FOR STORM SEWER REPAIR PROJECT AT 5014 NW MERRIMAC IN THE CITY OF RIVERSIDE, MISSOURI WHEREAS, the City of Riverside, Missouri ("City") desires to engage the services of a contractor to perform construction services in connection with the Storm Sewer Repair Project located at 5014 NW Merrimac and; WHEREAS, the City requested multiple bids for the Storm Sewer Repair Project and; WHEREAS, Havens Construction Company, Inc. has provided the City with a contract detailing the costs and services approved by the City. NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri as follows: Section 1. The City of Riverside shall employ Havens Construction Company, Inc. to perform the construction services, and shall pay to Havens Construction Company, Inc. an amount not to exceed Six-Thousand Four Hundred Dollars and No/100 Cents ($6,400.00) for such construction services which are described in the bid form attached hereto as Exhibit A ("Agreement for Construction"). Section 2. The contract, in substantially the form attached hereto as Exhibit A, and payment by the City for-the construction services described therein, is approved, and the Mayor is authorized to take such actions reasonably necessary to carry out the intent of this Ordinance on behalf of the City. Section 3. This Ordinance shall be in full force and effect from and after its passage and approval. Passed this 2°a day of May 2006. CONTRACT DOCUMENTS The contract documents consist of this agreement, the conditions of the contract (general, special and other conditions), the drawings, the specifications, all addenda issued prior to and all modifications issued after execution of this agreement. These form the contract and are as fully a part of the contract as if attached to this agreement or repeated herein. Remove Existing 4' 0 Grate Inlet 2. Install new 4' x 4' Field Inlet (Open on all 4 sides) 3. Slope Grades to Drain to the Field Inlet (Up to Approximately 8'-0", in all Directions, from the Structure) 4. Haul-off Removed Grate Inlet Total Estimated Amount $6,400.00 Adjustments to the contract amount for extra work or deductions will be determined by one or more of the following methods: A) By a lump sum price B) By unit prices named in the bid or as otherwise agreed C) By Contractors cost plus ~a fixed fee D) By Contractor's cost plus a percentage SPECIAL CONDITIONS .Adequate access to the site will be provided by others. All dirt is estimated to remain on site. Any soil left will be in a pile or laid over existing grades (no compaction). Haul off and/or haul in are excluded. An insurance certificate will be furnished by Havens. All bonds-and permits are excluded. If any existing utilities are encountered which are in conflict with Havens' work and either these services or the existing utilities must be relocated, this will be considered changed work and an equitable adjustment will be made to the contract. Seeding, sodding and construction staking are to be done by others. This price is based on preliminary plans. Any changes in the final plans are to be renegotiated. ,, w ., ,• ~. City of Riverside, MO Storm Sewer Repair 5014 Merrimac Apri124,2006 Page No. 3 This proposal is based on the use of hoe ramming to aid in the excavation of shale, sandstone, or rock. The cost associated with the use of hoe ramming wilt be an extra cost, which will be billed to the owner on the following basis: 1. In the event shale, sandstone.or rock is encountered while digging and hoe ramming is utilized, there will be an additional charge of $95.00 per cubic yard for every cubic yard excavated. Engineered drawings and as-builts are to be done by others. Rock backfill and/orflowable fill for trenches is NOT included in our bid. Our proposal is subject to acceptance within thirty (30) days. PAYMENT Payment is to be 100% of the monthly estimate, due within 30 days of the date of the invoice. Final payment, constituting the entire unpaid balance of the contract .sum, shall be paid by the owner to the contractor when the work has been completed.
