Alderman Burris, and the vote was: Aye: Aldermen Looker, Legaazd, Beard, Super, Dazata and Bums Motion Carries.
