HomeMy WebLinkAbout2004-07-06Minutes of Regulaz Meeting of Boazd of Aldermen of City of Riverside, Missouri July 6, 2004 A regulaz meeting of the Boazd of Aldermen of the City of Riverside, Missouri, was held in the City Hall, of Riverside, Missouri, July 6, 2004 at 7:30 p.m Those in attendance were Aldermen Burris, Looker, Dazata, Legaard, Super and Beazd. Mayor Burch, absent. Also present were, David Blackburn, City Administrator, Louise Rusick, City Clerk, Chief Wylie Simpson, Brent Miles, Planning, Zoning and Community Development Coordinator and John McClleland, City Attorney's office. Mike McGrew, Argosy Mike Mcgrew, Director of Construction with Argosy spoke to the boazd Speaks to the boazd about the new pazking garage for Argosy. They aze proposing 1,400 pazking spaces in the gazage. Bill Browning, PGVA showed the sketches of rendering to the boazd of the new Argosy pazking structure. C ity s tall h as b een meeting with necessary contacts regazding the critical zone. August 2004 is the commencement date for the project and July 2005 is the completion date. Brent's comment The under seepage package will be submitted for the critical zone process. Minutes, June 1, 2004 Alderman Legaazd moved that the minutes of Junel, 2004 be approved Approved seconded by Alderman Dazata, the vote was: Aye: Aldermen Burris, Dazata, Super, Legaazd, Beazd and Looker. Motion carries. Minutes June 15, 2004 Alderman Looker moved that the minutes of June 15, 2004 be approved Approved seconded by Alderman Super, the vote was: Aye: Aldermen Bums, Dazata, Super, Legaazd, Beazd and Looker. Motion cazries. Mins. 7/6/04 Public Hearing Opened Mayor Pro-Tem Beazd opened the Public Hearing at 7:50 p.m. to consider an amendment to Riverside Municipal Section 410.087E "GP" General Planned Development District, to allow structures greater than three (3) stories in height. Brent read the staff report that is inserted in these minutes: Summary of Request: Cunently, Riverside Municipal Code Section 410.087, specific district regulations for the "GP" District, does not explicitly state height regulations due to the "GP" District being an overlay zoning district. The height regulations for the "GP" district are regulated by the underlying zoning district, the "I"District, which state "buildings or structures shall not exceedthirty-five (35) feet in height or three stories. Due to the type of development that will occur in the "GP" District, staff believes that height regulations should be amended for this zoning district. Staff has made the following suggestion for amending the Municipal Code regarding height of structures in the "GP" District: 410.087.B.16: Location of proposed buildings and structures and existing buildings and structures to remain, with written dimensions of setback from proposed street right-of--way and adjacent prop lines, dimensions of building width and length, number of floors, gross floor azea per floor, and total building area. • 410.087.D.5: A. Staff Analysis ^ Staff has followed procedure on amending Municipal Code, including publication in a newspaper of general circulation at least fifteen (15) days before the date of the hearing. o Staff believes that this amendment is the best mechanism to allow for the type of development that could possibly occur in the "GP" District. Staff also believes that this amendment gives staff, the Planning & Zoning Commission, and the Boazd of Aldermen the proper devices to control structure height, while still keeping public health and safety in mind when reviewing proposed developments. O Staff would also like to comment that if a development would occur higher than five (5) stories or sixty (75) feet, rezoning the development to a "PD" Planned District would allow for designation of height to be reviewed by staff, the Planning & Zoning Commission, and the Boazd of Aldermen. Mins. 7/6/04 2 Public Hearing Closed Mayor Pro-Tem Beazd closed the Public Hearing at 7:57 p.m, Mike Flowers, Mike Flowers, Aylett Survey did not appeaz to speak regazding the Aylett Survey Northwood Estates Storm Water Management matter. Oleta/Ritchie Rogers Oleta said water is eroding their yard. She said the Department of Natural 5004 NW Merrimac Resources issued the permit after the houses were built. Oleta said the guttering speaks to the board is off (fell off) the house that is being built by Syntec. Brent Miles passed out copies to the boazd of Syntec's grading contract by Aylett Surveying and Engineering Company. This contract has been presented to Janet at Syntec. A swale system is proposed between the two homes on NW Merrimac, as this being the best solution, swales and bemts out the back to duect the water into the swale. John McClelland said the boazd of aldermen does not approve private contracts by landowners and their own engineers. John said a grading plan is needed. The original grading plan needs to be examined. If erosion control ordinances are being violated, a citation should be issued and then a court appearance Alderman Beard agreed, a grading plan is needed. Brent miles informed the boazd that a certificate of occupancy cannot be obtained until the city codes are incomplete compliance. There is lack of sufficient detail at this point in the current grading plan. If the silt isn't being controlled, Syntec will be cited and if Syntec continues to fail to comply, a "Stop Work Order" will be issued. The original grading plan needs to be examined by an engineer. A copy of the Land Disturbance Permit that Syntec received from the Department of Natural Resources in July 2003 needs to be obtained. Building Permit for Alderman Looker moved to approve a building permit for Ryan Richazdson, Ryan Richazdson 5010 NW Strathbury and the Planning Commission's staff analysis report, 5010 NW Strathbury Ryan Richardson, is wishing to obtain a building permit for