A RESOLUTION APPROVING AND ACCEPTING A RIGHT OF WAY DEED FROM
PATRICK W. BLYTH AND ALICE M. BLYTH FOR THE BELTON STREET
PROJECT
WHEREAS, the Board of Aldermen finds it to be a public purpose and in the best
interest of the public to acquire certain property further described herein in connection with
construction and maintenance of the Belton Street Project;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF
THE CITY OF RIVERSIDE,MISSOURI AS FOLLOWS:
THAT the Board of Aldermen ("Board") hereby approves and accepts the Right of Way
Deed, in substantially the form attached hereto, from Patrick W. Blyth and Alice M. Blyth,
husband and wife; and
FURTHER THAT compensation in the amount of $10.00 for the Right of Deed is
hereby approved to acquire such Right of Way; and
FURTHER THAT the Mayor, the City Administrator, the City Attorney and other
appropriate City officials are hereby authorized to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Resolution and to execute
and deliver for and on behalf of the City all certificates, instruments, agreements and other
documents, as may be necessary or convenient to perform all matters herein authorized.
PASSED AND ADOPTED by the Board of Aldermen and APPROVED by the Mayor
of the City of Riverside, Missouri, the 2nd day of July 2019.

RIGHT OF WAY DEED
THIS INDENTURE, made this Q N 1�- day of 2019, by and
between: Patrick W. Blyth and Alice M. Blyth, husband and e, w e address is 3403 NW
Belton Street, Riverside, Missouri, 64150 ("GRANTOR"), and the CITY OF RIVERSIDE,
MISSOURI, a Missouri municipality, whose address is 2950 N.W. Vivion Road, Riverside,
Missouri 64150("GRANTEE").
WITNESSETH, that the GRANTOR, in consideration of the sum of Ten Dollars ($10.00)
and other good and valuable consideration to it paid by the GRANTEE,the receipt and sufficiency
of which is hereby acknowledged, does by these presents grant, bargain, sell, convey, and confirm
unto GRANTEE, its successors and assigns, a Right of Way for the construction, improvement,
reconstruction and maintenance of a right of way for public use as a street, roadway or
thoroughfare, including but not limited to,the construction,maintenance and use of conduits,water,
gas, sewer pipes, fiber optic, telecommunication facilities, poles, wires, storm water drainage
facilities, ducts, cables on, over, along, across, and under the following described tract of land
situated in Platte County,Missouri,to-wit:
See Exhibit A,attached
GRANTOR further states that it is lawfully seized of title to the land through which the
Right of Way is granted and that is has good and lawful right to convey the Right of Way to the
GRANTEE herein.
THIS GRANT and right of way shall,at all times be deemed to be and shall be,a continuing
covenant running with the land and shall be binding upon the successors and assigns of the
GRANTOR.
TO HAVE AND TO HOLD THE SAME, together with all appurtenances and immunities
thereunto belonging or in any way appertaining, unto the GRANTEE and to its successors and
assigns forever.
IN WITNESS WHEREOF,the said GRANTOR has hereunto set its hand this g day

County,Missouri, described as follows: Commencing at the Northwest corner of the Northwest
Quarter of said Section 4;thence South 00 degrees 18 minutes 43 seconds West, along the West
line of the Northwest Quarter of said Section 4,a distance of 658.54 feet to the Northwest corner