buildmg a gazden Approved shed. The shed will be approximately ten (10) feet and six (6) feet tall. The shed will be made by anchor bolts to a fourteen (14) by fourteen (14) foot concrete pad four (4) inches thick, seconded by Alderman Burris, the vote was: Aye: Aldermen Super, Legaazd, Beard, Looker, Butris and Dazata. City Admnustrator Comments Change Order #6 for LEXICO, Approved Minn. 7/6/04 Motion carries. David received a letter from MoDot and they said they were reviewing the plans submitted from Bucher, Willis, Ratliff to MoDot regazding NW Vivion and NW Gateway. MoDot said this is a reasonable review. Alderman Looker moved to approve Change Order #6 from LEXICO for over-excavation of unsuitable foundation material for the retaining wall in front of the Animal Hospital at a cost of $4,020.00, seconded by Alderman Burris, the vote was: Aye: Aldermen Legaard, beazd, Looker, Dazata, Super and Bums. _1 Motion carries. Court Report for June Alderman Darata moved to approve the June Court Report, seconded by Approved Alderman Looker, the vote was: Aye: Aldermen Beard, Looker, Bums, Darata, Super and Legaard. Motion carries. Bill No. 2004-65 Alderman Darata moved to place Bill No. 2004-65 on its first reading, Payment of said Bill authorizing the payment of certain indebtedness listed therein, Indebtedness seconded by Alderman Legaard, the vote was: Aye: Aldermen Looker, Burris, Super, Legaard, Beard and Darata. Motion carries. Ordinance No. 2004-65 Alderman Bums moved to place Bill No. 2004-65 on its second reading, Approved and upon passage of same become Ordinance No. 2004-65, seconded by Alderman Legaard, the vote was: Aye: Aldermen Bums, Super, Darata, Legaard, Looker and Beard. Motion carries. Bill No. 2004-66 Alderman Looker moved to place Bill No. 2004-66 on its first reading, Author. the hire of said Bill authorizing the City of Riverside, Missouri, to employ Dawn Dawn M. Gish as a M. Gish as a full time Public Safety Administrative Coordinator in the Public Safety Admin. Department of Public Safety and the salary be set at $28,000.00 annually with a one-year work test period and full benefits to be effective June 17, 2004, seconded by Alderman Burris, the vote was: Aye: Aldermen Bums, Darata, Super, Legaard, Beard and Looker. Motion carries. Ordinance No. 2004-66 Alderman Darata moved to place Bill No. 2004-66 on its second reading, Approved and upon passage of same become Ordinance No. 2004-66, seconded by Alderman Super, the vote was: Aye: Aldermen Super, Darata, Legaard, Looker, Beard and Bums. Motion carries. Bill No. 2004-67 Alderman Super moved to place Bill No. 2004-67 on its first reading, Author. the hire of said Bill authorizing the City of Riverside, Missouri, to employ John John M. Stanfill M. Stanfill as a full time Officer in the Department of Public Safety as a full time P.S. Oflzcer and the salary be set at $32,000.00 annually with aone-year work test period and full benefits to be effective June 21, 2004, seconded by Alderman Legaard, the vote was: Aye: Aldermen Legaard, Beard, Looker, Darata, Super and Bums. Motion carries. Minn. 7/6/04 4 Ordinance No. 2004-67 Alderman Looker moved to place Bill No. 2004-67 on its second reading, Approved and upon passage of same become Ordinance No. 2004-67, seconded by Alderman Darata, the vote was: Aye: Aldermen Burris, Super, Darata, Legaazd, Looker and Beazd. Motion carries. Bill No. 2004-68 Alderman Dazata moved to place Bill No. 2004-68 on its first reading, Author. the hire of said Bill authorizing the City of Riverside, Missouri, to employ Elizabeth Elizabeth A. Simms A. Simms as a full time Dispatcher in the Department of Public Safety and the as Dispatcher in P.S. salary be set at $27,500.00 annually with aone-yeaz work test period and full benefits to be effective June 30, 2004, seconded by Alderman Super, the vote was: Aye: Aldermen Bums, Darata, Super, Legaazd, Beard and Looker. Motion carries. Ordinance No. 2004-68 Alderman Dazata moved to place Bill No. 2004-68 on its second reading, Approved and upon passage of same become Ordinance No. 2004-68, seconded by Alderman Super, the vote was: Aye: Aldermen Super, Dazata, Legaazd, Looker, Beard and Bums. Motion carries. Site Delineation It was mentioned the monitoring wells were taken out. tanks comment for 1914 NW Platte Road Bill No. 2004-59 Author. the accept. of proposal for environ- mental site delineation & risk based corrective action assessment 1914 W. Platte Road Aldemum Looker moved to place Bill No. 2004-59 on its first reading, said Bill authorizing the acceptance of proposal for Environmental Consulting Services by TranSystems Corporation Supplemental Site Delineation and risk based corrective action assessment 1914 W. Platte Road tanks release site, Riverside, Missouri for an amount not to exceed $37,400, seconded by Alderman Burris, the vote was: Aye: Aldermen Darata, Legaazd, beard, Looker, Burris and Super. Motion carries. Aldermen's comments Alderman Legaazd said there was no admission to the "Summer Blast". Alderman Looker asked the boazd be provided with an updated list on the major projects within the city. It was also mentioned the boazd be provided with a roster of new hires. Chief Simpson's Chief Simpson said there were (51) fifty-one complaints on fireworks comment violations. Mins. 7/6/04 +~ Motion for Closed Alderman Legaard moved that the meeting go into closed session, pursuant to Session at 9:35 pm RSMo 610.021(1) for discussion of legal issues with the City Attorney, seconded by Aldertan Dazata, and the vote was: Aldermen Super, Beazd, Legaard, Bums, Dazata and Looker. Motion carries. The City Clerk left at 9:35 p.m Motion for Open Alderman Legaard moved that the meeting go into open session, seconded by Session at 10:30 p.m Alderman Looker, and the vote was: Aye: Alderman Burris, Beazd, Super, Darata, Looker and Legaard.
